A RESOLUTION REGARDING STEPS TO BE FOLLOWED IN PETITIUNING
FOR VACATION OF STREETS OR ALLEYS.
WHEREAS, The City Council of the City of Pasco is desirous
of establishing a procedure to be followed by petitioners for
the vacation of streets or alleys;
NOW, THEREFORE, BE IT RESOLVED by the City Council of the
City of Pasco that the following steps must be complied with
before any petition to vacate any street or alley will be acted
upon by the City Council:
1. A written petition must be filed with the City Clerk
signed by the owners of more than two-thirds of the private
property abutting upon the part of such street or alley$ sought
to be vacated.
2. A $75.00 deposit shall be made with the City Clerk to
cover administrative expenses. The unexpended portion of said
deposit will be refunded. (0.650)
3. A certificate of title from a reputable title company
shall be submitted which shall name all parties legally interested
in the street or alley to be vacated.
4., The petition, deposit, and certificat of title, must
be submitted to the City Clerk at least 7 days prior to
submission of petition to the City Council.
5. A check list shall be attached to the petition by the
City Clerk which shall be completed by the City Clerk and the
City Engineer showing that all of the procedural steps have
been followed and showing remarks of the City Engineer as to
the public need for the property sought to be vacated.
6. The City Clerk shall prepare a resolution to be adopted
by the City Council fixing a time for a public hearing on the
petition.
