A RESOLUTION AUTHORIZING LEGAL ACTIONS BY THE CONSTRUCTION
IMPACT GROUP.
WHEREAS., the Construction Impact Group was formed by
an action of local taxing districts in 1976 for the purpose of
documenting and negotiating construction impact payments, and
WHEREAS, subsequent actions by the governing bodies of
the participating taxing districts have authorized continuation of
negotiations, and
WHEREAS, no specific authorization was given to authorize
the Construction Impact Group to initiate litigation which may be
necessary to clarify legal issues related to the assigned responsibility
of the Construction Impact Group, and
WHEREAS, it is the desire of the participating taxing districts
that the Construction Impact Group have clear authority to take legal
actions as may be needed to facilitate a fair and equitable settlement
of the claim or otherwise carry out the responsibility assigned to the
Construction Impact Group; NOW, THEREFORE,
BE IT RESOLVED BY THE COUNCIL OF THE CITY OF PASCO:
That the Construction Impact Group be and the same is hereby
authorized to take such legal action as may be determined necessary
to carry out the purpose of the construction group, and
That anticipated expense of any such legal actions shall not
exceed the maximum authorized level of expenditure under the management
consulting services agreement except as may hereafter be amended by
action of the participating jurisdictions.
