A RESOLUTION OF THE CITY OF PASCO FORMALIZING DISPUTED BILLS
PROCEDURE.
WHEREAS, the Supreme Court of the United States of America on May 1, 1978,
determined that utility service fits the definition of "property" and is, therefore,
subject to the protections afforded by the 14th Amendment regarding "due process";
and
WHEREAS, such protections include adequate time, adequate warning and a
timely opportunity, to meet with designated personnel who are duly authorized to
review disputed bills and take. such action as necessary before disconnecting the
service of a delinquent account holder; and
WHEREAS, the City of Pasco desires to formalize such a procedure; NOW,
THEREFORE,
THE CITY COUNCIL OF THE CITY OF PASCO DOES RESOLVE AS FOLLOWS:
Section 1. As soon as possible, billing forms and_ delinquency..nbtices be
amended to include notice of the availability of an appeals process which shall
specify the Hearing Officer's business address, telephone number and during which
hours of the day disputed bills may appropriately be considered.
Section 2. That the City Manager -is. hereby authorized and directed to
appoint a Hearing Officer and an alternate and formulate such internal procedures
as are necessary to carry out the intent of this resolution.
PASSED by the City Council of the City of Pasco this 18 day of
June , 1979.
