Dear Ashok:
This letter is being sent as a follow-up to our discussion on the sewer capacity for your property
located at the northwest corner of Broadmoor Boulevard and Burns Road.
As you are aware, the City completed a Sanitary Sewer Master Plan to determine how best to serve
the needs of the City for the next 20 years. One of the larges areas of sewer utility need is the
northwest portion of the City where there is currently high development activities that appears will
continue into the foreseeable future. In order to serve the approximately 3,500 acres of vacant
property, a 30 -inch sewer trunk line is needed. Your property is located within the 30 -inch trunk line
service area and construction and installation is currently scheduled to occur in 2017.
It is our understanding that you are planning to develop your property ahead of completion of the
sewer trunk line. An Engineering Evaluation was completed to determine if there is capacity within
the existing sewer system along Broadmoor Boulevard. The consultant, Murray, Smith & Associates,
Inc., concluded as part of their study, that there is approximately a 250 residential -unit capacity
available.
You have requested that the City allocate capacity for 150 residential -units for your development
from the capacity currently available. The City is willing to grant you the 150 residential -unit
capacity requested, with the condition that your residential development be connected to the new 30 -
inch sewer trunk line within 6 months of its construction at your full expense. This agreement is not
valid until the City receives your signatures below confirming your agreement to the condition stated
above.
