A RESOLUTION OF THE CITY OF PASCO AUTHORIZING THE MAYOR
TO SIGN THE JOINT APPOINTMENT ARTICLE FOR THE BOARD OF
APPEALS
WHEREAS , the Cities of Pasco, Kennewick and Richland and Benton and
Franklin Counties have heretofore established a Board of Appeals for the purpose
of providing uniformity of interpretation of the provisions of the Uniform Building
Code, and
WHEREAS , the City of Pasco, by the adoption of Section 3 of Ordinance
No. 1644 established the Board of Appeals for this purpose, and
W H E R E A S , it is now necessary to make re -appointments to the original
Board appointed in 1974, now, therefore,
THE CITY COUNCIL OF THE CITY OF PASCO DOES RESOLVE AS FOLLOWS:
Section 1. The Mayor of Pasco is hereby authorized and directed to sign
the joint appointment article re -appointing the existing members of the Board of
Appeals, which is attached hereto and, by this reference, incorporated herein.
Section 2. This Resolution shall be in full force and effect after its passage
as required by law.

SUBJECT: Board of Appeals -- Joint Appointment Article
As a follow-up of my memorandum of December 6th, I am transmitting a
copy of a proposed new Joint Appointment Article for the Bi -county Board
of Appeals. (This is a review copy only; the original should ultimately
be signed by all participants.) It is my understanding from Jim McCurry,
current Chairman of the Inspector's Committee, that all seven members of
the Appeals Board have indicated a willingness to continue such service.
In effect, this new document, when executed by the five participating
jurisdictions, would reappoint Mr. Holmes and Mr Sathe>:', whose terms ex-
pired in 1975, and would similarly reappoint Mr. Uhlman and McCue, whose
terms will expire'at the end of this month. The remaining Board members,
Messrs. Alford, Giles, and Hirst, are simply to be reaffirmed in their
present terms of Office by this document. You may note that, contrary
to my earlier memorandum, the terms specified in the proposed Appointment
Article span a period of five years rather than three. This, I now under-
stand, was the intent of some if not all of the participating jurisdictions
in 1974.
Individual jurisdictions may find it desirable or appropriate to adopt separate
appointment resolutions by commissions and councils. If this is your situation,
I would suggest that action be taken as soon as possible, inasmuch as the pro-
posed effective date of the attached Article is January 1, 1977. Wi ile I urder-
stand'that it would not be inconsistant from a legal standpoint for you to sign
the original of this document after that date, it would be desirable to have
the instrument fully executed no later than the first or second week in January.

JOINT APPOINTMENT ARTICLE
- BOARD OF APPEALS -
As provided for in adopted ordinances in the Cities of Pasco, Kennewick and
Richland and the Counties of Franklin and Benton, we, the undersigned
Mayors and Chairmen of the Boards of County Commissioners, hereby jointly
deem it necessary to fill vacancies in the Board of Appeals.
The membership of the Board of Appeals consists of a representative of
Franklin County, a representative of Benton County, a civil engineer, an
architect, a general contractor, a specialty contractor and a fire
specialist.
The term of membership on the Board of Appeals is five years for each
position, subject to reappointment, except as hereinafter provided: that
the term of membership of the architect shall expire December 31, 1981;,
that the term of membership of the civil engineer shall, expire December 31,
1981; that the term of membership of the general contractor shall expire
December 31, 1977; that the term of membership of the specialty contractor
shall expire December 31, 1978; that the term of membership of the fire
specialist shall expire December 31, 1979; that the term of membership
of the Benton County representative shall expire December 31, 1980; and
that the term of membership of the Franklin County representative shall
expire December 31, 1980; and thereafter, each term of membership shall
span five years.
The following seven individuals are hereby appointed to membership on the
Board of Appeals effective January 1, 1977.

The Board of Appeals is charged with determining the suitability of al-
ternate materials and methods of construction and with providing reasonable
interpretations of the provisions of the Uniform Code adopted by the above
noted ordinances.

Joint Appointment Article
Board of Appeals
As provided in the referenced ordinances, the Building Official of each
appointing agency shall be an ex -officio member of the Board and shall
serve as Secretary of the Board on a rotating basis. The Board shall
adopt reasonable rules and regulations for conducting its investigations
and shall render all decisions and findings in writing to all the Building
Officials with'a duplicate copy to the appellant and may recommend to the
City Councils and/or Boards of County Commissioners such new legislation
as is deemed appropriate.
