RESOLUTION NO. 545
WHEREAS, there is presently pending between the City of Pasco, a
municipal corporation, and the Port of Pasco, a municipal corporation, an
Agreement to Transfer the Pasco Municipal Airport from the City to the Port, and
WHEREAS, there is an opportunity to have the State Highway Department
remove or cause to be removed in conjunction with highway improvements a hill
near the airport located on land to be retained by the City, and
WHEREAS, the removal of this hill would make another approach to the
airport safer, and
WHEREAS, it is contemplated that most of such removal will occur after
the airport has been transferred to the Port, and
WHEREAS, a copy of the Agreement is attached hereto and by this reference
incorporated herein,
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PASCO DO
RESOLVE AS FOLLOWS:
Section 1. The Mayor is hereby authorized to sign and the City Clerk is
hereby authorized to attest the Excavation Agreement attached hereto and made
a part hereof by this reference.

EXHIBIT "A" TO EASEMENT
For purposes of this instrument, the Clear Zone at the southeast end of Run-
way
29R, Pasco
Airport is
the
area represented
by the figure enclosed within
the
4i four
lines AB,
BD, DC and
CA,
as shown on the
accopipanying drawing, Exhibit "B".
The transition zone for said runway is the area represented by the figure enclosed
by the three lines BD, DE and EB as shown on said drawing.
The clear zone approach surface for Runway 29R is an inclined plane located
directly over said clear zone, having a slope of 50:1 (one foot of elevation for
each fifty feet of horizontal distance), which inclined plane has an elevation of
398 feet above mean sea level at its inner and lower edge along lines AB and an
elevation of 448 feet above mean sea level at its outer and upper edge along line
DC, all as shown on said drawing Exhibit "B".
The transitional surface for Runway 29R is an inclined plane located directly
over the transition zone for said runway as above described, having a slope of 7:1
(one foot of elevation for each seven feet of horizontal distance measured at right
angles to the center line of Runway 29R, as extended) which inclined plane has an
elevation along line BD equal to the elevation above provided for the clear zone
applicable to such line, and an elevation of 448 feet above mean sea level along
line DE.
The clear zone at the southeast end of Runway 29L shall be the area represented
by the figure enclosed within the four lines FG, GI, IH and HF as shown on said
drawing. The transition zone for Runway 29L shall be the area represented by the
figure enclosed by the three lines GI, IJ and JG as shown on said drawing.
The clear zone approach surface for Runway 29L is an inclined plane located
directly over the said clear zone, having a slope of 40:1 (one foot of elevation for
each forty feet of horizontal distance) which inclined plane has an elevation of 396
feet above mean sea level at its inner and lower edge along line FG and an eleva-
tion of 446 feet above mean sea level at its outer and upper edge along line IH, all
as shown on said drawing, Exhibit "B".

The transitional surface for Runway 29L is an inclined plane: llcated directly
over the transition zone for said runway, as above described, having a slope of
7:1 (one foot of elevation for each seven feet of horizontal distance measured at
right angles to the center line of Runway 29L, as extended) which inclined planea
has an elevation along line GI equal to the elevation as above provided for the
clear zone applicable to such line, and an elevation of 446 feet above mean sea
level along line IJ.
Party of the first part agrees, as respects so much of its land as lies within
any of the above-described clear zones or transition zones, that it will limit the
height of structures or objects of natural growth to an elevation at or below that
provided for the above described clear zone approach surfaces and transitional
surfaces, providdd, that whenever any two of such surfaces overlap, the surfaces
having the lesser elevation shall be applicable; and further
Provided, that the party of the first part shall be under no obligation to
lower existing ground levals; and further
Provided, that party of the second part shall have the right and privilege to
lower the ground level, and remove earth, rock and fill material, the level of which
must be agreed upon by the parties, from so much of the above described land as liess
northeast of the DE as shown on the accompanying drawing Exhibit "B".
For purpose of this instrument, the elevation above mean sea level of the
southeast end of Runway 29R is considered to be 398 feet, and that for Runway 29L
is-oonsidered to be 396 feet.
EASEMENT
THIS AGREEMENT made and entered into this
day of July, 1963, by
and between the CITY OF PASCO, a municipal corporation, party of the first part
and the PORT OF PASCO, a municipal corporation, party of the second part,
which expression includes its assigns and successors, WITNESSETH:

WHEREAS, the party of the first part owns and has title to that real estate
and real propetty located in Franklin County, State of Washington,.described as
follows:
The northwest quarter except the southerly 110 feet of the
easterly 318.26 feet thereof, and the westerly 1207.54 feet
of the northeast quarter, all in section 19, township 9 north,
range 30 east, W.M., except the State Highway.
AND WHEREAS, the party of the second part desires a perpetual easement
granting:
a) The right of flight for the use and benefit of the public, for the
i passage of aircraft in the airspace above the surface of said land, together with the
right to cause in said airspace such noise as may be inherent in the operation of air-
craft, now known or hereafter used for navigation of or flight in the air, using said
airspace or landing at, taking off from or operating on the Pasco Municipal Airport.
b) The right to prohibit the erection of any structure or object or the
growth of any tree on said land which would constitute an obstruction within the
standards established by FAA Technical Standard Order N18, as amended with applicable
height limitations being set forth in terms of mean sea level elevations according
to Exhibits "A" and "B" attached hereto and by this reference incorporated into
and made a part of this easement.
c) The right to prohibit the use of said property in any manner which
might interfere with the landing and taking off of aircraft from said Pasco Muni-
cipal Airport or otherwise constitute an airport hazard.
d) The right of ingress and egress from said land for the purpose of
exercising the rights granted by said easement in the event said rights are breached.

NOW, THEREFORE, it is hereby agreed as follows:
lJ The party of the first part does hereby grant, assign and set over to the party
of the second part a perpetual easement on the following described real property:
