VISITORS: Ira Schmidt asked the Council to.consider the possibility of getting a fire permit to burn over the telephone. He.s.tated that often time you would call in for a permit in the morning and it would be afternoon-b.efore.the Fire.Department could get out to issue it; therefore, if a permit.could be.issued over bhe telephone, they could check it periodically when they have time. Staff noted.this suggesti.on. Councilman Wilkins stated that there was.one day the garbage collection was not made and'people were not -notified of:it..•He asked staff to look into -the situation. Motion carried. VISITORS: M Mr. George,Brewder addressed the City Council and stated"he wanted to protest the "obscene behavior" of Pasco's administrator..s.. .On October.9, 1976, Mr,. Brewder pur- chbsed a City of Pasco vehicle at a Police Auction.. Subsequent -to sale, he discovered it did not have a jack and spare;,therefore, he ca lled'Mr. Ajax in regard.to the problem. Mr. Ajax stated, he would see if there was a•jack.and..spare for.the.vehicle, and if so, Mr. Brewder could have it. Following their conversation, City officials were unable to locate a jack and spare for -Mr. Brewder.'s vehicle and he -was advised: Mr. Brewder then contacted the City Manager on -several occasions and..the.City.Manager, in turn, likewise attempted to locate a jack and .spare .for Mr.. - Brewder... . .Upon contacting the City Attorney for an opinion, the City Manager.was informed. that City funds could not be used.to purchase proposed items and that Mr.�Brewder purchased the vehicle on an"as is, where is" condition. - Mr..Charles Smith asked, "Who maintains streets for a level of safety?" 'Mr. Ajax repponded that the City doesn't have an obl'igationl;;that everyone has'a smooth street but we do have an obligation to fill holes where safety,is involved. Mr. Smith assured staff that he would be in contact with them. RECESS EXECUTIVE SESSION - 8:25P.M. RECONVENED: 9:45 P.M. k MINUTES PASCO CITY COUNCIL REGULAR MEETING ANNOUNCEMENT: DECEMBER 21, 1976 Upon returning to meeting room from an Executive Session, Mayor Tidrick made the following motion: "I move to give the -Department Heads and City Manager..in the amount of $500 for their :services for 1976 year. The appropriations should be from the appropriate fund, which is anticipated to be the General Fund." Seconded by Mr. Schuelein. Motion carried by roll call vote of six (6). ORDINANCES: ORDINANCE NO. 1828: AN ORDINANCE ADOPTING THE CITY OF PASCO BUDGET FOR THE YEAR 1977. Ordinance No. 1828 was read by title only. Mr. Sheeley moved that Ordinance No. 1828 be adopted. Seconded by Mr. Snider. Motion..,carried by!roll:,call vote=of six (6). ORDINANCE NO. 1829: AN ORDINANCE SETTING SALARIES FOR CERTAIN CITY OFFICERS AND PERSONNEL, AND AMENDING SECTION 2..42.600 OF THE PASCO MUNICIPAL CODE ENTITLED "CURRENT SALARIES." Ordinance No. 1829 was read by title. Mr. Sheeley moved that Ordinance No. 1829 be adopted. Seconded by Mr. Schuelein.. Mr. Snider moved to amend Exhibit 1, Paragraph Two to read as follows: "In addition to other c@mpensation, all Department Directors and City Manager shall be eligible for merit payments not to .exceed ten (10) days. Such merit payments shall be made upon an evaluation and..r.ecommendati.on..of. the City Manager and .confirmation by the City Council, with the exception.of the City Manager who'will be evaluated by the City Council.. Such payments shall be made to eligib=Ye Department Directors in December of each year." Further, Paragraph Nos. 3 and 4 should be-stricken.and.City Manager salary set at $2;485.monthly - $29,820 yearly and exempt from step system. Seconded 4y Mr. Sheeley. ORDINANCE NO. 1830: AN ORDINANCE RELATING TO DOGS, IMPOUNDING DOGS, DISPOSITION OF DOGS, LICENSING OF DOGS, CRUEL TREATMENT OF_ANIMALS.,:POISONING OF ANIMALS; TO PREVENT THE SPREAD OF THE DISEASE OF.RABIES; RROVIDING FOR THE QUARANTINE OF DOGS AND CATS SUSPECTED OF BEING INFECTED WITH SAID DISEASE; PROVIDING FOR A STRICT QUARANTINE OF ALL ANIMALS IN THE CITY DURING ANY PERIOD WHEN SAID DISEASE IS PREVALENT IN THE AREA AND FOR DESTRUCTION OF ANY ANIMALS FOUND RUNNING AT LARGE DURING SUCH PERIOD; PROVIDING FOR THE TREATMENT OR DESTRUCTION OF ANIMALS BITTEN BY A RABID ANIMAL; PROVIDING FOR PENALTIES FOR VIOLATIONS OF THIS ORDINANCE, BY . ADDING A NEW CHAPTER TO TITLE EIGHT OF THE PASCO.MUNICIPAL CODE, CHAPTER 8.04 ENTITLED, "ANIMAL CONTROL", AND.REPEALING CHAPTERS 8.04 - 8.32 MUNICIPAL CODE AND ANY OTHER ORDINANCE IN CONFLICT HEREWITH. (Discussion) MINUTES PASCO CITY COUNCIL REGULAR MEETING ORDINANCES - Continued: DECEMBER.21, 1976 Mr. Adams questioned recourse for meter reader if there.was.a guard dog in the yard. Mr. Sheeley replied that the reader estimated reading and if there was a descrepancy in the bill, it was between City and! owner of property. Mr. Earl Warren felt the City was penalizing individuals who were -trying to abide, by the law, and the people who had always..let'their..dogs roam.would continue to let them.. He favored.kennel license for people who:.ow.ned up.to three dogs as a means of saving money on licensing. Further,.fee of $7150 for neutered animals and $9.00 for non -neutered animals was discriminatory to the'animals.. Main motion carried by roll call vote of. six (6). RESOLUTIONS: RESOLUTION NO. 1061: A RESOLUTION APPROVING AN AMENDMENT.TO THE CONSTRUCTION IMPACT STUDY CONTRACT WITH MANAGEMENT CONSULTING SERVICES. RESOLUTION NO. 1062: A RESOLUTION OF THE CITY OF PASCO AUTHORIZING THE.CITY MANAGER T0' SIGN A JOINT DATA PROCESSING AGREEMENT WITH THE CITY OF RICHLAND. Resolution No. 1062 was read by title only. Mr. Snider moved that Resolution No. 1062,- as.corrected in Section 10, be adopted.. Seconded.'by Mr. Schuelein. Mr. Sheeley opposed joint venture by stating, "We should.have our own equipment and act independently." His main concern,was 180 -day cancellation -clause and then what do we have? S Mayor Tidrick shared Mr. Sheeley's concern,as.he, too, had certain reservations about "jobbing" out our computer work and much...preferred.in-house control; however, it appeared this was the least expensive method and Richland was completely set up for such work. Mr. Smith explained the basic financial package to the Councilmen and alternatives. Main motion carried by roll call vote of five (5). Councilman-Sheeley voting no. RESOLUTION NO. 1063: A RESOLUTION ACCEPTING.THE .WORK DONE BY TRI CITY TILE AND MASONRY,.INC. FOR THE GOLF CART STORAGE FACILITY. Resolution'No. 1063 was'read .by ti.tle only. Mr. Sheeley moved that Resolution No. 1063 be adopted. Seconded by Mr. Snider., Motion carried by roll 'call vote of six (6). t NEW BUSINESS: BID RESULTS - COURT`STREET�WATER LINE: The°following bids were opened on December 16, 1976 for installation of Court-Street.Water Line: Al Nevills Excavation $53,187.02 Mahaffey Excavation 60,308.90 Stenstrom Construction 87,761.65 Valley Cement 66,883.01 Mid Columbia Const. 52;678.22 ** Sharpe & Preszler 56,721.17 **Staff Recommendation Mr. Sheeley moved that recommendation of the staff be accepted and bid be awarded to Mid Columbia Construction, Inc. in the amount of $52,678.22 which includes sales tax.
