ROLL CALL: OCTOBER 19, 1976 By Deputy City Clerk. Councilmen present were: S.K. Adams, J.C. Bailie, Vernon Schuelein, David Sheeley, Jan Tidrick and Bill Wilkins. Councilman E.A. Snider was absent from the meeting. Also present were:. George.Smith, City Manager; Patrick Roach, City Attorney; Leo Olney, Director of Finance; James Ajax, City Engineer; Al Tebaldi, Chief of Police, and Michael Corcoran, City P.lanner. CONSENT AGENDA: Mr. S.heeley moved that Consent Agenda be approved. Seconded by Mr. Wilkins. Motion carried by roll call vote of six (6). Consent items are as follows: a) Approval of Minutes: Minutes of regular meeting, held October 5, 1976. b) Bills and Communications: General Claims - Warrant Nos. 10575 through. 10674 in the total amount of $206,564.10. c) CORRECTED ORDINANCE NO. 1748: An Ordinance providing for the annexation of certain. property into the City of Pasco. .(Ri"ght of Way for Road 24). VISITORS: Mr. Howard Baker questioned extension of 2 -hour parking in down town area, and when uqq s'.the-fdot-pa.troh`going to resume as the business area was plagued by panhandlers. Mr. Ajax responded. that s.igns should be here soon. Police Chief Al Tebaldi replied that he had one officer out"on disability and one resignation; therefore, .it created a shortage of patrol officers so he had to pull the foot patrol officer temporarily. Mr. Frank Thomsen, Manager of Pasco Chamber, -asked: "Is it possible to get more"Police officers?" ORDINANCES 1 1 ORDINANCE NO. 1820: .(FIRST. READIN'G)" AN ORDINANCE APPROPRIATING'$126,200'OF UNANTICTPATED RE- VENUES -..-MAKING EXPENDITURE'"ADJUSTME'NTS"WITHIN THE GENERAL.*FUND AND TO THE PARK'FUND; NEIGHBORHOOD"FACILI'TY FUND, CEMETERY FUND, GOLF FUND, FIRE EQUIPMENT"AND CONSTRUCTION FUND, AND THE ADMINISTRATIVE SERVICE "FUND; AND DE'CLAR'ING AN EMERGENCY Ordinance No. 1820 wa's read by title only.. Mr. Sheeley moved that Ordinance No. 1820 had been read by title for its first reading and set November 2, 1976 as date of Public Hearing for finaih passage. Seconded by: Mr. Bailie. Motion carried. UNFINISHED BUSI.NESS ORDINANCE - ADULT.MOTI.ON PICTURE"THEATRE: Mr. Sheeley moved -that the City Manager, City Attorney.and City Planner be authorized and directed to draft an appropriate.Zoning Ordinance restricting adult moti.on pictures and other ,.,adult entertainment dealing principally in sexually explicit material to areas ;other.thaR_down town or near residential areas, to be discussed-atnext Workshop Session. Seconded by Mr.. Schuelein. _(Discussion) MINUTES PASCO CITY*COUNCIL REGULAR -MEETING UNFINISHED BUSINESS'' Continued: OCTOBER. •1.9, 1976 Mr. John Napoli asked the following -questions: 1) -Why-was the.license issued? 2) Unfortunately, Pasco is now known for prostitutes, pot, personal service, pimps, porno movies and pidgeons.- 3) Can the proposed Ordinance be made -retroactive? Staff replied that the 1icense was -issued because they complied with existing City Codes and we had no legal grounds to deny it. As far as undesirables in the City, Mayor Tidr•ick replied that the City -Council -was not responsible .for their activities, they had been a.r_o.und.for a long-time. Staff will attempt to draft a solid Ordinance -which will hold up in court in regard.to obscenity; however, there is much research -to be done. The City Attorney stated that.f.irst.amendment.of the.Supreme Court does not allow any restraint &n- exercising that-fi•r-right right of, free speech. Mr. Napoli disagreed by stating that the•bus.i-ness license should not have been issued after the judge viewed it and declared it obscene. Mr.. Roach defended licensing procedufes• used and:refused.to debate the issue at this time. Mrs. Juanita Blume asked why hasn't such. -an Ordinance already,been passed regarding zoning for theatressand bookstores? The City Attorney replied that the Supreme Court just.passed the Zoning Ordinance requirement this past June. Pastor Dobson feared the theatre.would. result in a .boycott, o.f.•- the downtown merchants, and further, "why. didn't the Police seize al:l the films?" Chief Tebaldi reiterated the.City Attorney's statement that the'Supreme Court does not allow any restraint in. -exercising -that first':right of free -speech. However, the Police Department did seize the -film -and the theatre, in turn, ran copies.. Mayor T•idrick supported.the,City's position by -'stating that they would not go beyond the law, but that -they would welcome any suggestions the Public might have in.combating this problem. Mr. Frank Thomsen urged the delegation to listen to -the City Attorney, have patience, but not force - the legal merchants out ­ of. bus.i ness - Pascoe needs your support. Mr. Don McClure, President of Chamber of Commerce, read Chamber's opposition to XXX Move Theatre. Mrs. Lee Ann Roach criticized the Council for:not.taking-the.initiative and trying to unite the citizens i n .an:.effor.t.. to :ri.d. the City of this type of enterta4nment. She reminded the�Council that as :'l.eaders,-people looked to them for guidance and certainly something-could.be:done because no one wanted the theatre. Mr. Sheeley reiterated that the:.City Council.did not bring the theatre into town, the local merchants did not_bri.ng .it either-. -He was.proud of Pasco or he would not live here, he.acknowledged;that•.we.had_pr.oblems but everyone else did too and the only way we could solve them was to.work together - not "badmouth" efforts being made. .. Mr. Wilkins commended audience by saying., "If all people were as concerned as you, we would not need an Ordinance.T Mr. Bob Young', businessman, stated; we were having.much.the.same problems as other small towns; however, we.were.doing ev.erythi.ng we:•could•,to change our image and encouraged citizens.to.funnel their complaints,an& suggestions through the`Chamber of Commerce and City Council. Mayor T=i-drick•-empha'Sized that the City should be well aware of citizen input also. Mayor Tidrick reminded the delegation that.this council is A nterested in down- town Pasco, our staff is interested in.downtown-Pasco; however, this is a matter of perseverance and.patience because we just can't go over there and burn the building down. MINUTES PASCO CITY COUNCIL REGULAR MEETING UNFINISHED BUSINESS - Continued: OCTOBER 19, 1976 Mr. Ken Reithmeyer asked if time lag could be shortened by door to,door campaign? Staff replied negative. Mr. Wilbur Miller urged the citizens to take,more interest in their local government and to think more carefully about background of legislators we are sending to the State and Washington, D.C. Main motion carried by roll call vote of six (6). RECESS: '9':10 P.M., RECONVENED: 9:30 P.M. Two petitions were presented to the City Council in opposition -to XXX Theatre - one by Mr. & Mrs. John Valentine and the.other.by.Mrs. Angie Thomas. Collectively, there were around 700 signatures. EAST PASCO NEIGHBORHOOD FACILITY LANDSCAPING: Mr.. Sheeley moved that staff be authorized to prepare plans and specifications and call for bids for the land- scaping of the East Pasco Neighborhood Facility. Seconded:by Mr. Wilkins. Motion carried by roll call vote of six (6). LAND DISPOSITION: Mr. Sheeley moved to ,approve the -sale of Lots 12, 13 and 14, Block 101, along with the 10' x 150'.':north portion of -the vacated east/west alley adjacent to said lots, all located -in Pasco Land Company's First Addition, to Mr. Fred West for the sum of $4,500.00. Seconded -by Mr. Wilkins. Motion carried by roll call vote of six (6). ANNEXATION REQUEST -FROM MRS. BERLENE. BUTEER,:. Mr,.; $heeley moved to set a date for a meeting with the property owner.s.orr the annexation .of Mrs..Berlene'Butler's property, to be held on.Tuesday, November 2,-1976, which.is the date of the next regular council meeting, 8:00 P.M. or any time thereafter. Seconded by Mr. Schuel.ein. Motion carried by roll :call vote of six (6). SUGGESTIONS FROM COUNCIL - GENERAL DISCUSSION: In Councilman Wilkins called attention to.fence row adjacent to Wilkies "N Out and stated it was in dire need of being cleaned up. Staff noted this.suggestion. The City Manager called attention.to special meeting of the City Council, to be held Wednesday, October 20th at 7:30 P.M. This is in.regard to L.I.D.' s.
