HomeMy WebLinkAbout05-12-1976 MinutesCORRECTED MINUTES PASCO CITY COUNCIL SPECIAL MEETING/PUBLIC HEARING CALL TO ORDER: May 12, 1976 Hearing called to order at 8:10 p.m., by Jan Tidrick, Mayor. ROLL CALL: Councilmen present were: S.K. Adams, J.C. Bailie, Vernon Schuelien, David Sheeley, E.A. Snider and Jan Tidrick. Bill Wilkins was absent as he was not feeling well. Also present were: George Smith, City Manager; Patrick Roach, City Attorney; Leo E. Olney, Finance Director and Jim Ajax, City Engineer. PUBLIC HEARING: Councilman David Sheeley spoke about how the subject of the LID came to be. He stated that when he was campaigning the subject of better streets was a common subject of what needed to be improved."'With-this in mind he started the process of a possible LID. He sent out four notices to all of the property owners who would be affected by the LID statinj a%-.timbaand place of a meeting..;'.Theses,mee.ting.s:•would enable the City to get a better look about how many people would be interest in the creation of an LID. The boundaries of such LID were to be on the South by Court, on the East by 5th, on the West by 14th and on the North by Highway 12. Attendance at the :f.out=_preliminary meetings were about the same amount which were present at this Public Hearing, approximately 150. The main feeling after these four preliminary meetings was•..>.that'-_the City should proceed with the next steps for a LID. Jim Ajax, City Engineer, discussed the proposed LID, the location, assessment costs, finances and out look for the future. Mr. Ajax also stated the process of appeal for the people who were at the meeting and were against the creation of the LID. Mayor Tidrick stated that he would not vote for a LID which was opposed by 50% of the people going to be affected by the LID. Leo E. Olney, Finance Director, stated that the protest of the LID As of the,date of this public hearing is as follows: 62 accounts have been protested, assessment value of $68,720.76, which represents 7.9% of the total assessment. COMMENTS: Harry Turner, 1708 North 6th, stated that Court Stteet does not have any more than 2" of asphalt on it. Jim Ajax said that the looks would be similar as Court Street; 4" of crushed rock, 2" of concrete. Harry Turner also stated that he had not received a letter previous of the one for this meeting. He also wanted to know what the City Council was trying to pull and how much money each councilmen was going to make on this Mayor Tidrick stressed that the council would not benefit from the LID and that this meeting is to be a productive meeting and that any person wishing to comment should keep it in mind to keep it productive. Walt Kizer, 1713-1721 North 10th, stated that he was in favor of better streets but was wondering what it would do to the property value? Mr. Ajax stated that it would increase the real value of the property and that the value of the property being increased would increase the property taxes. He also stated that if he were asked if he wanted the streets improved that he might say yes but if you told him that it was going to cost him $1,700.00 to do so, he would of said no. Dave Diggs, 2112 West 9th, wanted to know if there were any other ways of financing the LID. Mr. Ajax stated that there is no-'_such�-_way. . The only way is through an LID. Dave Diggs also wanted to know if the Department of Social and Health Services had any funds available. Mr. Ajax stated that there were none. Stan Hunstein, 936 W. Pearl, presented a petition to the council, with 29 names,.:.agdinst the LID. Joe Gifford, 1819 N. 13th, wanted to know.if you could asphalt over the road already there. Mr. Ajax stated that if could not be done because putting asphalt over asphalt would cause the sidewalk and drains to be at different levels in accordance with the streets. Willard Burchill, 1504 14th. What about the gas tax money which the city receives. Couldn't the gas tax take some burden off the LID? Mr. Ajax stated that the City of Pasco received.two types of gas, tax; 1/2 cent gas tax fund and motor vehicle fuel excise tax fund. Half cent gas tax fund and to -,be used for arterial streets and not residental stredts�'The motor vehicle fuel excise tax fund goes into maintenance of city streets. All residental streets are put in by either the developer or by a LID. Louise Kizer, 1823 N. 13th, stated that it was too expensive. John Mesler, 1107 Lincoln Drive, wanted to know why you had to change the driveway ramps. Mr. Ajax stated that once the streets are improved there can't be any asphalting over it. It is my responsiblity to design a driveway which you can get your car over. John Westfall, 2115 N. Hopper, has a protest. It is to be noted that paper will be provided for people to protest this LID:when the meeting is at breaktime. Mary Simonton, 923 Lincoln Drive, wanted to stater�thattshbrDwassinr favor of itf-'even though it would hurt her to pay for it. She said that in the next few years the costs of it will go up and that we should do it now before it gets any more expensive. Jack Huckabone, 1108 Lincoln Drive, why do we have to have storm drains? Mr. Warell, 2105 14th, in favor. The costs is going up so we should do it now. Mr. Jim Sisk, 1747 N. 7th, in favor. Jim Ajax answered Mr. Huckabone's question of why storm drains? He said that there has been times that there was flooding in the City of Pasco. The LID consists of flat land and storm drains are needed because the land consists of 30 acres of land. If it rains the water off of 30 acres of land is a considerable amount. Marie Schultz, 1823 13th, is in favor of good streets but the'.cost.-is too high. How much do:the,.stotm-:drains have to do with the total costs? CORRECTED MINUTES PASCO CITY COUNCIL May 12, 1976 Mr. Ajax stated that it was between 10%-15% of the total project cost. Bob Anglen, 928 Ruby, what are the interest rates if the LID were to go through? , Mr. Ajax stated that it would be between 7%-7 1/2%. Bob Anglen, has it been considered to have smaller-:LlDs? Mr. Ajax, stated that it has been thought about but there are several advantages, namely, contractor will give a better cost for larger LID, costs of legal, attorneys, processing, etc., would be less because of it being a larger LID. A break' -in the public hearing at 9:30 p.m. The public hearing was again opened at 9:45 p.m. David Berg, 2107 N. 9th, stated that the City has an obligation to maintain the streets. What has happened? Mayor Tidrick stated that that�:has,3been...the case but there would be some attempt to keep them up better than they have been kept. Jacqueline Belanti, 1823 N. 13th, wanted to know^iT.Lthere­.was-jany legal obligation for the City of Pasco to maintain streets. Patrick Roach, City Attorney, stated that there was no bbligation because no contract was entered into concerning upkeep. Mike Capsule, 747 W. Agate, stated that it was bad timing to ask for more money from the property owners because of higher taxes from the state. He asked that a notice be sent out stating that the property owner either state yes or no for the LID and that the approximate cost be stated on the notice. Jim Ajax -stated that notices were sent out and that some did come back but that the informal meetings were just to get some type of feeling from the people as to whether they wanted the LID or not. Art Winter, 1615 Foster, asked who paid from the streets in the first place. Mr. Ajax stated that the majority of the streets were put in by the developers. Evelyn Dorendorf, 928 Pearl Street, cannot afford it. Ralph Meding, 1816 12th, stated that he was in favor of it because it would cost more in the future. Mary Sandvig, stated she was in favor of it. Lee Combs, 14th, stated that he can't afford it. Walt Stiner, 728 Jay, stated that he was in favor of it. Dick Plows, 1206 Jan, wanted to know if we were going to reevaluate traffic signs. Jim Ajax stated that that would be done in the area but that stops signs could not be put on every corner. A break in the public hearing at 11:00 p.m: --The public hearing reopened at 11:15 p.m. Mayor Tidrick asked for more discussion on the proposed LID. A third and final call. Mr. Adams was not sure if the voting should take place because of the amount of people having not beeni--.notified. Mr. Sheeley stated that if the City Council does not vote for the ordinance then everything which has been done would have been for nothing.and that the people will not be able to act on. -'.it. Mr. Sheeley also stated that do to the tight time table necessary to get the LID done this year a vote on it tonight would be necessary.so that the staff could start on the process should the property owners agree to have the LID. Ordinance No. 1789 was read by title only. Mr. Sheeley moved that Ordinance No. 1789 be adopted. Seconded by Mr. Adams. Motion carried by roll call vote of six (6).
