WHEREAS the City of Pasco currently operates and maintains
its water system without the boundaries of the City of Pasco in
what is commonly referred to as the Riverview area and West Pasco
under a non-exclusive franchise agreement granted to it by Franklin
County, and
WHEREAS the City of Pasco desires to eventually annex this
territory west of the City of Pasco to the City of Pasco, and
WHEREAS it would be and is in the best interest of the City
of Pasco to encourage annexation of the above mentioned area by
requiring that any extentions of City of Pasco water system services
to newly developed areas without the City of Pasco be conditioned
on either annexation to the City of Pasco of the territory to be
served or upon agreement to annex when legally possible to do so;
NOW, THEREFORE,
BE IT RESOLVED BY THE COUNCIL OF THE CITY OF PASCO:
That any extentions of the City of Pasco water system services
to areas without the City of Pasco be conditioned upon annexation
of the territory desiring to be so served or by execution of an
agreement to annex by the owner of the property requesting the services,
said agreement to be duly recorded and to be a covenant running with
the land, when annexation at the time of the request is legally
impossible.
