HomeMy WebLinkAbout2056 OrdinanceORDINANCE NO. 2056 AN ORDINANCE of the City of Pasco relating to peace, safety, and morals and creating certain criminal offenses by amending Sections 9.08.020, 9.12.010, and 9.12.020, and by enacting Section 9.12.030 of the Pasco Municipal Code. THE CITY COUNCIL OF THE CITY OF PASCO DOES ORDAIN AS FOLLOWS: Section 1. That Section 9.08.020 of the Pasco Municipal Code (Ord. 1273 1, 1967) be and the same is hereby amended to read as follows: P.M.C. 9.08.020 VAGRANCY. Any person who: 1. Keeps a place knowing that lost or stolen property is concealed therein without promptly notifying the police; 2. Approaches another person in or upon any place or property open to members of the public and requests the other to contribute money or something of value for his private support; 3. Who lodges in any enclosed structure, vessel, car, or other place belonging to another without the permission of the owner or person entitled to have control of the premises; is a vagrant and is guilty of violation of this code. Section 2. That Section 9.12.010 of the Pasco Municipal Code (Prior Code , 10 - 2.04) be and the same is hereby amended to read as follows: P. M.0 . 9.12.010 PROSTITUTION . It is a violation of this code for any person to practice or solicit prostitution. 1. Prostitution includes but is not limited to the following: To engage, or to agree, or to offer to engage in sexual donduct with another person in return for a fee; or to solicit, procure, or induce another person to engage or to agree to engage in sexual conduct in return for a fee; or to offer to another person a fee to engage in sexual conduct. This sub -section shall not apply if the respective parties are married to each other. 2. Sexual conduct means: 6) Sexual intercourse in its ordinary sense which occurs upon penetration, however slight, or contact between persons involving the sex orgrans of one and the mouth or anus of another done for the sexual gratification of either person. b) The touching or handling of the genitals of another person for the sexual gra tifica tion of either person. Section 3. That Section 9.12.020 of the Pasco Municipal Code (Prior Code 9 10 - 2.08) be and the same is hereby amended to read as follows: P.M.C. 9.12.02 0 PROSTITUTION LOITERING. It is a violation of this code for any person to remain in any public place and intentionally solicit, entice, induce, or procure another person to commit an act of prostitution as provided in this chapter.. 1. "Public place" shall include any area generally visible to public view including streets, sidewalks, bridges, alleys, plazas, parks, driveways, parking lots, automobiles (whethermoving or not), and builidings apen to the general public including those which serve food or drink, or provide entertainment, and the doorways and entrances to buildings or dwellings and the grounds enclosing them. 2. Among the circumstances which may be considered in determining whether the actor intends the conduct prohibited by this section shall include: a) Attempting to stop or attract the attention of passersby including the occupants of vehicles by repeated beckoning to or other gestures or expressive conduct. b) Being located in an area or place where it is commonly known that the conduct prohibited by this chapter occurs. c) Being a known prostiztute, panderer, or solicitor, of prostitutes. d) The believability of any explanation offerred by the person at the time of the incident regarding their presence and conduct. 3. A known prostitute, panderer, or solicitor of prostitutes shall include any person who has been convicted of violating this chapter or any like or similar law or any law dealing with prostitution ,TeWd or immoral conduct associated with the same of any other. jurisdiction. Section 3. That Section 9.08.030 be and the same is hereby enacted to read as follows: P.M.C. 9.12.030 PERSONS. In the prosecution of any offense under this chapter it shall not matter what the sex of the persons may be or that the persons are of the same sex. A person acting as an agent for the Police engaged in efforts to enforce this chapter is not guilty of violating this chapter provided his or her conduct has been authorized.
