HomeMy WebLinkAbout1022 Resolutiony,. RESOLUTION NO. 1022 A RESOLUTION OF THE CITY OF PASCO AUTHORIZING THE CITY TO EMPLOY THE SERVICES OF COMMUNITY DEVELOPMENT SERVICES, INC. WHEREAS, the City of Pasco must meet certain requirements in order to prepare the 1976-77 Community Development Block Grant Application, and WHEREAS, the City staff has recommended employing the services of a qualified consultant in the preparation of said Application, and WHEREAS, the City Council met with Robert C. Jacobsen of Community Development Services, Inc. at the Workshop meeting February 10, 1976, and Mr. Jacobsen explained the services his firm would be able to provide the City with respect to the Community Development Block Grant Application, now, therefore, THE CITY COUNCIL OF THE CITY OF PASCO DOES RESOLVE AS FOLLOWS: Section 1. The City hereby authorizes and directs Mayor Jan Tidrick to enter into a contract on behalf of the City with Community Development Services, Inc. for assistance in preparation of Pasco's 1976-1977 Community Development Block Grant Application. Section 2. The services to be performed by Community Development Services, Inc. shall include, but not be limited to, those items discussed in the letter from Robert C. Jacobsen to Mr. George Smith dated February 2, 1976, a copy of which is attached hereto and by reference incorporated herein. Section 3. The funds to be expended by the City for such services shall not exceed $4,500.00 Section 4. This Resolution shall be in full force and effect after passage as required by law. Roach, City Attorney CONTRACT BETWEEN THE CITY OF PASCO AND COMMUNITY DEVELOPMENT SERVICES, INC. This contract entered into this 17th day of February, 1976 by and between the City of Pasco (hereinafter referred to as the City) and Community Development Services,.Inc, (hereinafter referred to as the Contractor) witnesseth: 7 t Whereas, the City is desirous of submitting an application to the Federal Department of Housing and Community Development (hereinafter referred to.as HUD) for a 1976 Block Grant pursuant to the Housing and Community Development Act of 1974;.and Whereas, the City requires the services of a qualified consultant to assist the personnel of the City in the preparation of said application; and Whereas, a professional consulting firm with skills and experience in'n the—development and preparation of said application is desirable'° for assisting the City; and Whereas, the City Manager has investigated the qualifications of , ti—Fe Contractor and has determined its qualifications and exper- ience in similar work within the Tri -Cities area and has found its proposal for services to be responsible to the needs of the City and has recommended retaining said Contractor to be the City's 1976 HUD Block Grant Consultant, NOW THEREFORE, for and in consideration of the mutual promises and agreements hereinafter contained, the parties hereto agree as follows: ` Section I: Scope of Service The work undertaken shall be carried out essentially as indicated in Contractor's letter of proposal dated February 2, 1976, a copy of which is attached hereto as Attachment A and is hereby incorporated into this contract. The work shall proceed expe- ditiously in the light of the requirements of the Application and according to the Schedules set forth hereunder as Attach- ment B. Such schedule may be modified by mutual agreement with- out formal written amendment of this contract. -2- A. The Contractor shall be responsible for the preparation of the Housing and Community Development Block Grant for 19.76 (hereinafter referred to as the Application) which will sup- port the City's needs as presented to the Contractor by - City staff and the expressions of citizens of Pasco as determined through citizen participation activities pur- suant to City's Community Development Program. B. The.Contractor shall be responsible for preparation of the Housing Assistance Plan which will be in conformance with the requirements set forth by HUD. C. The Contractor shall assist the City in the preparation of the current year Performance Report for submission to HUD on or about February 28, 1976. Such work shall include (1) recommendations to City for the means to meet the per- formance criteria, (2) drafting the report for submission to HUD, and (3) representing the City in seeking HUD acceptance ,.<r of the report. D. Under .the supervision of the City Manager, the Contractor shall assist the City in the organization of a continuing program for citizen participation in planning for community development and in obtaining the input and support of Pasco i citizens in the 1976 Block Grant Application. Section II: Services of City In order to expedite the work of the Contractor, City agrees-, to provide the services of City personnel for: r A. Making field inspections of housing conditions required for t the Housing Assistance Plan and assisting in the organization } of citizen participation activities, pursuant to subsection I -D above. It is expressly understood and agreed that City personnel assigned to provide this assistance will work under the direct supervision of Contractor's personnel. In all not less than eighty (80) man/hours shall be so provided. Personnel assignments and scheduling shat.]. be determined by mutual agreement between the City Manager and the man- agement of the Contractor. B. Giving notice of public meetings and public hearings as f necessary in order to meet the I -IUD and City requirements } for citizen participation and to provide places and facil ities for the conduct of such meetings at such times as indicated by a schedule of meetings submitted to the City a.'✓r. by. the Contractor. -3, C. Record the minutes of all such meetings and to prepare and file such appropriate documentation of meeting notices and minutes as may be required in order to support the Applica- tion or to meet other HUD requirements, D. Supply to Contractor such maps, data, reports, and other documents from the records of City as may be necessary to Contractor. E. Provide such other reasonable aid as may be determined to be in support of the purposes of this Contract, but not specifically required of Contractor by Section I hereinabove. Section III: Administration The Contractor shall provide the City with the services of pro- f fessional consultants with skills and experience in the design and conceptualization of Community Development and Housing Assistance Plans. The Contractor shall report regularly to the City Manager to assure that the City is kept informed of the progress of the work IP and status of the Application. The Contractor is hereby author- ized to represent the City in dealing with HUD with respect to the Application and in all matters directly related thereto. In consideration of the absolute deadline for submission of the Application, in the event that disagreement or controversy may arise between the City and Contractor, the purposes of this con- tract shall not be frustrated. Therefore it is hereby agreed that every reasonable effort will be given toward the completion, and submission of the Application on or before March 29, 1976 and adjudication. of such disagreement or controversy, if unre- solved, be delayed until after March 29, 1976. Section IVV: Time of Performance The services of the Contractor are to commence on February 17, 1976 and shall be undertaken and completed in such sequence as to assure their expeditious completion in light of the purposes of this contract and the HUD deadline for submission of the Appli- cation, but in any event, allof the services required hereunder by Section I shall be completed on or before March 29, 1976, Section V: Compensation For the services performed by Contractor pursuant to this Contract as set forth in Section I, the City agrees to pay the Contractor the sum of $41500 which shall constitute full payment exclusive of any change orders pursuant to Section VI hereinbelow. =4- �A t Payment shall be made in two f y payments as follows; A progress payment of $2,000.00 on or before March 15,'1976; Final payment of $2,500.00 on or before April 15, 1976; i Payment of any balance due, pursuant to Section VI: Change Orders within thirty days following satisfactory completion of any such work. (� ` . 4 F .. r ` a� ``•, Y Section VI.: Change Orders In the event City desires any modifications or additions to the work performed including but not limited to (a) attendance at special meetings; (b) the performance of tasks imposed by HUD but not contemplated by Contractor's proposal, or (c) the pro- vision ro vision by the Contractor of services assigned to the City pur- suant to Section II hereinabove, the Contractor hereby agrees, t to provide such additional services: (1) at the rate of $240. i.: per consultant day which fee shall include all direct and in-:",' direct costs, or (2) for such lump sum amount as the parties hereto may agree in light of the specific requirements of the change order. I Section VII: Termination This Contract shall not be terminated unilaterally except for cause. Section VIII: Equal Opportunity In connection with the performance of work under this Contract, Contractor agrees as follows: A. Contractor will not discriminate against any employee or applicant for employment because of race, creed, color, age, F sex, or national origin. Contractor will take affirmative action to ensure that applicants are employed and that em- ployees are treated during employment without regard to their race, creed, color, age, sex, or national origin. Such action shall include but not be limited to, the following: employ- ment, upgrading, demotion or transfer; recruitment or recruit- ment advertising; layoff or termination; rates of pay or other forms of compensation; and selection for training, '. including apprenticeship. Contractor will, in all solicitations or advertisements for ,-; employees placed by or on behalf of Contractor, state that all qualified applicants will receive consideration for em-"" ployment without regard to"race, creed, color, age, sex or national origin, C. In the event of the Contractor's noncompliance with the non- I discrimination part of this Contract or with any of the said rules, regulations or orders, this Contract may be cancelled,., terminated or suspended in whole or in part and Contractor r E may be declared ineligible for further work in accordance with procedures authorized in Executive Order 11246 of Sep- tember 24, 1965, as amended, and such other sanctions as may.',',. ,^ be imposed and remedies invoked as provided by law. We are pleased to offer our service to assist the City of Pasco in the preparation of the 1976-,77 Community Development Block Grant application. As we have discussed with you and Mr. ,lames Ajax, our proposed responsibility would include (1) preparation of a new Housing Assistance Plan including the undertaking of a survey of housing conditions and an analysis of housing needs, (2) assistance in the organization and initiation of an ongoing program for the involvement of citizens in the Community Develop- ment planning process, and (3) general consulting and assistance in the preparation of the Community Development Program and the Annual Performance Report, We are prepared to provide our consulting services, as may be re- quired, in order to assure that the absolute deadline of March 29, 1976 for all submissions can be met. In order to accomplish that goal it is important to initiate an effective citizen participation program as soon as possible so that some report of its activities can be included in the Annual Per- formance Report which should be submitted to HUD on February 26, Therefore we strongly urge you to schedule a citywide informational meeting for some time before February 20. Enclosed is a guide form for use in publicizing that meeting. As you requested, we will attend the February 10 study session meeting of the Pasco City Council in order to discuss your programs and the services which we offer. Should the City of Pasco wish to retain our services, as your consultant we would assume the primary responsibility for organizing the work leading to the Housing Assistance Plan and to augment regular city staff as required to meet the various HUD requirements, CITY PLANNING COMMUNITY ORGANIZATION REAL ESTATE ANALYSIS SOCIAL AND ECONOMIC RESEARCH Mr. George Smith -2- February 2, 1976 Based upon the information provided by you and Mr. Ajax, we believe that we could provide all of the services you require for a fee of approximately $4,500.00. This assumes that our primary responsi- bilities would be limited to those set forth above and that ap- proximately thirty (30) man hours in the conduct of the housing conditions survey would be provided by qualified city personnel. We would design the survey forms, prepare instruction for field personnel, participate in the field work, and document the survey results.
