HomeMy WebLinkAbout0142 Resolution�11 RESOLUTION / -�(-„2, t EE IT RESOLVED, by the City Council of the City of Pasco, that the City Attorney be authorized to settle the controversy with the Steel Tank and Pipe Company, of Oregon, upon the following basis: That the City waive all claims against the said company for danages by reason of the fact that the construction,of,,the 400,000 gallon water tank was not completed within the time specified in the contract, in consideration of which the Steel Tank and Pipe Company waive all claims against the City by reason of taxes paid the state of Washington on the construction of said tank, said waiver being upon the ground and for the reasons that the said tank is held to be a part of the real estate. That the City Clerk be authorized to issue a warrant to the said Steel Tank and Pipe Company, of Oregon, for the sum of Five Hundred Seventy Dollars ($570.00) heretofore deducted from its claim as damages for delay in completion of the work. That said warrant be issued and delivered to the said Steel Tank and Pipe Company, of Oregon, upon its giving of a waiver in writing of all claims against the City by said company. Passed and approved this lst day of December, 1938. Attest: W A I V E R In consideration of the City of Pasco waiving all claims against the Steel Tank and Pipe Company, of Oregon, for damages for failure to complete the work of constructing 400,000 gallon tank within the time provided in the contract, the said Steel Tank and Pipe Company, of Oregon, hereby acknowledges receipt in full of payment of all claims against the City of Pasco of whatsoever nature.
