PASCO CITY COUNCIL
REGULAR MEETING JULY 20, 1976
CALL TO ORDER:
Meeting called to order at 8:00 P.M. by J.C. Bailie, Mayor Pro -Tem.
ROLL CALL:
By Deputy City Clerk. Councilmen present were: S.K. Adams, J.C. Bailie,
Vernon Schuelein, David Sheel,ey, E.A. Snider and Bill Wilki'ns.' Mayor Jan Tidrick
was absent due to being in Olympia for Bridge Committee Meeting. Also present
were: George Smith, City Manager;.' Patrick'Roach, City Attorney';' Leo Olney,
Director of Finance; James Ajax, City Engineer; and Michael Corcoran, Planner.
PUBLIC HEARINGS:
SE 1/4, Section 25, T9N, Range 29, Government Lot 3, I-1 to R-3. (This item of
business transposed until end of meeting).
VISITORS:
Mrs. Kathy Smith complained of service to East Pasco area by Pasco Police. She
stated that on April 26, 1976, someone attempted to break into her apartment and
after three calls to Rbl'ice Department, one call to Sheriff's Departm'ent', Officer
Morgan responded to her call 1 1/2 hours later - stating he had'just received her
call. On. July 13, 1976, she had another burglary. When she called' the Police
Ddpartment, they said they would be right ouit and she alleges it took over 45
minutes.
The City Manager responded by stating that he had a full report and log of that
evening, and apparently, due to an extremely busy evening, one officer on patrol
in that vic-inity, and a mixup in the Dispatchers Office, the call was delayed
longer than usual; however; on behalf of the City, Chief Tebaldi and Lt. Smathers,
the City Manager apologized for the delay and assured the Council that it would
be investigated thoroughly.
Councilman Sheeleydefended the Police Department and e'ncoura ed'Mrs. Smith to

ride along on any Friday or Saturday evening to see how many calls they have to
rdspond to with limited manpower. Mr. Sheeley stated that he had widden along the
previous weekend and was most impressed by their manner and efficiency.' To this
Mrs. Smith responded, "if my boss was riding along, I'd do good work too."
ORDINANCES:
ORDINANCE NO. 1804:
AN ORDINANCE CHANGING THE ZONE CLASSIFICATION.OF CERTAIN REAL PROPERTY
WITHIN THE CITY OF PASCO FROM LIGHT INDUSTRIAL I-1 to HIGH DENSITY
RESIDENTIAL R-3.
Due to a surveying problem, Mr. Paul Lawson asked that the above public hearing
and Ordinance No. 1804 be continued to next regular meeting of th'e City Council.
Mr. Snider moved that zone change public hearing (SE 1/4, Section 25, T9N,
Range 29, Government Lot 3 - I-1 to R-3) and Ordinance No'. 1804 be continued to
next regular meeting of the City Council, to be held August 3, 1976. Seconded
by Mr. Adams. Motion carried by roll call vote of six ('6).
ORDINANCE NO. 1805:
AN ORDINANCE OF THE CITY OF PASCO, ESTABLISHING A CAPITAL PROJECT FUND
TO BE KNOWN AS THE "FIRE EQUIPMENT AND CONSTRUCTION. FUND" AND PROVIDING
FOR THE FUNDING THEREOF.
Ordinance No. 1805 was read by title only. Mr. Sheeley moved that Ordinance No.
1805 be adopted. Sdconded by Mr. Snider: Motion carried by roll call' vote of

BY THE SALE OF INTEREST BEARING WARRANTS.

Mr. Sheeley moved that. Resolution No. 1'046 be adQptOd. Seconded by Mr. '
Schuelein. Motion carried by roll call vote of six (6).
UNFINISHED BUSINESS:'
ANNEXATION -'VICINITY OF'OLD MANSION S'OUTH'OF SYLVESTER: The following statement
of policy was submitted' by.James Ajax, City Engineer, on the handling of annexation
procedures: '
."In accordance with RCW, this request should be.treated a.s a notification
by the requestingparties of their request or intention :to:commence ..
annexati'on proceedings. In receiving this statement of intent, the Council
shou'ld, by motion, set a date not 'later than sixty days' aft'dr the filing of
the request for a'meeting' with•the initiating parties to,determine whether the
City will:
1. Accept the annexation.
2. Require adoption of the Comprehensive Plan.
3. Require assumption of all or any parties of the City's
bonded .indebtedness.
If the City were 'to agree'to accept the annexation, it would then be.necessary
to:
1. 'Receive a 'petition representing' 75% of assessed valuation of
the. area
2. Set a date of and hold a public hearing.
3. Consider an Ordinance to'accomplish annexation"
Councilmen Sheeley and S -hider agreed if we foll'owed,pr.evious policies, we should
require them to adopt, the comprehen's'ive 'plandand not' require them to assume the
City's'.bonded indebtedness, but they felt we couldn't change the Ordinance for one
annexation.
Mr. Wilkins disagreed by stating, "we -shouldn't be` like' the other councils -.we
should say yes, we will consider annexations with certai'n'conditions and theyjwill
agree or disagree."
Mr. Schuel ei n expressed .concern' whether or' not Mr. Whitehead u'nd'erstood the' Ordi nance
goveri ng' requirements.'
Mr. Leonard Harms, representing Mr. Whitehead, adked the following questions:_
1) Is their a comprehensive plan for the City? The reply was affirmative.
2) Sh6uldn.'t adoption of comprehensive plandand assumption of bonded indebtedness
be considered at a Public Hearing? The reply was affirmative

To this, Mr. Sheeley replied that the petition had not been presented,properly and
stated, "I can't ask for a specific zone - that goes.to the Planning Commission first."
Mr. Harms stated that...they. had _done what they .were .told... Mr. Ajax substantiated
this statement by reiterating :_that.,Mr. Harms had . submi-tted .a proper 1 etter- asking
for annexation. Normally, when a City Council receives a petitmon for annexation,
it goes fmrst to the Planning Commission for their input and recommendations as to
what is most analogous. for ,the area and then back ,to .the City Council -to set a date
y of public hearing.
Mr. Schuelein stated, "if you are worrying about a time element involved, I would
suggest that you withdraw.because of opposition, problem of being landlocked by the
County, access, and he, personally, opposed high density.
Mr. Dale Howard, 3509 W. Hopkins, agreed with. Mr. ,Schuelei.n.',s•concerns and felt
high density area would result in increased traffic down Rds.'34 - 36 and on
Hopkins S.tr.eet. .He felt :the area should remain residential and.•presented a petition
bearing signatures of approximately 60'resid;ents in-opposi.tion.'• •
.Mr. Ajax responded .by. stating that. the .RCW..makes certain requirements. Analogous
to zone is not as much a 'pol icy i tem 'as. Code. i tem.. . Su.rther, -the Counc:i 1 • coul d
accept petition but with certain conditions the-petition.fs for consideration only.
Mr. Snider stated that.it_was:awkward to provide Police,and Fire protection to area
landlocked by the County.
Mr. Snider moved to not accept proposed annexation. Seconded by Mr. Sch.ue-l•ein.

Mr. Sheeley moved to accept consideration of the proposed annexation petition,
conditioned _upon:
1..' Adoption of the Comprehensive Plan upon annexation, and,
2.' Waive the ann€XEd area assuming the city's bonded indebtedness, and
3. Adoption of the most analogous city zoning to current Franklin County
zoning at the time of annexation.
Seconded by Mr. Adams. MOTION FAILED BY THE FOLLOWING.;ROLL-CALL VOTE: YES: Adams,
Sheeley and Wilkins. NO: Bailie,-Schuelein and: Snider..
.Mr. Sheeley moved to continue hearing until August 3, 1976 at 8:0.0 P.M. Seconded
'by Mr. Snider. Motion carried.'
Mr.'Harms presented tetter to connect to City sewer. Councilmen Sheeley and Snider
both opposed City sewer connections to out of City residents. Mr. Ajax responded
by stating the prior policy had been to petition for annexation if they wished sewer
service; if not, an agreement to annex inthe future.
QUESTIONAIRE ON PROPOSED RIVERVIEW ANNEXATION: Mr. Sheeley moved to authorize
the City Manager to send the proposed Community Interest Surveys.to residents in
the Riverview area who are•currently.receiving,utility bills. Seconded by Mr.
Schuelein. (discussion)
Mr. Smith, City Manager, suggested.adding one question, "are you a renter or
property owner?" The City Council concurred with this. Mr. Snider reiterated that
he was opposed to direct election method and felt the questionai_re_!hould be directed
to property owners only.
Mr. Earl Warren reminded the council that people in the Riverview area are primarily
interested in sewer only.

CONSENT AGENDA
APPROVAL OF MINUTES:
JULY 20, 1976
Prior to motion, Mr. Snider called attention to page 2, paragraph 15, the name
should have been Olson not Mrs. Gregson, Chairman of Planning Commission.
M,r. Schuelein requested that minutes reflect yea and nay voting record of each
Councilman.on roll call issues. Corrections noted.
Mr. Sheeley moved to approve Consent Agenda, as corrected. Seconded by Mr..
Snider. Motion carried. (Consent items were as follows)
BILLS AND COMMUNICATIONS:
a) 'To approve General Claims in the amount.of $311,006.26; Claim Warrant Nos.
5819 through 5924. .
SUGGESTIONS FROM COUNCIL - GENERAL DISCUSSION:
The Ctty Manager requested authorization from Council to write Mr. T.G. Gray,
Washington State Highway Commission, recommending that the Highway Department
make the deduction from the City's portion of the Arterial Street Gas Tax Funds,
prior to making any deductions from the normal gas tax revenues. He stated that
according to City's calculations, of the $37,500 which.would be deducted by the
SJ,ate from the City's gas tax portion, starting July 1, approximately $32,000
could be deducted from the City's arterial gas tax funds, leaving only approxi-
mately $5,500 to be deducted from the regular gas gax monies.
Mr. Sheeley moved to authorize the City Manager to write Mr. T.G. Gray of the
Washington State Highway Commission'i.nrr_egard.to City's -request.. Seconded by
Mr. Wilkins. Motion carried by roll call vote of six (6).
