CALL TO ORDER Chairperson Glatt called the regular meeting of the Code Enforcement Board to order at 7:00 p.m. B. ROLL CALL a. Board Members MEMBERS PRESENT Daniel Gottschalk Mary Gutierrez Russell Glatt MEMBERS ABSENT C. ADOPTION OF MINUTES: Board Member Gutierrez moved, seconded by Board Member Gottschalk, that the minutes of the February 4, 2016 meeting be approved. The motion carried unanimously. D. DETERMINATION HEARINGS: Chairperson Glatt explained the procedure and purpose for the meeting, noting that the City of Pasco was the Petitioner and property owners and their authorized representatives who had appeared to discuss the alleged violations of the Pasco Municipal Code were the Respondents. i. City of Pasco vs. Sohol Development LLC, case number CEB2016-0097, for the property located at 1800 W Lewis Street Troy Hendren, Inspection Services Manager, asked Code Enforcement Officer Rosanna Johnson to read the case facts into the record. Ms. Johnson indicated that the cited violations on this property were IPMC 302.8 – Parking lot is being used for the storage of inoperable junk and unregistered/unlicensed vehicles, IPMC 304.13 – Window openings are not secured/boarded to prevent unlawful entry and windows on first floor of this dangerous structure are broken, IPMC 304.13.1 – Fire extinguisher case glass is broken, IPMC 304.15 – (REPEAT) Building entrance door locks are broken/damaged and missing parts, door knob at stair 6 does not latch and is missing parts of the hardware and exterior door closures are not operating and/or are missing parts, IPMC 305.1 – (REPEAT) Carpets, tile, walls and ceilings throughout are dirty and unsanitary, trash, litter, junk furniture, mattresses and appliances throughout common area halls and stairways, IPMC 305.3 – Walls and ceilings are not maintained free of holes and peeling/flaking paint, IPMC 305.4 – (REPEAT) Common area stairways and landings have loose/broken tiles and several tiles are missing, IPMC 305.5 – Top of stair guard is damaged (wood is cracked/broken), IPMC 402.2 – Light fixture does not have bulbs, not illuminated as required, IPMC 505.3 – Leaks throughout water supply line in first floor hallway ceiling, IPMC 605.1 – (REPEAT) Light fixtures throughout the common halls and stairways are missing covers which pose a hazard, NEPA 10.7.7.1.1 – Fire extinguishers are not fully charged, on empty, PMC 25.42.030 – Semi Trailer used as storage, stored in the parking lot and storage containers are not allowed in a C - zone, PMC 25.75.040(1)(c)(3)(12) – (REPEAT) Garbage collection and outdoor storage areas are not sight screened to block public view from Lewis Street, PMC 25.75.110(1) – (REPEAT) Planting areas are not covered in live vegetation and trash, leaves and other debris is accumulated along and in the fencing, PMC 25.78.090(7) – Areas of parking lot asphalt from light standards to the east end north side of building has been broken up and re-installed, asphalt pieces are uneven, not secure and pose a hazard, PMC 5.04.057© - (REPEAT) Allowing possible illegal activities to occur on site and 03032016 CEB Minutes Page 2 of 3 allowing conditions to exist, which pose a hazard to the residents and guest of the adjacent hotel , PMC 9.60.020(4) – Allowing hazardous conditions as noted in these violations to remain on the property which pose a hazard to the occupants and guests of the property, PMC 9.60.030(11) – (REPEAT) Chain link fence and gate is dilapidated and needs to be removed or property repaired, PMC 9.60.030(6) – (REPEAT) Trash, litter, building material debris throughout exterior of property, PMC 9.60.040 – Dangerous fire damaged structure is not secured from unlawful entry and door is unlocked from the apartment building side and windows are not boarded/secured and PMC 9.85.050(1)(2) – (REPEAT) Graffiti throughout common area halls and stairs throughout the apartment building at the west end of the property and allowing graffiti to remain on the property. A correction notice was sent on July 24, 2014 for the previous case, CEB2014-1668, for one or more of the cited violations. On August 12, 2014, Mr. Sohol met Ms. Johnson at the Code Enforcement counter to discuss the correction notice. He had been out of the country and had just received a copy of the notice. Ms. Johnson explained the issues with him and notified him that she had walked the property with the current manager, Mr. John Wilson, prior to issuing the notice. He updated his mailing address and assured that he was working on updating the issues. On November 5, 2014 a follow-up inspection was conducted which showed the corrections had not been made and some conditions had become worse. Ms. Johnson spoke with the manager, Mr. Wilson, and asked about the status of the repairs. He stated that he had never received a copy of the correction notice. Ms. Johnson notified Mr. Wilson that she would be sending a notice of civil violation as she did not observe progress being made in correcting the issues. On November 7, 2014 a notice of civil violation was issued. The property owner was legally notified on November 14, 2014 via certified mail. From November 14, 2014 to December 31, 2015 when the case was closed, numerous site visits, inspections, phone calls and meetings had been conducted. The property was granted an extension for several items based on work in progress. About 75% of the violations had been corrected but then progress ceased. The property was assessed daily penalties totaling $1,000 for failing to come into compliance. A repeat notice of civil violation was issued on January 26, 2016. The property owner was l egally notified on January 30, 2016 via certified mail of the conditions believed to be repeat violations of the Pasco Municipal Code. On February 19, 2016, Mr. Sohol, Mr. Wilson and his new manager, Mr. Hudnall, attended a meeting with Code Enforcement and the Pasco Police to discuss activity at the property. On February 23, 2016, Mr. Sohol called to notify Ms. Johnson that they would discontinue renting any portion of the building as apartments and return to 100% motel rooms in order to better control the clientele and the effects on the property. He advised that there were several maintenance technicians working on the property, plumbing leaks were repaired, damaged tile had been replaced with carpet, graffiti was painted over and the north middle uninhabitable section was secured and they were cleaning the interior and exterior of the property. On March 1, 2016 the property was inspected and verified that many of the violations had been corrected but the property was not in compliance. Based on a final inspection of the property completed on March 1, 2016 the property is not in compliance at this time. Violations that have not been corrected are: (1) Graffiti throughout and allowing graffiti to remain on the property, (2) Allowing hazardous condition s as noted in the violations to remain on the property which pose a hazard to the occupants and guests of the property, (3) Allowing possible illegal activities to occur on site and allowing conditions to exists which, (4) Planting areas are not covered by live vegetation, (5) Trash, leaves and other debris are accumulated along the fencing. The City of Pasco recommended the respondent pay $200 for a repeat penalty and be given 30 days to correct any remaining violations or pay a penalty of $200 per day for 10 days. CODE BOARD DECISION: Board Member Gottschalk moved, seconded by Board Member Gutierrez that the actions taken by the City were appropriate and timely. The motion carried unanimously. Board Member Gottschalk further moved, seconded by Board Member Gut tierez, to impose a repeat penalty of $200 and give 45 days to abate the violations or pay $200 per day for 10 days. The motion carried unanimously. b. Amendments i. City of Pasco vs. Avila, Jose & Zenaida, case number CEB2016-0142, for the property located at 5106 Catalonia Drive c. Dismissals d. Motion Board Member Gottschalk made a motion to approving Resolution No. 2016-003 as amended, Board Member Gutierrez seconded. The motion carried unanimously. E. STAFF REPORT AND OTHER BUSINESS: F.
