CALL TO ORDER Chairperson Glatt called the regular meeting of the Code Enforcement Board to order at 7:00 p.m. B. ROLL CALL a. Board Members MEMBERS PRESENT Daniel Gottschalk Russell Glatt MEMBERS ABSENT Dennis Duncan Dwayne Speer Mary Gutierrez C. ADOPTION OF MINUTES: Board Member Speer moved, seconded by Board Member Gottschalk, that the minutes of the March 5, 2015 meeting be approved. The motion carried unanimously. D. DETERMINATION HEARINGS: Chairperson Glatt explained the procedure and purpose for the meeting, noting that the City of Pasco was the Petitioner and property owners and their authorized representatives who had appeared to discuss the alleged violations of the Pasco Municipal Code were the Respondents. a. Administration of Oaths Troy Hendren, Inspection Services Manager, asked that all City staff, respondents and any witnesses who had appeared to offer testimony before the Board be sworn to truthfulness. Chairperson Glatt asked the audience if there were any objections to any Board Member hearing any matter. There were no objections. All City staff, respondents and witnesses who wished to provide testimony before the Board were sworn to truthfulness. b. Hearings Scheduled Chairperson Glatt advised that the Board was now ready to proceed with the hearings and asked the City to begin presentation of the cases to be heard. i. City of Pasco vs. Evans, Thomas & Debbra, case number CEB2015-0628, for the property located at 1815 W. Yakima Street Troy Hendren, Inspection Services Manager, asked Code Enforcement Officer Debbie Scott to read the case facts into the record. Ms. Scott indicated that the cited violations on this property were PMC 5.78.010 – Expired rental license and PMC 5.78.020 – Failure to submit a habitability inspection. The rental unit was an expired rental license from March 2, 2015 which is a violation of the Pasco Municipal Code and determined to be a repeat violation. A previous notice was sent October 9, 2014, case number CEB2014-2532, for an expired rental license. This case came into compliance and was dismissed. A 06042015 CEB Minutes Page 2 of 3 repeat notice of civil violation was issued on April 23, 2015 via certified mail. The property owners were legally notified on April 28, 2015 of the conditions believed to be repeat violations of the Pasco Municipal Code. The license was renewed on May 29, 2015. Based on the Rental License Database compiled on May 28, 2015 the property is in compliance at this time. The City recommended imposing a repeat penalty of $200. Tom Evans, 1815 W. Yakima Street, spoke on behalf of this case. CODE BOARD DECISION: Board Member Gottschalk moved, seconded by Board Member Duncan that the actions taken by the City were appropriate and timely. The motion carried unanimously. Board Member Speer further moved, seconded by Board Member Duncan, to impose a repeat penalty of $200 to be held in abeyance for 12 months and dropped if no further violations in that time. The motion carried unanimously. ii. City of Pasco vs. Foust, Gary, case number CEB2015-0302, for the property located at 3008 W. Wernett Road Troy Hendren, Inspection Services Manager, asked Code Enforcement Officer Martin Barajas to read the case facts into the record. Mr. Barajas indicated that the cited violations on this property were PMC 12.16.020 – Depositing sand, gravel, dirt and other substances on the City street, PMC 9.56.030, 9.56.040 – Work on and around the property has allowed dirt, sand and dust to be placed on the public street and PMC 9.60.020(1) – Transporting scrap metal and other items for the purpose of scrapping in and out of a residential district on trucks and trailers, storing some items on the property and in the right -of-way. The property was inspected on March 16, 2015 for violations to the Pasco Municipal Code. Violations were observed and determined to be a repeat violation. A previous notice had been sent on September 10, 2014, case number CEB2014-2299, for no City of Pasco business license. The initial case was closed on December 19, 2014 after meeting with the property owner at which time almost all the materials had been removed from the site and the property owner agreed to not bring any more materials on to the property. A repeat notice of civil violation was issued on March 17, 2015 via process server. The property owner was legally notified on April 21, 2015. Multiple inspections show the recycling/scrap metal business and activities have continued for months at this location. Based on final inspection of the property completed on June 4, 2015 the property is in compliance at this time. The City recommended imposing a service penalty of $45 for the cost of personal process server and a repeat penalty of $200 for operating an unlicensed business in the City of Pasco. Gary Foust, 3008 W. Wernett Road, spoke on behalf of this case. CODE BOARD DECISION: Board Member Speer moved, seconded by Board Member Duncan that the actions taken by the City were appropriate and timely. The motion carried unanimously. Board Member Speer further moved, seconded by Board Member Duncan, to impose a $45 fee to reimburse the City of a process server and a repeat penalty of $200 to be held in abeyance for 12 months and dropped if no further violations in that time. City of Pasco vs. Mi Tierra Real Estate Investments Inc., case number CEB2015-0148, for the property located at 812 S. Myrtle Avenue ii. City of Pasco vs. Mi Tierra Real Estate Investment, case number CEB2015-0309, for the property located at NKA Vacant Lot e. Motion Chairperson Speer made a motion to approving Resolution No. 2015-006 as amended, Board Member Duncan seconded. The motion carried unanimously. E. STAFF REPORT AND OTHER BUSINESS: Troy Hendren introduced Alonso Torres as the newest Code Enforcement Officer. F.
