C hairpe r son Glatt asked the audience if there were any object io ns to a ny Board Member hearing any matter. There were no objections. All C ity staff, respondents and witnesses who wished to prov ide tes tim o ny before the B oard were swo rn to truthful n ess. b. Hearings Sc hed ul e d Cha irpe rson Glatt advised that the Board was n ow ready to proceed w ith t he hearin gs and a s k ed t he C ity to begin presentation of the cases to be heard . 1. C ity of Pasco vs. Posada, Andres & Juanita, case number CEB2014-2770, for the property located at 201 N 81h Avenue Troy Hendren , In s pectio n Services Manager, as ked Code Enfo rcement Officer Deb b ie Scott to read the case fac ts int o th e record . Ms. Scott indi cated that th e ci ted vio lation s o n this pro perty were PM C 8.02 .190 -Fa ilure to re new a dog lic e nse for 2014, observ ed o ne unli cen sed male dog on the s ite and n e ig hb or co nfirm s two d ogs o n s ite. On Decembe r I , 2014 a s mall black dog was observed at the fe nce a nd t he d og was photographed. On December 2 , 2 014 staff received informat io n that there were still two d ogs at thi s locati o n , Raid e r and Dai sy. It was confirm ed that both dogs still res ide at the property and had never left. A vio la ti o n was observed and was determined to be a second offense v io lation of the Pasco Mu nicip a l Code. A correction 05072015 CEB Minutes P age 1 o f 2 notice was sent o n April 17 , 2013 for case number CEB20 13-0589, fail in g to renew the d og lice nse f or Dai sy. Staff rece ived n o contact from the owner of the dog so o n A ugust 19 , 20 13 a fir st offense notice of c ivil v io lati o n was sent. On A ug ust 27, 2 013 a phone call was received from Juanita Posada s tatin g that their dog had run away w hi ch is w hy they didn't renew their d og li cense. Staff re ceived another call from Juanita Posada o n August 2 8 , 2013 statin g they s he was go in g t o re n ew h er dog li cense w he n s he re n ewed her dog lic ense but then her dog never came back. T he case was c losed upon th e initi a l phone ca ll o n August 27, 2 01 3. A second offense no t ice of c ivi l vio lation was iss ued via process se rve r on December 30,2014. The property owners were legall y notified on December 3 0,2014 of the cond iti ons beli eved to b e a second offense of the Pasco Municipal Code. O n December II , 2014 a phon e call was received by Juanita Pos ada s tating that s he wou ld l icense her dog, Daisy, w hen s he got bac k from A ri zona at the e nd o f J a nuary. She was informed that s he wou ld nee d to li cense two d ogs o n s ite for 20 14 a nd 2015 and was g iven an extens ion until February 15 , 2 01 5. Due to fina nc ia l pro blem s, Juanita asked for another extension. Staff s tated that s he wou ld need to li cense o ne dog for 2014 a nd 20 15 and the case wo uld be continu ed until the April 2, 2015 Code Board and would need to lic e n se t he secon d d og by Marc h 2, 2015. T hi s case wo uld still b e on for Code Board until o ne do g is li cen sed. Ms . Po sada l ice n sed the first dog for 2014 and 20 15 on February 9, 2015 and li cen sed th e second dog o n Marc h 4 , 2015 . Based o n the dog lice ns in g database completed on M arch 4, 20 15 the property is in compliance at t hi s time. T he C ity recomme nd ed a service penalty of $45 to reimburse the C ity for the cost of personal servi ce of th e notice and impos in g a repeat penalty of $100. T h e motion carried unanimously . Board Member Speer further moved, seconded by Board Member Duncan , t o impose a $45 fine penalty to re imburse the cost of personal service a nd impose a repeat pe nal ty of $100 to be he ld in abeyance fo r 12 month s and dropped if no futth e r violations in that time.
