HomeMy WebLinkAbout1304 ResolutionRESOLUTION NO. 1304 WHEREAS, the City of Pasco, a municipal corporation organized under the laws of the State of Washington, located in Franklin County, and Franklin County, a municipal corporation organized under the laws of the State of Washington, have entered into an agreement regarding the joint operation of the Pasco Police Department and the Franklin County Sheriff's Department in relation to the providing of record- keeping, dispatch service, and the provision of other services between the agencies of each municipality, NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PASCO: The City Council of the City of Pasco does hereby approve of the Agreement between the City of Pasco and Franklin County referred to above, a copy of which is attached hereto, marked Exhibit "A", and incorporated herein as though fully set forth at length. The City Council of the City of Pasco does hereby further authorize the Mayor and the City Clerk to execute the Agreement in the usual -fashion. De F li ,, City Attorney A G R E •E M•E N T THIS AGREEMENT entered into this _y� day of � 1979, by and between the CITY OF PASCO, a municipal corporation organized ' under the laws of the State of Washington located in Franklin County, its Police Department; and FRANKLIN COUNTY,. a municipal corporation organized under the laws of the State of Washington, and the Franklin County Sheriff's Department, relating to the joint operation of the Pasco Police Department and the Franklin County Sheriff's Department in providing recordkeeping, dispatch service, and the provision of other services between the agencies of each municipality. THE PARTIES MUTUALLY COVENANT AND AGREE AS FOLLOWS BASED ON THE CONSIDERATIONS HEREIN, INCLUDING THE BENEFIT TO THE PUBLIC INTEREST AND THE GENERAL WELFARE OF THE CITIZENS OF THE CITY OF. PASCO AND FRANKLIN COUNTY: 1. The implementation of this agreement shall be dependent upon the City Council of the•City of Pasco and the Franklin County Commissioners providing the funds necessary to fill the positions needed to provide the services described herein for each year that this agreement shall be in effect. It shall be the respons.ibility of the Chief of Police of the Pasco Police Department and the Sheriff of Franklin County to provide written notice to each other, on or before December 1 of each year, stating whether or not the forthcoming budget provides the funds for the necessary positions. In the event both the City of Pasco and Franklin County have provided the necessary funds, this agreement shall automatically be in effect from January 1st to December 31st of the succeeding,year. However, in the event either the City Council of the City of Pasco or the Franklin County Commissioners should deem that there is an emergency requiring the.reappropriation of"the funds provided for the positions needed to provide the services described herein and if it should then become a hardship for either party to provide.the positions, this agreement may be terminated by passage of a resolution by either the City Council or the Franklin County Commissioners giving not less,than seven (7) days notice of termination of this agreement. This agreement may also be terminated effective January 1st of any year by giving written notice to the othei""party not later than October 1st of the preceding year. 2. On or about January 1, 1980, the sheriff shall hire one dispatche and one dispatcher supervisor. The police department shall pay 5070 of the combined costs of these two positions. The salaries paid the persons filling these two positions and the other personnel costs of these two positions shall be reasonable and in relative accordance to the pay rate in effect-aV'the time in the Pasco Police Department and the Franklin County Sheriff's Department. Franklin County through i•ts Sheriff's i Department shall then be 10070 responsible for -the provision of dispatching services for both Franklin County and the City of Pasco's Fire Department, ambulance service, and Police Department. 3. The City of Pasco's Police Department shall be responsible for ine recordkeeping function of both the Police Department and the Franklin County Sheriff's Department. 4. Each agency shall pro.vide mutually satisfactory service to the other. Satisfactory service is generally defined to mean that level of service equal to or better than that being received by the agency providing the service to the other agency. In no event shall such service be less than the service currently being provided by each agency. 5. The Franklin County Sheriff's Department and the Pasco Police Department shall use the record system now established by the Pasco Police Department. The numbering'of all cases shall be by separate department as is currently practiced in all.Form 2's (officers' written reports) and shall be filed separately. 6. The records for type of crime, location of crime, property, name cards, etc., shall be on common file for both agencies. 7. The records division shall maintain daily statistic records and shall transmit a monthly report of such statistics to the Sheriff and the Chief of Police. 8. The Police Department shall maintain a full-time evidence technician in the crime lab who shall be available for major crime scene assistance to the Sheriff's Department on an on-call basis. The property/evidence room shall be administered by the evidence technician for. both agencies .in a manner that is secure and efficient as mutually approved and agreed to by the Sheriff and the Chief of Police. 9. The photo lab shall be operated by the Franklin County Sheriff's Department and service shall be provided to the City of Pasco Police Department. 10. The Police Department shall compensate the Sheriff's Department for the services provided by the photo lab and the Sheriff's Department shall compensate the Police Department for the services of the crime lab on an exchange of services basis. Each agency shall maintain sufficient supplies for the operation of the respective laboratories. 11. The Pasco Police Department and the Franklin County Sheriff's Department mutually agree to provide competent employees involved with the provisiori�of the services described herein andeach shall provide its own employees with necessary training and skill maintenance. 12. All operating costs shall be divided as follows: .A. Telephone -911 Emergency System: Police 501/11o, Pasco Fire 107o Sheriff 407 Non -Emergency: Police 60%, Sheriff 407o' B. WACIC - Teletype/CRT Police 507o, Sheriff 500 C. Radio Repeater Maintenance: Police 507o, Sheriff 500 D;,,1,1pupplies and Equipment: Police 717o, Sheriff 29% -3- 13. Franklin County through its Sheriff's Department shall operate jail and detention facilities and the City of Pasco shall pay an Dpriate "prisoner -day" rate. This rate is to be determined subject to the provisions in Section 2 of the joint resolution City of Pasco Resolution No. 796 and Franklin County Resolution No. 23-70. The Police Department Clerk/Dispatchers and similarly classified employees shall not be used as jail matrons. They shall not perform jail checks,, administer medicine, conduct strip searches, perform security tasks, or be responsible for any related duties. City Police Officers and County Road Deputies shall mug and print their own prisoners if the subject is in reasonable condition and .cooperative. If not, the Franklin County Jail personnel.shall handle the subject. 14. Each agency shall provide back-up units -to the other agency on an ongoing reciprocal basis. The Franklin County Sheriff shall deputize City of Pasco Police Officers to the extent necessary to make effective the reciprocal back-up services described herein. 15. In the event there should be any problems or disputes relating to the subjects covered in this agreement, each party shall provide notice of such problem or dispute.to the other and shall attempt to resolve said problem or dispute by first having a meeting and discussion between the Sheriff and the Chief of Police. 16. Any change in the operation of either the Franklin County Sheriff's Department -or the City of Pasco's Police Department that substantially affects the costs of the operation covered by this agreement or which.,shall affect the ability of either party to provide the services covered by this agreement, shall be discussed between the Franklin County Sheriff's Department and the Pasco Chief of Police prior to such change, unless there exists such an emergency that makes it impractical for a prior discussion to occur. Any such changes agreed upon by the Sheriff and Police Chief will need the approval of the County Commissioners, City Council, and City Manager prior to becoming effective.
