A RESOLUTION AUTHORIZING THE EXECUTION OF WAIVER OF 412 W. Clark
PROVISIONS OF RESTRICTIVE COVENANTS Pascoe WA. 99301
WHEREAS, the City of Pasco was the once record owner of Block
152; Lots 1 through 24 inclusive, Block 153 and Block 154, all in
Pasco Land Company's First Addition to Pasco, Franklin County,
Washington; and
WHEREAS, there exists of record certain Restrictive Covenants
covering the aforesaid property, restricting the use of said property
to one detached single-family dwelling of a certain size and one
private garage per residential lot, said restrictions appearing of
record at page 541 of Deeds, records of Franklin County, Washington,
having been filed for record in October, 1949; and
WHEREAS, the City of Pasco has been engaged in an Urban Renewal
Program that involves, in part, the aforesaid land and the
industrial development thereof; and
WHEREAS, it is the judgment of the City Council of the City of
Pasco that it is in the best interests of the City to waive the
provisions of the aforesaid Restrictive Covenants; now, therefore, it
is hereby
RESOLVED by the City Council of the City of Pasco as follows:
Section 1. The Mayor is hereby authorized to execute and
record the necessary instrument or instruments to waive the provisions
of the aforesaid Restrictive Covenants to enable the land to be sold
for commercial and industrial use.
Section 2. This Resolution shall be of full force and effect
after its passage as required by law.

HAIVER AND RELEASE OF RESTRICTIVE COVENANTS
JAN TIDRICK, the duly elected Mayor of the City of Pasco,
a municipal corporation of the State of Washington, being
authorized by Resolution No. 1054 of the City Council
of the City of Pasco, hereby waives and releases, on behalf of
and for the said City of Pasco, all of those certain restrictive
covenants restricting the use of the following described property
to one detached single family dwelling of a certain size and
one private garage per residential lot on all of Block 152; Lots 1
through 24 inclusive Block 153; and all of Block 154, all in Pasco
Land Cor_Zpany's First Addition to Pasco, Franklin County, Washington,
said restrictions appearing of record at page 541 of'Deeds, records
of Franklin County, Washington.
