WA FIRST AMENDMENT TO INTERLOCAL AGREEMENT Between CITY OF PASCO and PASCO SCHOOL DISTRICT (SEWER AGREEMENT) BY THIS FIRST AMENDMENT TO THE INTERLOCAL AGREEMENT entered into this /A4�' day of Atn4uS E, 2014, amending the Interlocal Agreement between City of Pasco and Pasco c��hool District (Sewer Agreement) dated March 13, 2007, wherein the parties agreed to the conditions for the City's extension of sewer services to McLoughlin Middle School and Ruth Livingston Elementary School; therein requiring the District establishing an utility account with the City pursuant to PMC 13.16.010, which requires compliance with all Ordinances governing the water -sewer utility. WHEREAS, PMC 13.16.011 requires as a condition for the service of utilities outside the City's corporate limits, a commitment to exercise necessary documents for potential annexation; and WHEREAS, due to a change in the interpretation of the law affecting annexations, school properties may be valued for annexation purposes, it is necessary to provide for compliance with this Ordinance. NOW, THEREFORE, in consideration of the mutual covenants contained herein, the Interlocal Agreement shall be amended as follows: Section 1. Section 3 of the Interlocal Agreement shall be amended and shall read as follows: First Amendment to Interlocal Agreement City/Pasco School District - 1 Prior to using the newly constructed facilities, the District shall pay the City the applicable connection fees and establish an account with the City. As consideration for the of City utility services beyond the City limits and continuing access thereto, the District shall, on request by the City, execute such documents as deemed necessary y the City Manager, or his designee, to assure and effectuate the annexation or future annexation of the property served by City services. The Superintendent is hereby authorized to execute the documents necessary to effectuate the annexation as such time such property may be eligible for annexation to the City of Pasco. Section 2. All remaining terms and condition of the Interlocal Agreement shall remain in full force and effect.
