HomeMy WebLinkAbout0912 ResolutionRESOLUTION NO. 912 A RESOLUTION AUTHORIZING THE EXECUTION OF WAIVER OF PROVISIONS OF RESTRICTIVE COVENANTS AND AGREEMENT TO DEFEND TITLE. WHEREAS, the City of Pasco is the record owner of Lots 1 to 6, inclusive, Block 152; Lots 16 to 24, inclusive, Block 153; Lots 7 to 15, inclusive, Block 153; and all of Block 154, all in Pasco Land Company's First Addition to Pasco, Franklin County, Washington; and WHEREAS, there exists of record certain Restrictive Covenants covering the aforesaid property, restricting the use of said property to one detached single-family dwelling of a certain size and one private garage per residential lot, said restrictions appearing of record at page 541 of Deeds, records of Franklin County, Washington, and having been filed for record in October, 1949; and WHEREAS, the City of Pasco is engaged in an Urban Renewal Project that involves, in_ part, the aforesaid land and the industrial development thereof, and WHEREAS, it is the judgment of the City Council of the City of Pasco that it is in the best interests of the City of Pasco to waive the provisions of the aforesaid Restrictive Covenants; NOW, THEREFORE, IT IS HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PASCO AS FOLLOWS: Section 1. That the Mayor is hereby authorized to execute and record the necessary instrument or instruments to waive the provisions of the aforesaid Restrictive Covenants. Section 2. That the Mayor is hereby authorized to execute for prospective purchasers of said real property an agreement whereby the City .of Pasco will defend the title of prospective purchasers against the provisions of the Restrictive Covenants hereinbefore referred to. Section 3. This Resolution shall be in full force and effect after its passage as required by law. PASSED by the City Council and APPROVED as provided by law this 20 day of February P 1973. Approved as to form: City Attorne ayo r 100, Section 2.
