AN ORDINANCE approving and confirming the assessments and assessment
rolls of Local Improvement District #105 created and
established by Ordinance No. 2064 for the purpose of
constructing and installing a six (6") inch and eight
(8") inch water main extension, together with appurtenances
along Sycamore Avenue to Butte Street, Butte Street to Hugo
Avenue, Hugo Avenue to Helena Street, all within the City
of Pasco, Washington, to be constructed to city standards
by furnishing all equipment, material, labor and
incidentals to accomplish a complete project, and
levying and assessing the amount thereof against the
several lots, tracts, parcels of land and other property
shown on the -roll.
WHEREAS, the assessment roll levying the special assessments
against properties located in Local Improvement District #105 in the
City of Pasco, Washington, created under Ordinance No. 2064 has been
filed with the Director of Finance and City -Clerk of the City of Pasco,
as provided by law; and
WHEREAS, notice of time and place of hearing thereof and making
objections and protests to said assessment roll was duly published at
and for the time and.in the manner provided by law, fixing the time
and place of hearing thereon for the 1,- day of October, 1979, at
the hour of 8:00 p.m. (P.S.T.), in the Council Chambers of the City
Hall at Pasco, Washington, and further notice thereof was duly mailed
by the Director of Finance and City Clerk to each property owner shown
on the assessment roll; and
WHEREAS, at the time and place fixed and designated in the
notice, the hearing was duly held and the City Council of the City of
Pasco heard all persons who wished to be heard at such hearing and
duly considered all protests made in writing and overruled the same;
NOW, THEREFORE,
THE CITY COUNCIL OF THE CITY OF PASCO DOES ORDAIN AS FOLLOWS:
Section 1. That any objections to said assessments or assessment
roll be and the same are hereby overruled and that the assessments and
assessment roll of Local Improvement District No. 105 for the cost of
improving the city standards by furnishing all equipment, material, labor
and incidentals to accomplish a completed project in the construction
and installation of a six (61') inch and eight (8") inch water main
extension, together with appurentances along Sycamore Avenue to Butte
Street, Butte Street to Hugo Avenue, Hugo Avenue to Helena Street, all
within the City of Pasco, Washington, as provided by Ordinance No. 2064,
be and the same is hereby approved and confirmed in the total amount
of Fourteen Thousand Two Hundred Four & 10/100 ($14,204.10) Dollars.
Section 2. That each of the lots, tracts, parcels of land and
other property shown upon the assessment roll of Local Improvement
District #105 is hereby determined and dedlared to be specially benefited

by said improvement referred to hereinabove in at least the amount
charged against the same and the assessment appearing against the same
is in proportion to the several assessment appearing upon said
assessment roll; and that there is hereby levied and assessed against
each lot, tract, parcel of land and other property appearing upon said
assessment roll the amount finally charged against the same thereon.
Section 3. That the assessment roll as approved and confirmed
herein be and the same shall be filed with the Treasurer of the City
of Pasco for collection and the City Treasurer of the City of Pasco is
hereby authorized and directed to publish notice as required by law
stating that the roll is in her hands for collection and payment of
any assessment thereon or any portion of the assessment can be made at
any time within thirty days from the date of the first publication of
said notice without penalty, interest or cost, and that thereafter the
summary remaining unpaid may be paid in ten annual installments with
interest thereon hereby fixed at the rate of __L/2percent per annum.
The first installment of assessments on the assessment roll shall become
due and payable during the thirty day period succeeding the date one
year after the date of first publication by the City Treasurer of
notice that the assessment roll is in his hands for collection and
annually thereafter each succeeding installment shall become due and
payable in like manner. If the whole or any portion of the assessments
remain unpaid after the thirty day period, interest upon the whole
unpaid sum shall be charged at the rate of 1_1,L2percent per annum and
each year thereafter one of the installments, together with interest
due on the whole of the unpaid balance, shall be collected. Any
installment not paid prior to the expiration of the thirty day period
during which such installment is due and payable shall thereupon become
delinquent. All delinquent installments shall be subject to a charge
for interest at 7 1 2percent per annum and for an additional charge of
6 percent penalty levied upon both the principal and interest due upon
each installment or installments. The collection of such delinquent
installments will be enforced in the manner provided by law.
