HomeMy WebLinkAbout0984 ResolutionRESOLUTION NO. 984 A RESOLUTION COMMITTING THE CITY OF PASCO, WASHINGTON TO THE MARINE FIRE PROTECTION PROJECT, MUTUAL AID FIREFIGHTING ASSISTANCE AGREEMENT. WHEREAS, effective control during a major Marine Fire depends on immediate activation of all possible manpower, resources, and bring this force to bear to preserve life and property at the location of the incident. This is particularly important to prevent any threatening conflagration, or other dire emergency, and WHEREAS, the City Council deems it to be in the best interest of the City of Pasco to participate in the Marine Fire Protection Project, Mutual Aid Fire- fighting Assistance Agreement on the terms and conditions set forth in the Mutual Aid Agreement (Attachment "A"), NOW, THEREFORE, the Fire Chief is authorized and directed to sign and execute on behalf of the City, the Marine Fire Protection Mutual Aid Firefighting Assistance Agreement. This Resolution will be in full force and effect after its passage as required by law. PASSED by the City Council and APPROVED AS PROVIDED BY LAW, this 15 day of April , 1975. DONALD D. Roach, City Attorney ATTACHMENT "A" MUTUAL FIREFIGHTING ASSISTANCE AGREEMENT THIS AGREEMENT, made and entered into this by and between the Municipalities, establishments and agencies listed below: Aberdeen Olympia Anacortes Pasco Bellingham Port Angeles Bremerton Port Townsend Edmonds Richland Everett Seattle Hoquiam Tacoma Kennewick Vancouver Longview WITNESSETH: WHEREAS, each of the parties hereto maintains equipment and personnel for the suppression of fires within its own jurisdiction and areas, and WHEREAS, the parties hereto desire to augment the fire protection available in their various establishments, districts, agencies and Municipalities in the event of large marine fires, and WHEREAS, with proper transportation, mutual assistance in a ship fire emergency is deemed feasible, and WHEREAS, transportation can be made available through cooperative agreement with Federal, State and local agencies, and WHEREAS, it is the policy of the above Municipalities or other districts and their governing bodies to conclude such agreements wherever practicable, and WHEREAS, it is mutually deemed sound, desirable, practicable, and beneficial for the parties to this agreement to render assistance to one another in accord and - with these terms; THEREFORE BE IT AGREED THAT: 1. Whenever it is deemed advisable by the commanding officer of a fire department belonging to a party to this agreement, or by the commanding officer of any such fire department actually present at any fire, to request firefighting assistance under the terms of this agreement, he is authorized to do so, and the commanding officer of the department receiving the request, or his authorized subordinates, shall forthwith take the following action: a. Immediately determine if firefighting equipment and/or personnel can be spared in response to the call. b. Determine what equipment and/or personnel might most effectively be dispatched. c. Determine the exact mission to be assigned in accordance with the detailed plans and procedures of operation drawn in accordance with this agreement by the technical heads of the fire department concerned. d. Forthwith dispatch such equipment and/or personnel as, in the judgment of the responsible officer receiving the call should be sent, with complete instructions as to the mission, in accordance with the terms of this agreement. 2. The rendering of assistance under the terms of this agreement shall riot be mandatory, but the party receiving the request for assistance should immediately inform the requesting agency if, for any reason, assistance cannot be rendered. It is expressly understood and agreed that parties to this agreement receiving a request for assistance will not be liable for any damages for failure to provide such assistance. 3. Agencies providing assistance under terms of this agreement may withdraw such assistance at the decision of the commanding officer of the fire department providing assistance, or his authorized representative at the scene of the fire. It is expressly understood and agreed that the requesting agency will defend and hold harmless the parties providing assistance from any action arising from such withdrawal, in accordance with provision of paragraph five. 4. Subject to provisions of paragraph six, each party to this agreement waives all claims against the other party as to matters arising between them for any loss, damage, personal injury or death, to property, officers or employees of parties to this agreement arising from performance under this agreement. S. A requesting party under this agreement shall indemnify and hold harmless parties rendering assistance, when so requested, from any and all loss, claims, actions or damages suffered by any person or persons not a party to this agree- ment, or damage inflicted upon property of a person or persons not a party to this agreement by reason of, or resulting from, the performance under this agreement; and in the event any suit or action is brought against a party rendering assistance, when so requested under this agreement by reason thereof, the requesting party shall, upon notice to it of the commencement thereof, defend the same at its sole cost and expense, and if final judgment be adverse to the party or parties rendering assistance, or the parties rendering assistance and the requesting party, the requesting party shall satisfy the same: 5. All services performed under this agreement shall be rendered without reimburse - meet of either party, except that: a. Firefighting materials and equipment which are damaged or expended during the course of fighting the fire shall be replaced or repaired by the party requesting the assistance, and that such repair or replacement will take place within 30 days. b. Marine firefighting teams, or members of marine firefighting teams, which have been trained under the Marine Fire Protection Project sponsored by the Federal Maritime Administration, shall be reimbursed for their services at the rates established in the schedule attached as part of this agreement. This reimbursement is to be paid for in full by the ship line whose vessel required firefighting assistance, and is not the responsibility of the Municipalities, which are parties to this agreement. However, it is under- stood and part of this agreement,,that commanding officers of fire departments must obtain the agreement of the ship's Master or agent to pay for such assistance, before calling for marine firefighting teams, or members of such teams acting in the capacity of advisors. c. The requesting agency shall assume responsibility for expenses of providing lubrication oil, motor fuel, and welfare items for firefighters to the extent of supplies available at the time of the request, which are incurred by the agency providing assistance in connection with the rendering of emergency assistance. Provided further, that all parties shall exercise due diligence in returning lost equipment to the rightful owner. 7. The commanding officer of the fire department requesting assistance shall assume full charge of the operations; but, if he specifically requests a senior officer of a fire department furnishing assistance to assume command, he shall not, by relinquishing command, be relieved of his responsibility for the operation, provided that the equipment and personnel of the agency rendering assistance, shall be under the immediate supervision of, and shall be the immediate re- sponsibility of the senior officer responding, or the commanding officer of the department rendering assistance. 8. The chief fire officers and personnel of the fire departments of the parties to this agreement are invited and encouraged on a reciprocal basis to frequently visit each other's activities for guided familiarization tours consistent with local security requirements and, as feasible, to jointly conduct pre -fire planning inspections and drills. 9. The commanding officers of the fire departments of the parties to this agreement are authorized to meet and draft any detailed plans and procedures of operation necessary to effectively implement this agreement. Such plans and procedures of operations shall become effective upon ratification by the signatory parties. 10. This agreement shall become effective upon the date hereof and shall remain in full force and effect until cancelled by mutual agreement of the parties _ hereto or by written notice by one party to the other party, giving ten (10) days notice of said cancellation, IN WITNESS WHEREOF, the parties hereto have executed this agreement at , Washington, on the day and year first above written. SCHEDULE OF PAYMENT FOR MARINE FIRE PROTECTION PROJECT/EQUIPMENT AND FIREFIGHTING TEAMS RESPONDING TO ALARMS OUTSIDE THE CITY OF SEATTLE EQUIPMENT: l.. Equipment which is damaged or expended during the course of firefighting opera- tions shall be repaired or replaced by the agency requesting assistance. Charges for repair or replacement shall be equal to the current prices in effect from commercial sources which repair or supply such equipment. Payment shall be made as described in this agreement. PERSONNEL: 1. Compensation of personnel shall be made at the following rates: Each Firefighter - $25.00 per hour Each Lieutenant - $28.75 per hour Each Captain - $33.06 per hour Each Battalion Chief - $38.01 per hour Each Deputy Chief - $43.71 per hour Provided, however, if assistance is requested in connection with a fire within the City of Seattle, Fire Assistance Team members shall be paid at rates of compensation provided in the Seattle Salary Ordinance. 2. Compensation shall begin when the Fire Assistance Team member leaves the Seattle staging area. Compensation shall be paid for each hour the member is traveling to, working at, and returning from the scene of the emergency, except that the compensation for returning from the emergency shall be paid for a maximum of three hours travel time. 3. Compensation shall be received for a minimum of four hours. False and needless alarms shall receive the same compensation as firefighting operations. 4. Seattle Fire Department personnel shall work a maximum of twelve consecutive hours, but may be relieved after a shorter period of time at the sole discretion of the Senior Seattle Fire Officer present at the fire.
