HomeMy WebLinkAbout2103 OrdinanceI.iI1r�YT�i f.:i1 �� .• CITY OF PASCO, WASHINGTON ORDINANCE NO. 2103 AN ORDINANCE creating Sidewalk Construction Fund No. 1, 1979; authorizing the issuance of interim construction fund interest-bearing warrants; and ratifying actions heretofore taken by the City Council in accordance with Resolution No. 1256 of the City Council. WHEREAS, by Resolution No. 1256 adopted June 18, 1979, the City Council required property owners on both sides of Sylvester Street from 20th Avenue West to the freeway overpass to construct sidewalk, curb and gutter each at his own expense according to the plans and specifications set forth therein and further provided that in the event the required construction was not completed by August 31, 1979, the City would perform and complete such sidewalk improvement and assess the costs therefor against the abutting property owners; and WHEREAS, by Resolution No. 1256 the City Council fixed the date for public hearing thereon at 8:00 o'clock p.m. on July 2, 1979, in the Council Chambers of City Hall, 412 West Clark Street, Pasco, Washington, and caused notice of the hearing to be published and mailed in the manner required by law, and such hearing was duly held at such time and place; and WHEREAS, on July 2, 1979, the City Council by motion deter- mined to proceed with the sidewalk improvement; and WHEREAS, the sidewalk improvement described in Resolution No. 1256 has not been constructed by the abutting property owners according to the plans and specifications set forth therein and the City Council has determined it to be in the best interests of the City that the sidewalk improvement described in Resolution No. 1256 be carried out and that a Sidewalk Construction Fund No. 1 be created in connection therewith; NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PASCO, WASHINGTON, DO ORDAIN, as follows: Section 1. The City Council of the City of Pasco, Wash- ington, hereby orders the construction of the sidewalk improvement described in Resolution No. 1256, passed by the City Council on June 18, 1979, and reconfirmed by motion of the City Council on July 2, 1979. Section 2. There is hereby created and established pursuant to RCW 35.68.040 in the office of the City Treasurer a special fund of the City to be known as the "Sidewalk Construction Fund, No. 1, 1979," which fund shall be used for the sole purpose of carrying out the sidewalk improvement authorized pursuant to Resolution No. 1256, and of paying the costs and expenses connected therewith, into which fund shall be deposited any advances as loans to such fund from any available funds of the City the amounts necessary to pay any costs of the improvement together with collections pertain- ing to assessments, and against which fund warrants shall be drawn to pay the costs of the sidewalk improvement. Whenever warrants �M • are drawn on such fund which are not paid for want of sufficient funds, they shall be so stamped and shall bear interest until called and paid at a rate to be established by the City Council by resolution. Section 3. All actions heretofore taken and authorized by the City Council in connection with the sidewalk improvement de- scribed in Resolution No. 1256 are hereby approved and confirmed. PASSED by the City Council and APPROVED by the Mayor of the City of Pasco, Washington, at a regular open public meeting thereof, this 15 day of October, 1979.
