[REAS, the proposed Eagle Estates Subdivision No. 3's required
construction improvements include the installation of a sanitary sewer and water
system, and
WHEREAS, it is desired to cross property outside the subdivision, and
WHEREAS, the construction of these facilities will be of public benefit,
NOW, THEREFORE,
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PASCO:
That the City Council accept the proposed easement from Earl and Priscilla
Warren, which provides for the construction, operation and maintenance of utilities
across a portion of government Lot 3, Section 25, Township 9 N, Range 29 E.W.M.
PASSED by the City Council of the City of Pasco this 3 day
of December , 1979.

For good and valuable consideration, the receipt of which is hereby acknowledged,
hereby grant(s) to City of Pasco of Franklin County, Washington, a municipal cor-
poration, and to its successors or assigns, the right to enter upon the lands of the
Grantor(s) situated in the County of Franklin, State of Washington, and more part-.
icularly described as follows:
An easement over the East 20,0 feet of that portion of the West
half of. South half of West half of following described tract, which
lies North of the North line of West "A" Street: Beginning at a.
point in North line of government lot 3, Section 25, Township 9
North, Range 29 East, W.M., which point is 8 rods West of Northeast
corner of said lot; thence West 35.86 rods; thence South 80 rods;
thence East 35.86 rods; thence North 80 rods to a. point of begin-
ning.
and to construct, operate and maintain over and under the above described lands .a
water main pipe and other public utility services as may be desirable and necessary
for the purpose of constructing, reconstructing, maintaining and removing said
uti.tities and appurtenances, and -to exercise such other rights as necessary to
carry out these purposes.
The grantor(s) agree(s) that all facilities installed upon or under the above
described lands at the gran Lee's expense sha11 remain tie property of the grantee,
and that the grantee shall have the right of ingress and egress over the adjacent
lands of the grantor(s) for the purpose of exercising all rights hereby. granted.
All rights hereunder shall cease when the grantee, its successors or assigns,.
: abandons or removes said line or system.
Grantee shall not .be liable for any damages caused to Grantor's property by '
actions reasonable taken by Grantee in the exercise of the rights herein granted.
