A RESOLUTION PETITIONING THE SECRETARY
OF THE DEPARTMENT OF HOUSING AND URBAN
DEVELOPMENT TO WAIVE THE REQUIREMENT
FOR A BID BOND (HUD -42 38-E) AND A PERFORM-
ANCE BOND (HUD -4238-G) FOR THE CONSTRUC-
TION OF THE EAST PASCO NEIGHBORHOOD FACILITY,
H.U.D. PROJECT NO. NFP -WA -10-19-1000, AND
TO FURNISH BOND ASSURANCE TO THE CITY OF
PASCO.
WHEREAS, The Department of Housing and Urban Development Grant Award,
Project No. N.F.P.-WA-10-19-1000, is for the remodel and construction of a much
needed Neighborhood Facility in the City of Pasco; and
WHEREAS, It is the desire of the City of Pasco that the East Pasco Neighbor-
hood Facility be completed as proposed, thereby providing a facility that would
meet the objectives established for that facility; and
WHEREAS, The City of Pasco recently advertised the Project for bid through-
out the Northwest and received only one bid which was far in excess of available
funds; and
WHEREAS, The City Council subsequently rejected that bid and requested
a search be made for additional funds and that the Bid Bond requirement and the
Performance Bond requirement be eliminated; and
WHEREAS, It is the opinion of the East Pasco Neighborhood Facility Board
of Directors and the City of Pasco that the waiver of the requirement for a Bid Bond
and a Performance Bond will produce more competitive participation by responsive
bidders thereby making the completion of this project more feasible within the Grant
Award; NOW, THEREFORE
THE CITY COUNCIL OF THE CITY OF PASCO DO RESOLVE AS FOLLOWS:
Section 1. That the grant award of $343,935.00 is insufficient for the complete
construction of this facility as proposed due to substantially inflated building
costs.
Section 2. That the waiver of the Bid Bond and the Performance Bond is requested
in an attempt to allow more contractors to bid on the construction of this project.
Section 3. That the Pasco City Council hereby petitions the Secretary of the Depart-
ment of Housing and Urban Development to waive the requirement for a Bid Bond and
Resolution No. -2- Date:
for a Performance Bond for the East Pasco Neighborhood Facility Project (No. NFP -
WA -10-19-1000) and to furnish to the City of Pasco Bond Assurance so that the City
will be in compliance with requirements of State Law when the waiver is granted.
Section 4. This resolution shall be in full force and effect after its passage as re-
quired by law.
