(2) Corrective Action: IMMEDIATELY discontinue all prohibited home occupation activities. Prohibited home occupations include: vehicle repair and/or maintenance; rebuilding motors; painting vehicles; welding; sheet metal shops; upholstering; firewood cutting, any group H Occupancy as defined in the International Building and Fire Code adopted by the City and any other uses that are similar in nature. Description: INOPERABLE VEHICLES STORED IN FRONT OF THIS PROPERTY ON THE CITYRIGHT OF WAY. PMC 25.70.150 (2) (a -d) (1) Violation: Only one (1) inoperable vehicle may be stored outside of a fully enclosed building on the property in any residential zone. The vehicle shall not be stored upon a public right-of-way or in the front or side yard areas of the property. The vehicle must be locked and secured at all times it is unattended and must be stored on an approved hard surface (i.e. gravel, asphalt or concrete) behind a completely enclosed six (6) foot fence, which is fully sight obscuring. All vehicle parts not properly installed upon a vehicle shall be stored inside a fully enclosed building or within the vehicle itself. (2) Corrective Action: Store all inoperable vehicles within an enclosed building (such as a garage or shed). One vehicle may be stored outside an enclosed building in compliance with the provisions above. All other vehicles must be removed from the property or made operable. Store all vehicle parts in an enclosed building, within the vehicle or remove the parts from the property. Description: FRONT YARD LANDSCAPING NOT BEING MAINTAINED. PMC 25.75. 110 (1) (1) Violation: Failing to maintiain landscaping and/or screening free of weeds and trash and not providing, protecting, and permanently maintaining all landscaping material, areas and plants in a healthy, growing condition, replacing it when necessary. (2) Corrective Action: Remove and lawfully dispose of all weeds and trash and replace any dead/dying plants and other vegetation. PMC 25.78.030 (2) (1) Violation: Using the driveway for the storage of equipment or materials, or for the sale, repair or servicing of vehicle(s). (2) Corrective Action: Discontinue any of the actions described above. All vehicle repairs must be for personal vehicles only and must be performed within a fully enclosed building. Equipment and other materials must also be stored within an enclosed building. Description: WEEDS IN FRONT YARDS PMC 9.60.030 (16) (1) Violation: Weeds, noxious weeds, grass, and other vegetation which constitutes a fire hazard, encroaches on sidewalks or neighboring properties, is damaging public improvements, impairs the vision of traffic signs or signals, and/or has reached a height of twelve inches (12"). (2) Corrective Action: Eradicate weeds by chemicals, cutting or other acceptable means so that they do not exceed twelve inches (12"), encroach on neighboring properties, constitute a fire hazard, etc. Weeds that are cut or removed by the root must be removed from the property and lawfully disposed of. Description: VEHILE PARTS STORED/LOCATED INPUBLIC VIEW. PMC 9.60.030 (9) (1) Violation: Scrap metal, ashes, bric-a-brac, broken stone or cement, broken crockery, broken glass, broken plaster, automobile bodies and/or parts, and all such trash or abandoned material that are not kept in approved containers. (2) Corrective Action: Remove all vehicle parts, scrap metal, machinery, disassembled vehicles, etc. from the property or store these items in an enclosed container or building. Remove and lawfully dispose of all junk items (e.g. any items or which have served their intended original purpose) and unusable vehicle parts. Description: VEHICLE PARTS IN PUBLIC VIEW PMC 9.62.050 (A) (1) Violation: Permitting the storage of any unauthorized junk motor vehicle or parts thereof on private property. (2) Corrective Action: Remove and lawfully dispose of all junk vehicle(s) and vehicle parts or store them in an enclosed building. CEB2016-0456 205 W BONNEVILLE ST - JUAN M & JULIA E CONTRERAS, owner Debbie Scott, Code Enforcement Officer Description: FAILURE TO LICENSE THE SMALL DOG ONSITE (NOTA PUPPY) PMC 8.02.190 (1) Violation: All dogs over seven (7) months of age must be licensed with the City of Pasco. (2) Corrective Action: License all dogs over the age of seven (7) months with the City of Pasco (please call (509) 545-3488 for more information). CEB2016-0460 223 S 24TH AVE - SKIRT INVESTMENTS LLC, owner Rosanna Johnson, Code Enforcement Officer Description: Failure to obtain a permit for the temporary structure (carport) erected on the East side of the building. PMC 16.04.010 (1) Violation: Failure to secure a City of Pasco building permit. CEB Agenda Page 2 of 10 (2) Corrective Action: Discontinue all construction activities and submit an application for a building permit from the City of Pasco (please call (509) 543-5726 for information on permit requirements). If no permit can be obtained, unpermitted construction must be removed. Description: Remove or paint overall signs which pertain to a business that is no longer licensed and operating at this location. "AC Delco' etc PMC 17.09.050 (1) Violation: Any sign, including support frames, now or hereafter existing which no longer advertises a bona fide business conducted, or a product sold or service rendered at this location. (2) Corrective Action: Remove the advertising copy by painting or coating out within 30 days. All sign frames and supports of abandoned signs must be removed within one year of the date of abandonment or business closure. Description: (3) Outdoor storage is not sight screened to obscure vision of storage from Lewis St. PMC 25.75.040 (1)(C)(8) (1) Violation: Outdoor storage and trash collection areas located in a commercial or industrial zone with existing or new development and upon a lot adjacent to or visible from Lewist St. shall be so screened as to obscure vision of such outdoor storage from Lewis St (2) Corrective Action: Screen lot to obscure outdoor storage and trash collection areas from Lewis St. Description: Unlicensed, junk vehicles (camper, van, trailer) stored on this property in public view. PMC 9.60.030 (12) (1) Violation: All places used or maintained as junkyards, or dumping grounds, or for the wrecking or disassembling of automobiles, trucks, tractors, or machinery of any kind, or for the storing or leaving of worn-out, wrecked or abandoned automobiles, trucks, tractors, or machinery of any kind, or of any of the parts thereof, or for the storing or leaving of any machinery or equipment used by contractors or builders or by other persons. (2) Corrective Action: Discontinue wrecking or disassembling automobiles, trucks, etc. Remove and lawfully dispose of all wrecked or abandoned vehicles, machinery, etc. along with any parts thereof. (2) Corrective Action: Discontinue all vending until a license has been obtained from the City of Pasco. Propane operated burners are being used to cook both inside units and immediately outside in the common area walkway. IFC 304.2 (1) Violation: Storing flammable or combustible materials and/or rubbish in a way that produces conditions that create a nuisance or hazard to the public health, safety or welfare. (2) Corrective Action: Remove all combustible and/or flammable materials from rooms and discontinue use on the property. Description: Trash litter and debris dropped throughout the property. IPMC 302.1 (1) Violation: The exterior structure or equipment is not in good repair, is structurally unsound, or is in an unsanitary condition. (2) Corrective Action: Remove all materials and items and/or remove or repair equipment around the property which is creating unsafe or unsanitary conditions and maintain in a clean, safe and sanitary condition. Description: Attached roof cover over driveway entrance is deteriorated, failing and unsafe The area is not blocked from access. Guardrail surrounding decking/roof area is deteriorated and missing portions. Obtain a permit to demolish or repair. IPMC 304.1 (1) Violation: Exterior of the structure is not maintained in good repair, structurally sound and sanitary so as not to pose a threat to the public health, safety or welfare. IPMC 304.1.1 (12) Violation: Exterior stairs, decks, porches, balconies, and all similar appurtenances attached thereto, including guards and handrails, are not structurally sound, not properly anchored or are anchored with connections not capable of supporting all nominal loads and resisting all load effects. Corrective Action: Repair or replace all unsafe conditions to comply with the International Building Code as required. A City of Pasco building permit is required. Contact the Building Department Permits Desk at 509-543-5726 for further information. Description: Large decorative openings in walkway railings are missing the original metal inserts, have damaged inserts or inferior materials not capable to withstand imposed loads have been installed. All areas must have a minimum 3/8" thick piece of plywood installed and secured. IPMC 304.12 (1) Violation: Handrail or guard is not firmly fastened or is incapable of supporting normally imposed loads or is in bad condition. (2) Corrective Action: Make necessary repairs to handrail so that it is firmly fastened and capable of supporting the normally imposed loads. Description: Window in rear of unit is broken and/or missing glass. IPMC 304.13.1 (1) Violation: CEB Agenda Page 4 of 10 Windows have cracks, holes or are completely broken out. Description: Windows do not have approved sash locking devices (only provided with sill wing nut locks). IPMC 304.18.2 (1) Violation: Window is missing a required window sash locking device. (2) Corrective Action: Install a window sash locking device or new window with a sash locking device for all windows located in whole or in part within 6 feet above ground level or a walking surface below that provides access to a dwelling or rooming unit. Installation of new windows requires a City of Pasco building permit. Description: Exterior paint is in poor condition (peeling chipping, flaking) causing exposed rusted railings and weather deteriorated wood trim and fascia. IPMC 304.2 (1) Violation: Exterior surfaces (i.e. doors, door and window frames, cornices, etc.) are not maintained in good condition. (2) Corrective Action: Paint or apply another protective treatment to all exterior wood surfaces that are not decay resistant. Remove all peeling, flaking and chipped paint and repaint the surface. Ensure all siding and masomyjoints are weather resistant and water tight. Treat all metal surfaces subject to rust or corrosion with a rust/corrosion resistant coating, and stabilize all surfaces with rust or corrosion. Remove all oxidation stains from exterior surfaces. Description: Appears to be mold and/or mildew throughout units in bathrooms and living areas. Bathroom baseboard heaters are rusted and unsafe. IPMC 305.3 (1) Violation: Interior surfaces (i.e. windows, doors, floors, ceilings, etc.) are unsanitary or damaged. (2) Corrective Action: Clean and sanitize all interior surfaces and/or repair peeling, chipping, flaking or abraded paint. Cracked or loose plaster, decayed wood and other defective surface conditions need to be repaired. Surfaces which cannot be repaired must be replaced. (1) Violation: Interior surfaces (i.e. windows, doors, floors, ceilings, etc.) are unsanitary or damaged. (2) Corrective Action: Clean and sanitize all interior surfaces and/or repair peeling, chipping, flaking or abraded paint. Description: Floor in bathroom is failing (soft throughout) IPMC 305.4 (1) Violation: The stairs, ramp, landing, porch, deck, and/or other walking surface is damaged or in disrepair. (2) Corrective Action: Repair stairs, ramp, landing, porch, deck, and/or other walking surface that is in bad condition or needs repair. Description: Guests reported bedbug infestation in several units, bedbugs were observed crawling on an occupant of a unit on the 2nd floor. IPMC 309.1 Violation: Failure to exterminate and maintain the structure free from insect and rodent infestation. Corrective Action: Promptly exterminate the structure by approved processes that will not be injurious to human health. Maintain structure free of infestation and take proper precautions to prevent reinfestation. The owner is required to submit a written pest control plan prepared by a pest control company, carrying an active City of Pasco business license, and copies of the service ticket. Description: Laundry room sink is connected to hoses which hang in the sink and the drain line (no p -trap installed) is connected directly to the floor drain -this poses a cross contamination hazard. IPMC 505.2 (1) Violation: Water supply is not protected or maintained free from contamination. (2) Corrective Action: Install approved vacuum breakers at hoses and/or correct all issues which pose a contamination hazard. Description: Bathroom sinkfaucets do not provide sufficient water supply volume and pressure. IPMC 505.3 1) Violation: Water supply system is not installed properly and/or maintained. 2) Corrective Action: Make corrections to water supply system so that it is properly installed, provides sufficient volume and pressures of water to plumbing fixtures, operates safely and is free of defects and leaks. Description: Laundry room sink does not have a require p -trap installed. Sink drain is directly connected to laundry floor drain. IPMC 506.1 (1) Violation: Plumbing fixtures are not properly connected to either a public sewer system or to an approved private sewage disposal CBB Agenda Page 6 of 10 system (i.e. an approved septic tank). (2) Corrective Action: Connect all plumbing fixtures to either a public sewer system or an approved private sewage disposal system. Description: Vent pipe is not maintained clear of combustibles, move pipe in accordance with required manufacturer's installation guidelines. IPMC 603.3 (1) Violation: Combustible items being stored near mechanical appliances/heat sources. (2) Corrective Action: Removed all combustible materials from around appliances such as heaters, clothes dryers, water heaters, fuel burning appliances, etc. Description: Electrical conduit is in disrepair, unapproved repairs made with excess amounts of black electrical tape. Wiring conduits on second floor ceilings are not appropriately connected at joints and/or secured to the ceiling or walls. Air Conditioner cover inside room is missing. Exposed, bare electrical wires in laundry room. Laundry room light fxiture has been installed inside the ceiling and sealed with plaster and wiring has been spliced together (splice is not protected/contained in box or condui IPMC 605.1 Violation: Failure to maintain electrical equipment, wiring and appliances in a safe and approved manner. Electrical permits must be obtained from Labor and Industries. Description: Guest has stored numerous items on the walkway obstructing the emergency egress path from their unit to the public way. IPMC 702.1 (1) Violation: The continuous path of travel to the public way is obstructed and is creating an unsafe means of egress. (2) Corrective Action: Clear the obstruction(s) so that there is a safe, continuous and unobstructed path of travel from any point in the structure to the public way. Description: Seal all areas where plumbing fixtures meet with the wall or the floor(toilet base and tub/shower at floor),IRC P2705.1 (3) 1) Violation: Fixtures are not properly sealed to remain watertight. 2) Corrective Action: Where fixtures come in contact with walls and floors the contact area shall be water tight with an approved material which prevents water penetration. Description: Allowing possible illegal activates to occur on site and allowing conditions to exist, which pose a hazard to guests of the Motel and nearby businesses. All numbers shall be complete and no two doors shall have the same number. Description: Units are being rented on a 30+ day basis. This location does not hold a rental license with the City of Pasco. (2) Corrective Action: Remove and lawfully dispose of all litter, garbage, junk or vegetative waste on the property. Description: Graffiti on exterior walls of building and unit doors. PMC 9.85.050 (1) (2) (1) Violation: Permitting graffiti to remain unabated on any portion of any property. (2) Corrective Action: Remove or paint over all graffiti until it is no longer visible. ADOPTION OF MINUTES: Board Member Gottschalk moved, seconded by Board Member Gutierrez, that the minutes of the May 12, 2016 meeting be approved. The motion carried unanimously. D. DETERMINATION HEARINGS: Chairperson Glatt explained the procedure and purpose for the meeting, noting that the City of Pasco was the Petitioner and property owners and their authorized representatives who had appeared to discuss the alleged violations of the Pasco Municipal Code were the Respondents. a. Hearings i. City of Pasco vs. Knudsen, Cutis & Margie, case number CEB2016-0170, for the property located at 4908 Hilltop Dr Troy Hendren, Inspection Services Manager, asked Code Enforcement Officer Alonso Torres to read the case facts into the record. Mr. Torres indicated that the cited violation on this property was PMC 25.75.050 (1) (c) — Arbor Vitae hedge in front yard has grown to exceed the 3.5' maximum height allowed. The property was inspected on January 27, 2016 in response to a complaint received stating the hazard of overgrown arbor vitae created while backing out of the driveway blocking the view of the street and sidewalk. Violation of the Pasco Municipal Code was observed and a correction notice was issued on February 11, 2016. A re -inspection of the property revealed that the property was still in violation of the Pasco Municipal Code and notice of civil violation was issued on May 18, 2016. The property owner was legally notified via certified mail on May 20, 2016. Based on a final inspection of the property completed on May 31, 2016, the property is still in violation. The City of Pasco recommended giving the respondent an additional 10 days to abate the violation or pay a daily penalty of $50 per day for 10 days. City of Pasco vs. Charron, Chrissy & Dan, case number CEB2016-0647, for the property located at 7716 Bonilla Dr Troy Hendren, Inspection Services Manager, asked Code Enforcement Officer Alonso Torres to read the case facts into the record. Mr. Torres indicated that the cited violations on this property were PMC 12.04.040 — Right of way permit required for driveway approach, PMC 16.05.030 — City of Pasco building permit required for addition to concrete driveway and PMC 25.66.040(6) — Business materials must be stored out of site in an enclosed structure and only one occupational vehicle can be stored on property. The property was inspected on March 21, 2016 and violations of the Pasco Municipal Code were observed. A correction notice was issued March 22, 2016. A re -inspection of the property revealed that it was still in violation of the Pasco Municipal Code and a notice of civil violation was issued May 13, 2016. The property owner was legally notified via certified mail on May 18, 2016. Based on a final inspection of the property completed on May 31, 2016, the property is not in compliance. The City of Pasco recommended giving the respondent an additional 10 days to abate the violation or pay a daily penalty of $100 per day for 10 days. Dan Charron, 7716 Bonilla Dr, spoke on behalf of this case. CODE BOARD DECISION: Board Member Gottschalk moved, seconded by Board Member Gutierrez that the actions taken by the City were appropriate and timely. The motion carried 4 to 1 with Board Member Glatt dissenting. Board Member Glatt further moved, seconded by Board Member Harding, to give the respondent 90 days to abate the violations on the property or pay a penalty of $100 per day for 10 days. The motion carried 3 to 2 with Board Member Gottschalk and Board Member Gutierrez dissenting. City of Pasco vs. Brown. Boyd, case number CEB2016-0734, for the property located at 823 W Octave St Troy Hendren, Inspection Services Manager, asked Code Enforcement Officer Alonso Torres to read the case facts into the record. Mr. Torres indicated that the cited violations on this property were PMC 25.78.030(4) — Vehicle must be parked on an approved surface and PMC 9.60.030(16) — Overgrown weeds throughout property. The property was inspected on May 10, 2016 and violations of the Pasco Municipal Code were observed and determined to be repeat violations. A previous notice was sent May 5, 2015. A repeat notice of civil violation was issued May 11, 2016 and the property owner was legally notified May 18, 2016. On May 19, 2016 the property owner's daughter called stating that she had mowed the lawn and was going to remove the vehicle from the backyard by the deadline. Based on a final inspection of the property on May 31, 2016 the property is in compliance at this time. The City of Pasco recommended imposing a repeat penalty of $200. City of Pasco vs. Baumgartner, Richard, case number CEB2016-0754, for the Property located at 1808 W Yakima St Troy Hendren, Inspection Services Manager, asked Code Enforcement Officer Alonso Torres to read the case facts into the record. Mr. Torres indicated that the cited violations on this property were PMC 25.75.110 (1) — Failure to maintain landscape in a healthy growing condition and PMC 9.60.030 (16) — Overgrown weeds throughout property. The property was inspected on May 17, 2016 and violations of the Pasco Municipal Code were observed and determined to be repeat violations. A previous notice was sent on August 4, 2014. A repeat notice of civil violation was issued on May 18, 2016 via certified mail. The property owner was legally notified on May 20, 2016. On May 20, 2016 the property owner came to the Code Enforcement Office showing a receipt showing that he had hired the service of a handyman to have the weeds trimmed. Based on a final inspection of the property completed on May 31, 2016 the property is in compliance at this time. The City of Pasco recommended imposing a repeat penalty of $200.
