HomeMy WebLinkAbout1229 ResolutionRESOLUTION NO. 1229 A RESOLUTION confirming the appointment of a police court judge by the City of Pasco, establishing the duties of the position, and regulating the operation of the Pasco Police Court. WHEREAS, the City of Pasco its own police court pursuant to to continue that practice, and has chosen in the past to operate R.C.W. Chapter 35A.20 and wishes WHEREAS, the operation of Pasco Police Court is an important matter to the citizens of Pasco; NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PASCO DOES RESOLVE AS FOLLOWS: Section 1. That Arthur J. Bieker is confirmed as Pasco Police Court Judge for an appointment to a four-year term, which.term shall be concurrent with the term of the term for the Justice of the Peace under the general law effective in Franklin County (January 8, 1979, to January 10, 1983). Section 2. The salary for this position is to be set by ordinance as required. Section 3. The powers and duties of the Pasco Police Court Judge shall be as contained in R.C.W. Chapter 35A.20 and shall include such powers and duties as are required by all applicable laws. Section 4. The Pasco Police Court shall be held at such times, places, and in such a manner as the city council or the city manager directs. It shall be the duty of the Pasco Police Court Judge to make such local court rules not inconsistent with the court rules for Justice Courts in Washington State necessary to fulfilling the duties and obligations of the office and to otherwise promote the efficient and judicious operation of Pasco Police Court. Section 5. The city attorney shall not be required to appear in matters where the other party does not have an attorney. Cases involving the city attorney shall be given a preferential setting and hearing over other cases. PASSED by the City Council of of uary 1979. Dear Judge Bieker: This letter is to announce your re -appointment as Police Court Judge for the City of Pasco for a four-year term of office pursuant to R.C.W. . 35A.20.020, with your new term of office to begin January 8, 1979 and to run to January 10, 1983. The appointment is subject to your acceptance of the terms of Resolution No. 1229 adopted by the City Council on January 2, 1979, and your acceptance of the following additional terms which are integral to the future conduct of your office: 1. MEETINGS .OF THE COURT: The Police Court shall continue to meet Monday afternoons and Wednesday nights; provided, however, the City Council, on the City Manager's recommendation, may modify the dates and times when the Court shall meet. 2. COURT PROCEDURE IN RE CITY ATTORNEY: (a) In cases involving the City Attorney's presence , the Court shall make a good faith attempt to give precedence to the cases involving the City Attorney, and these cases shall,:pneabe heard first. (b) Preferably, case settings involving the City Attorney shall be in blocks of time so as to make the most effective use of the City Attorney's time and, preferably, case settings involving the City Attorney shall be set for Monday afternoon Court. 3. COURT PROCEDURE IN RE POLICE OFFICERS: Whenever possible, Court cases involving the presence of Police Officers from the Pasco Police Department, should be conducted during regular working hours so as to avoid unnecessary overtime in the Police Department. j{ I Judge Art Bieker - 2 - 4. COURT PROCEDURE IN RE CITY MANAGER: f (a) Whenever you, as Judge, because of illness or other sufficient reason, cannot be on the bench, then you are to advise this office in advance of Court as to who is to preside in your absence. Your signing and returning one copy of this letter of re -appointment will signify your acceptance of the terms of Resolution No. 1229 and your acceptance of the additional terms and conditions of office as spelled out in this letter.
