RESOLUTION NO.&,3
WHEREAS the City of Pasco is the owner of the following described real
property:
Those portions of the west half of the west half of the
southwest quarter of the southeast quarter (W 1/2 W 1/2
SW 1/4 SE 1/4) of Section Thirty (30), Township nine (9)
North, Range Thirty (30) East, W. M. lysing north of a line
drawn parallel with and distant 700 feet northerly from the
south line of the southeast quarter (SW 1/4) .of said section
thirty (30), EXCEPT those portions thereof of Lucas Str-eet,
Hopkins Street, Olive Street, Mound Street and Grace Street
which were dedicated to the public by Order of the Board of
County Commissioners of Franklin. County, Washington of
July 3, 1922, and which order was recorded July 5, 1922, as
-a,uditor.'s file,No".150692 in. Volume. 42- of,Deeds at Page 586,
records of "Franklin County, Washington„
and,
WHEREAS the absolute fee simple title was acquired in said property
by condemnation in November of 1945, and
WHEREAS the said property has never been developed as a park and is
now unimproved, and
WHEREAS- the City ,has developed a four -block park, named Memorial
Park, c,onti.guous to the said property which is adequate in size for the area,. and
.WHEREAS the City"wishe-s to`sell or leas.e,the above-described property, and
WBMEAS an action to enjoin the City of, Pasco from leasing, selling or
otherwise disposing of said property has been -commenced by John Miller, and

WHEREAS it is deemed advisable to set forth the position of the City Coun-
cil of the City of Pasco- in regard .to <said property! , NOW, THEREFORE,,
THE CITY COUNCIL.,' OF THE CITY OF PASCO DO RESOLVE AS FOLLOWS:
Section 1. That the following described real property, is not required or

needed for park purposes:

Those portions of the west half of the west half of the
southwest quarter of the southest quarter (W 1/2 W 1f2 SW 1/4
SE. 1/4) of Section Thirty (30), Township nine (9) North, Range
Thirty (30) East, W. M. lying north of a line drawn parallel
with and distant 700 feet northerly from the south line of the
: southeast quarter (SW 1/4) of said Section thirty (30),
EXCEPT those portions thereof of Lucas Street, Hopkins`
Street,, Olive Street, Mound Street and Grace Street which
were dedicated to the public by Order of the Board of County.,
`Commissioners of Franklin County, Washington of July 3,
1922, and which order was recorded July 5, 1922, as auditor's
file No. 5.0692 in Volume 4,2 of heeds at Page 586,records of
Franklin County, Washington.
Section.. '2. ` That the City of Pasco does not plan to develop .said property
as a park.
S ection 3. That the City of .Pasco desires to sell or lease said property'
in any p-ropex or legal manner exclusive of Chapter 294, Laws of 1955, or by
virtue of Chapter 294, Laws of 1955.
Section 4.. That the City Council of the City of Pasco believes it would be
to the best interests of the City of Pasco to lease or sell said. property.
Section: 5, That the City Council of the City -of Pasco believes it would be.
beneficial to the tax payers of the City of Pasco to lease or sell said property.
