A correction notice was sent o n July 24, 2014 for the previous case, CEB2014-1668 , for one or more of the cited v iolations. On August I 2, 2014 , Mr. Soho I met Ms. Johnson at the Code Enforcement counte r to discuss the correct ion notice. He had been out of the country and had just received a copy of the notice. Ms. John son explained the issues with him and notified him that she had walked the p roperty wi th the cu rrent ma nager, Mr. John Wilson, prior to iss uing the notice. He updated hi s mailing address and assured that he was working on updating the issues. On November 5 , 20 14 a follow-up in spection was conducted whic h showed the corrections had not been made and some conditions had become worse. Ms. Johnson s poke with the mana ge r, Mr. Wilson, and asked about the status of the repairs . He stated that he h ad n ever received a copy of the correction not ice. Ms. Johnson notified Mr. Wilson that she would be send in g a n otice of civil v iolation as she d id not observe progress b eing made in correcting the issues . On Novem ber 7, 2014 a no ti ce of civil v iol at ion was issued . The property owner was legally notified on November 14 , 2014 v ia certified mail. From November 14 , 2014 to December 3 1, 2015 when the case wa s closed, numerous site v is its, in spections, phone ca ll s and meetings had been conducted. The property was granted an extension for several item s based on work in progres s . About 75% of the violations had been corrected but th e n progress ceased. The property wa s assessed daily pena lti es totaling $1,000 fo r failing to come into compliance. A repeat noti ce of civil violation was issued on January 26 , 20 16. The property owner was lega ll y notified on January 30 , 20 16 via certified ma il of the conditi ons believed to be repea t v iol ation s of the Pasco Municipal Code. On February 19 , 2016, Mr. Soho !, Mr. Wilson and his new manager, Mr. Hudnall, attended a meeting with Code Enforcement and the Pasco Police to di scuss activity at the property. On February 23, 20 16, Mr. Soho! call ed to notify M s. J ohn so n that they would discontinue re ntin g any portion of th e building as apartments and re turn to 100% motel rooms in order to better control the cl ientele and the effects on the property. He advised tha t the re were several ma intenance techni cians working on the property, plumbing leak s were repaired, d amaged t il e h ad been replaced wi th carpet, graffiti was painted over and the north middle uninha bi table section was secured and they were c leaning the inte ri o r and exterior of the property. On M arc h I , 20 I 6 the prope rty was in sp ected and verifi ed that many of the violations ha d been corrected but th e property was not in compliance. Based on a final in sp ecti on of the property completed on March 1, 2016 the property is not in compliance at thi s time. Violations that have not been corrected are: (I) Graffiti throughout and a ll owing graffi ti to remain on the property, (2) A llowing hazardous condition s as noted in the viola ti ons to re main on the prop erty which pose a h azard to the occ upa nt s and guests of the property, (3) All ow in g po ssi bl e ill ega l activ iti es to occur on s ite and a ll owing conditions to exists which, (4) Planting areas are not covered by live vegetation, (5) Trash, leaves a nd other debris are accumula ted a lon g the fenc ing . The C it y of Pasco recommended the re spondent p ay $200 fo r a repeat penalty and be g iven 30 days to correct any remaining vi o lations or pay a penalty of $200 p er day for 10 days. CODE BOARD DECISION: Board Member Gottschalk moved , seconded by Board Member Gutierrez that the actions taken by the City were appropriate and timely. The motion carried unanimous ly . Board Member Gottschalk further moved , seconded by Board Member Guttierez, to impose a repeat penalty of $200 and give 45 days to abate the vio lations or pay $200 per day for I 0 days.
