HomeMy WebLinkAbout1230 Resolutionu RESOLUTION NO. 1230 WHEREAS, the City of Pasco's Comprehensive Park and Recreation Plan has recommended the sale of two small lots described below; WHEREAS, it would be in the best interest of the city to sell the lots as they are surplus to the future and foreseeable needs of the city; and WHEREAS, the circumstances surrounding the acquisition of these lots involved a requirement by the city's planning commission that they be dedicated to the city for the purposes of parks as a condition of approving the subdivisions in which they are contained; NOW,, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF PASCO: That the staff members of the City of Pasco are authorized to enter into negotiations to sell Lot 11, Block 1, of Eagle Estates; and Lot 5, Block 2, of Williams Addition. It is further resolved that Lot 11, Block 1, of Eagle Estates may be sold for a price of Three Thousand & 00/100 ($3,000.00) Dollars and Lot 5, Block 2, of Williams Addition may be sold for Four Thousand & 00/100 ($4,000.00) Dollars which is below the appraised value of Ten Thousand & 00/100 ($10,000.00) Dollars for each lot for the reasons set forth below: 1. The lot dedicated by Mr. Keltch was dedicated with a clause requiring that the property revert to Mr. Keltch or his heirs in the event.it was ever used for anything other than park purposes. 2. At the time of the dedication, Mr. Keltch agreed that he would pay Three Thousand & 00/100 ($3,000.00) Dollars for the lot in the event the city no longer wished to use it as a park site in the future. 3. Although the dedication from Mr. Williams did not contain a reversionary clause, Mr. Williams was required to dedicate the property for park purposes in order to have the city planning commission approve his subdivision. Because of this arrangement, there is a substantial legal question as to whether or not the city can use the property for any other purpose. 4. For the reasons above, the value of the property in the hands of the city is less than the appraised value. S. The sales price of the lot to Mr. Williams incorporates the understanding that the city assumes obligation for paying off the outstanding street L.I.D. assessment from the proceeds of the sale.
