CODE ENFORCEMENT MINUTES
MEETING OF MAY 7, 2015
A. CALL TO ORDER
Chairperson Glatt called the regular meeting of the Code Enforcement Board to order at 7:00 p.m.

C. ADOPTION OF MINUTES:
Board Member Speer moved, seconded by Board Member Gottschalk, that the minutes of the March 5, 2015
meeting be approved. The motion carried unanimously.
D. DETERMINATION HEARINGS:
Chairperson Glatt explained the procedure and purpose for the meeting, noting that the City of Pasco was the
Petitioner and property owners and their authorized representatives who had appeared to discuss the alleged
violations of the Pasco Municipal Code were the Respondents.
a. Administration of Oaths
Troy Hendren, Inspection Services Manager, asked that all City staff, respondents and any witnesses
who had appeared to offer testimony before the Board be sworn to truthfulness. Chairperson Glatt
asked the audience if there were any objections to any Board Member hearing any matter. There
were no objections.
All City staff, respondents and witnesses who wished to provide testimony before the Board were
sworn to truthfulness.
b. Hearings Scheduled
Chairperson Glatt advised that the Board was now ready to proceed with the hearings and asked the
City to begin presentation of the cases to be heard.
i. City of Pasco vs. Posada, Andres & Juanita, case number CEB2014-2770, for the property
located at 201 N 8th Avenue
Troy Hendren, Inspection Services Manager, asked Code Enforcement Officer Debbie Scott to read the
case facts into the record.
Ms. Scott indicated that the cited violations on this property were PMC 8.02.190 – Failure to renew a dog
license for 2014, observed one unlicensed male dog on the site and neighbor confirms two dogs on site.
On December 1, 2014 a small black dog was observed at the fence and the dog was photographed. On
December 2, 2014 staff received information that there were still two dogs at this location, Raider and
Daisy. It was confirmed that both dogs still reside at the property and had never left. A violation was
observed and was determined to be a second offense violation of the Pasco Municipal Code. A correction

notice was sent on April 17, 2013 for case number CEB2013-0589, failing to renew the dog license for
Daisy. Staff received no contact from the owner of the dog so on August 19, 2013 a first offense notice
of civil violation was sent. On August 27, 2013 a phone call was received from Juanita Posada stating
that their dog had run away which is why they didn’t renew their dog license. Staff received another call
from Juanita Posada on August 28, 2013 stating they she was going to renew her dog license when she
renewed her dog license but then her dog never came back. The case was closed upon the initial ph one
call on August 27, 2013. A second offense notice of civil violation was issued via process server on
December 30, 2014. The property owners were legally notified on December 30, 2014 of the conditions
believed to be a second offense of the Pasco Municipal Code. On December 11, 2014 a phone call was
received by Juanita Posada stating that she would license her dog, Daisy, when she got back from Arizona
at the end of January. She was informed that she would need to license two dogs on site for 2014 and
2015 and was given an extension until February 15, 2015. Due to financial problems, Juanita asked for
another extension. Staff stated that she would need to license one dog for 2014 and 2015 and the case
would be continued until the April 2, 2015 Code Board and would need to license the second dog by
March 2, 2015. This case would still be on for Code Board until one dog is licensed. Ms. Posada
licensed the first dog for 2014 and 2015 on February 9, 2015 and licensed the second dog on March 4,
2015. Based on the dog licensing database completed on March 4, 2015 the property is in compliance at
this time.
The City recommended a service penalty of $45 to reimburse the City for the cost of personal service of
the notice and imposing a repeat penalty of $100.
Juanita Posada and Juanita Arocha, 201 N 8th Avenue, spoke on behalf of this case.
CODE BOARD DECISION: Board Member Duncan moved, seconded by Board Member Gottschalk that
the actions taken by the City were appropriate and timely. The motion carried unanimously.
Board Member Speer further moved, seconded by Board Member Duncan, to impose a $45 fine penalty
to reimburse the cost of personal service and impose a repeat penalty of $100 to be held in abeyance for
12 months and dropped if no further violations in that time. The motion carried unanimously.

Chairperson Gottschalk made a motion to approving Resolution No. 2015-005 as amended, Board
Member Duncan seconded. The motion carried unanimously.
E. STAFF REPORT AND OTHER BUSINESS:
Troy Hendren introduced Alonso Torres as the newest Code Enforcement Officer.
F. ADJOURNMENT
There being no further business before the Pasco Code Enforcement Board, the meeting was adjourned by
Chairperson Glatt at 7:21 p.m.
