ROLL CALL: FEBRUARY 17, 1976 By Deputy City Clerk. Councilmen present were: S.K. Adams, J.C. Bailie, Vernon Schuelein, E.A. Snider, Jan Tidrick and. Bill Wilkins. Councilman David Sheeley was ill w4th a strep throat. Also present were George Smith, City Manager; Patrick Roach, City Attorney; Leo Olney, Director of Finance; James Ajax, City Engineer; Al Tebaldi, Chief of Police and Webster Jackson, Director of Urban Renewal. APPROVAL OF MINUTES: Mr. Wilkins moved that minutes of regular meeting,'held February13, 1976, be approved as written. Seconded by Mr. Adams. Motion carried. INTRODUCTION OF POLICE VOLUNTEERS:.. Chief Al l ebaldi of the Pasco Police Department called attention to the fact that our Police Volunteers had been in operation approximately three years and had contributed over 5,650 hours of work doing service for the City of Pasco. Seven of the reserves went on to full time law enforcement work, either with the City of Pasco or Franklin County Sheriff's Department. He then asked Lt. Bruce McCord to introduce the officers in attendance: Sgt. Don McAlpin, Sgt. James Eberhart, Sgt. Rich Long, Dave. Friday, Lee Phillips, Don Henie, Dennis Waters, Jack Vannice, Jr., Don Wharton, Donald Ledgerwood, Lewis Hawk, Holbert Wilson, Hap Pickrell, Jr., James'Kessie, Rictor Overlie, Bob Williamson, Rebecca Nelson, Teri Holland, Michelle Blasdel and Gracie Wilson. Mayor Tidrick stated "that,"having a good reserve gives us the help we need at the problem and critical times and gives backup assistance where needed." Mr. Snider commented that they should be commended for their public spirit. Mr. Wilkins asked for a round of applause as�a show of appreciation. Seconded by Mr. Bailie. Motion carried by roll call vote of six (6). COMMUNICATIONS: PLANNING COMMISSION: The follow.ing correspondence was received from James Ajax, City Engineer, for informational purposes.:. "Please be advised that in the regular meeting of February 12, 1976, the Planning Commi.ssi.on recommended denial of a requested zone change from low density Residential R-1 to Medium Density Residential R-2. There was significant opposition from residents of.the neighborhood. The property .involved.is as follows: Lots 10, 11, 12 and 13, Block 8,•Sylvester's . Second.Addition. Note: On Friday afternoon, February 13., 1976, Mr. Siegal withdrew his request for.the zone.change....Thus this document is for informational and recording purposes only."' No further action taken by the City Council. PLANNING COMMISSION: A letter.was read from.James Ajax, City Engineer, requesting a public hearing to rezone the following described..property from Residential R-1 to Light Industrial I-1 with the recommendation that they connect to City water when it is available:fo That portion of McLeod's First Addition to Pasco, lying souther-ly of,the.centerline of Liberty Street, and westerly of Highway 395. Mr. Wilkins moved that a.public hearing be.held on March -16,1976i -for -the purpose of hearing this request. Seconded by Mr..Schuelein. Motion carried. PUBLIC HEARINGS: L.I.D. NO. 86'- 5TH STREET IMPROVEMENT: It.was reported that the hearing•had been duly published and posted. The Deputy City Clerk read;description as follows: "An Ordinance approving and confirming the assessments and assessment roll of Local Improvemdnt District.No.. 86,.which has.been,created and established for the purpose of improving Fifth Avenue and Arthur Avenue from Columbia Street to Court Street within the City of Pasco, Washington, to arterial standards by grading, constructing and installing storm drains, curbs, gutters, street lighting, necessary sidewalks,.base rock, -leveling course, asphalt concrete surfacing, and all incidental. work, as provided by Ordinance No. 1705, and levying and assessing the amount thereof against the several lots, tracts, parcels of land and other property shown on the roll." There were three (3) protests; namely, D. Evelyn Edwards ($199.11); Richard and Erma Patrick ($922.34), and Bertha Roff($540.45) Mr. Wilkins asked if there was some way to assist hardship cases in paying their L.I.D.'s. In other words,.they would still have to meet their A ndividual assessments, but maybe they could budget it out monthly. Mr. Ajax, City Engineer, stated he was very sympathetic with hardship cases, but that there was no,satisfactory,method in treating.individuals... In -Mrs. Edward's case, her L.I.D. payment would amount to approximately $3.00 per month; however, she would have to budget this amount each month because the installments.were.due annually. In the case of Mr. Patrick, he was assessed on -a zone..anditermini method which has been the acceptable practice; further, the abutting;proper.ty owner paid for curb, gutter and sidewalk which was a sizeable amount:. To,•thi;s; Mr.., :Patri;ck replied that he did not see how a long, narrow 25' -lot could possibly be benefitted $922.34 worth. MINUTES PASCO.CITY COUNCIL REGULAR MEETING PUBLIC HEARING - Continued: FEBRUARY 17, 1976 Mr. Ajax stated that the City Treasurer sends out notices ten (10) days after roll is confirmed stating they have a prepay period .in which they ca,n pay all or a portion of without intenett. Mr. Tidrick asked what options are available to individuals protesting L.I.D. 's? Mr. Roach replied that they would have to appeal to the Superior Court; however, the City Council had the authority at.this time to reduce, modify or dilete assessments from the roll. To this, Mr. Tidrick stated, "however, we would have to justify our actions with staff." The Engineer reiterated that this project is paying its fair share and will work out onan equitable basis. Following three (3) calls from M§ryor-Tidrick for further comments from the floor, either for or against, the Public Hearing was declared closed. L.I.D. NO. 87 - LEOLA STREET IMPROVEMENT: It was reported that the hearing had been duly published and posted. There were no adverse communications. The Deputy City Clerk read description as follows: "An Ordinance approving and confirming the assessments and assessment roll of Local Improvement District No. 87, which has been created and established for the purpose of improving Leola Street from Poplar Avenue to Arthur Avenue within the City -of Pasco, Washington, to residential- standards by grading, constructing and installing gutters, base rock and leveling course, asphalt concrete surfacing, and all in- cidental work, as provided by Ordinance No. 1706, and levying and .assessing the amount thereof against the several lots, tracts, parcels of land and,.other property shown on the roll." The City Engineer reported that the final assessments were 65% lower than preliminary assessment. Following three (3) calls from Mayor Tidrick for further comments from the floor, either for or against, the Public Hearing was declared closed. RECESSED 8:50 P.M. - RECONVENED 9:00 P.M. L.I.D. NO. 88 - HUGO STREET SANITARY SEWER: It was reported that the hearing had been duly published and posted. There were no adverse communications. The Deputy City Clerk read description.as follows: "An Ordinance.approving and confirming.the assessments.and assessment roll of Local-Impr.ovement District.No. 88, which has.been created and established for.the.purpose of constructing and installing a sanitary sewer main extension on.East "A" Street from Sycamore'Avenue to Hugo Avenue,.and a sanitary sewer extension.on Hugo Avenue from East "A" Street to Alton Street within the City of Pasco, Washington, to a standard 'design of a sanitary sewer by furnishing all equipment, material, labor, and all incidental work, as provided by -Ordinance No. 1707, and levying.and assessing the amount thereof against the several lots, tracts, parcels of land and other property shown on the roll." The City Engineer reported that the final assessment figure was 82% of pre- liminary roll. Following three (3) calls from Mayor Tidrick for further comments from the floor, either for or.against, the Public. -Hearing was declared closed. 1 1 L.I.D.-NO. 90 - NIXON, 7TH, PARK, MARGARET & OCTAVE STREET IMPROVEMENTS: It was reported that the Hearing had.been duly published and posted. There were no adverse communications. The Deputy City Clerk read description as follows: "An Ordinance approving and confirming the assessments and assessment roll of Local Improvement District No. 90, which has been created and established for the purpose of improving Norbart Avenue from Sylvester Street to Nixon Street, Nixon Street from Norbart Avenut to Fifth Avenue, Park Street from Arthur. The City Engineer -reported that the average assessments were less than 70% of preliminary roll. .Mr. Bruce Lee asked if the City was going to fill'in-from'street to sidewalk on Nixon Street? Staff will check on this. Mr..Ajax stated this -could be connected with street lighting project. Following three (3) calls from Mayor Tidrick,for further comments from the floor, either for or against, the Public Hearing was declared closed. L.I.D. NO. 91 - WILLIAMS SUB -DIVISION IMPROVEMENT: It was reported that the Hearing had been duly published and posted. There were no, -adverse communications. The Deputy City Clerk read description as follows: !;.:' - "An Ordinance approving and confirming.the.assessments and assessment roll of Local Improvement -District No.'91, which has been created and established for the purpose of improving Road 27 -from Hopkins Street to;Bonneville Street and Bonneville Street from Road..27 to Road 28, within the City of yasco, Washington, to residential street standards by grading, constructing and installing storm drains, curbs, gutters, and necessary.sidewalks, crushed base rock, crushed leveling course, asphalt concrete surfacing and.all:incidental work ;�as provided by Ordinance No. 1710, and levying and assessing the.amount thereof against the several"lots, tracts, parcels of land and other property shown on the roll." The Deputy City Clerk read description as follows: "An Ordinance approving and confirming the assessments and assessment. roll of Local Improvement District.No. 92., which has been created and established for the purpose of improving Road 28 from Sylvester Street to West Lewis Street within the City of Pasco,. Washington, to arterial standards by gr.ading,,constructing and installing`storm drajns,lcurbs, gutters, base course,'asphalt.concrete surfacing;'traffic control de- vices and all incidental work, as' -provided by Ordinance•:No. 1711'1, and levying -and assessing the amount thereof against the several lots, tracts, Parcels of land and other property shown on the roll. The City Engineer reported that the average assessments were -approximately 92% of preliminary. Following three (3) calls from Mayor Tidrick for further comments !from the floor, either for or against, the Public Hearing was declared closed. Mr. Ajax introduced Mr:,Ted•Johnson, Engineering Aide for the City of Pasco, and commended him for his assistance in compiling these L.I.D:.records, ownerships, etc. He further stated that Mr. Johnson had put in many long hours at job sites and felt the City Council should be aware of his merits. The City Council expressed appreciation to Mr. Johnson for all his efforts. 342 MINUTES PASCO CLTY COUNCIL REGULAR MEETING VISITORS: FEBRUARY 17, 1976 There were no visitors wishing,to address the -Council at this time. CLAIMS AGAINST:THE CITY:. Robert Voghtman: Mr. Wilkins moved that potential .claim of -Robert Voghtman be referred to City Attorney and the Insurance Company for their action and/or -attention. Seconded by Mr. Adams. Motion carried.,. Kevin Ahlgreen: Mr. Schuelein moved that potential claim of Kevin Ahlgreen be referred to City Attorney and the Insurance Carrier for their action and/or attention. 'Seconded by -Mr. Wilkins. Motion carried. Mr. Snider questioned number of Police claims and cost factor. Staff will request disposition of these claims from insurance company for council's perusal. REPORTS FROM OFFICERS: CITY ATTORNEY, RE: HARRY D. KINZER: The following correspondence was.received from Patrick Roach,..C,ity Attorney: "I have reviewed the employment'contract of. the previous City Manager as per your request to determine what; ifany•;-action should be. -taken with respect to.securing overpayment of City funds.' -After reviewing the State Constitution,.Statutes.and Pasco's Municipal Ordinances, I have come to the following conclusion: 1). The'City'of Pasco is entitled to the amount overpaid to Harry Kinzer at the time of his termination. I 2) Harry Kinzer is'entitled.to an offset approximately equal in amount for underpayment of his salary during 1975'.. 3) The cost to the City in terms of time and money.would not, from a practical standpoint, warrant commencing any legal action. I would, therefore, request of the.City Council.authorization to prepare the necessary.documents for a status quo settlement with the necessary releases from all parties." RESOLUTIONS: RESOLUTION NO. 1020;-a A RESOLUTION OF THE CITY*OF PASCO AUTHORIZING THE MAYOR,TO ENTER INTO A CONTRACT FOR THE YEAR 1976 WITH THE BENTON-FRANKLIN COUNTY HUMANE SOCIETY, INC. Resolution No. 1020 was read by.title only. Mr. Adams moved that Resolution No. 1020,be adopted. Seconded.by Mr. Schuelein. (Discussion),. Mr. Schuelein asked, "are we going into this with the idea of improved service?" Staff replied affirmative. Mr. Adams stated h_e felt the new managers were very sincere in their, efforts and should be given a chance. Mr. Snider expressed concern that if service wasn't improved at the end of six months, we should seek other avenues. Main motion carried -by rol l call .vote of 'six (6)'. MAIN ORDER OF BUSINESS TRANSPOSED TO HEAR PRESENTATION OF HARRY D. KINZER: Mayor Tidrick recognized Mr. Kinzer in the audience and asked if he would like to state anything to the Council: Mr. Kinzer repl'ied'yes. First,:he'commended the.Council for being a unified council, and unfortunately for him, it came about 'a year too late. Secondly, he wanted the record set straight on overpayment of sick leave and underpayment of salary. Pieroni, Manager of Clover Leaf Lanes: "I would like to submit for -approval by your office, an application for permission to purvey alcoholic beverages, as per license granted by the Washington State Liquor Control Board, to the bowling lane area at Clover Leaf Lanes, located at W. Lewis & Rd. 28 in Pasco, Washington. I represent the licensee, Atomic Lanes, Inc. dba Bar -X Lodge at Clover Leaf Bowling Lanes, and request that we be permitted.to serve all beverages directly to -the bowling area from our. cocktail. --lounge. Atomic Lanes', Inc. operating Atomic Lanes Bowling Center has received permission,and is,. in fact, operating in this manner at their Richland facility. We hope to be in operation at Clover Leaf by April 1,_1976, and an early decision in this matter by your office would -facilitate transmission of final papers to the State Liquor Board for disposition. Discussion) Mr. Schuelein asked, "how much will liquor sales increase your revenue?" Mr. Pieroni replied that they were trying to develop a family type recreational area, and'the serving of liquor wil'1 be more of a service than a revenue investment. He further stated that this service will continue after 6:00'in the evening when they cater, primarily, to bowling leagues and less children. There are nursery facilities as well as recreational areas for children available. At all.times, there would be at least 4.to 6 persons over 21.policing the lane area. Mr. Snider expressed concern that liquor sales should be restricted to lounge area because there are a lot of children bowling, particularly in the summer. REFERENDUM 27 - MUNICIPAL & INDUSTRIAL WATER SUPPLY FUNDING REQUEST, PROJECT NUMBER 277509720: The City Manager apologized for overl.00king.acceptance agreement from the De- partment of Social and Health Services in the amount of $38,231.00 for a portion of the project costs. This had been previously discussed at Workshop meeting of February 10, 1976. . Section P - Specific Conditions was read into the record and caused concern among several councilmen: "The applicant must, submit a signed.and,dated :statement, ,i.n.addition to the Offer and Acceptance Agreement,,.:stating that the applicant will actively participate in water utility coordination activities conducted through the Benton -Franklin Governmental Conference, and in development of solutions.to.area-wide concerns as,expressed.in.the.letter from Mr. Alan Rowe to the governmental conference, dated October 22, 1975. This statement agreeing to participate must be submitted to the Department's Water Supply and Waste Section, Mail Stop 4-1, Olympia, Washington, 98504 by March 15, 1976." Mr. Snider stated, "Section P looks like we are bound to participate in the Governmental Conference.". The City Attorney responded by stating, "as I read the contract, Section P only obligates the City to participating,in a.study, and by signing this, we are in no way altering plans for future water planning." To this, Mayor Tidrick reiterated that before the City commits itself to anything, we want to know what we are committing ourselves to. Mr: Ajax stated that they are forming a Water Utility,Coordinating Committee which will answer to the Benton -Franklin Governmental Conference. This group merely establishes minimum criteria for water systems. Mr. Snider expressed concern over relationship with solid waste. :Mr. Wilkins responded by stating that we are paying cash for opinion of Health Services, and as he sees this request, we are merely being asked to participate. Mr. Sniderstated that "if we are only bound to.a study and we.do not have to alter our plans in any way, I,will withdraw my objection, but only on that basis."
