HomeMy WebLinkAbout2015 Ordinance' i r ORDINANCE NO. 2015 AN ORDINANCE relating to solid waste disposal by amending Pasco Municipal Code 6.04.300 and 6.04.310. THE CITY COUNCIL OF THE CITY OF PASCO DOES ORDAIN AS FOLLOWS: Section 1. That Section 6.04.300 of the Pasco Municipal Code (Ordinance No. 1881, Section 5) be and the same is hereby amended to read as follows: P.M.C. 6.04.300 SCHEDULE OF SERVICE CHARGES. The person responsible for water or sewer service to a place receiving solid waste disposal service is responsible for all charges and costs resulting from such services. The tenant in possession is also responsible for all charges and costs resulting from such services if the bill is sent to that person. In the event no water and sewer service is provided a location receiving solid waste disposal service, the tenant in possession, if billed, and the person making application for the service are responsible for all charges and costs resulting from such services. In all events, the property and the property owner are responsible for all charges and costs and the same may become a lien upon the property in the manner provided by law. The charges for solid waste disposal services are as set forth below and include the charges to delinquent accounts as provided in P.M.C. 6.04.310. A. CAN RATES: (1) For each occupied residence or separate unit thereof, the charge shall be Four & 00/100 ($4.00) Dollars per month for weekly full service garbage collection. Full service garbage collection shall include: (a) The collection of an unlimited number of cans or containers (including plastic bags) which weigh not more than eighty (80) pounds, and otherwise meet the requirements of P.M.C. 6.04.100. (b) The collection of an unlimited number of bundles meeting the requirements of P.M.C. 6.04.140. (c) Additional Service. Items too large for regular collection as described in (a) and (b) shall be limited to 250 pounds per item from the premises. A residence customer as qualified below may apply for and receive a different rate and service. The rate shall be One and 75/100 ($1.75) Dollars per month for the weekly removal of one (1) can or container per week. To qualify the customer must certify on an appropriate form at the city hall and otherwise provide satisfactory proof of the following: -2- (a) That he is at least sixty-five (65) years.of age or is totally and permanently disabled; (b) Has a minimum annual income from all sources of less than Four Thousand & 00/100 ($4,000.00) Dollars if single, and less than Six Thousand & 00/100 ($6,000.00) Dollars (combined income) if married; (c) That he is the single occupant or head of the household; (d) That he is directly responsible for payment of the garbage collection bill or will be granted proper credit resultant from this provision; and (e) That he has resided at such residence for a period of not less than ninety (90) consecutive days; and (f) That one can per week is at least or more than adequate to meet the normal needs of the residence or separate unit thereof. (2) For each occupied unit or units of a multi -family residence the charge shall be Two & 55/100 ($2.55) Dollars per month for the weekly collection of two (2) cans per unit. (3) For each commercial establishment the charge shall be Three & 70/100 ($3.70) Dollars per month for the weekly collection for two (2) cans. (4) For each public food.establishment the charge shall be Fourteen & 25/100 ($14.25) Dollars per month for the daily collection of one (1) can. (5) The charge of 50/100 ($.50) Dollar per can per week shall be added for the collection of a can of solid waste over and above the level of service required or permitted by this ordinance. B. CONTAINER RATES: In the event a multi -family residence, a commercial establishment, or a public food establishment elects to utilize a container, rather than a can, for disposal of solid waste, the charge for collection of solid waste from containers shall be: (1).Three & 35/100 ($3.35) Dollars per collection for a one (1.) cubic yard container. (2) Four & 15/100 ($4.15) Dollars per collection for a one and one-half (1 and 1/2) cubic yard container. (3) Five & 15/100 ($5.15) Dollars per collection for a two (2) cubic yard container. (4) Six & 25/100 ($6.25) Dollars per collection for a three (3) cubic yard container. (5) Eight & 00/100 ($8.00) Dollars per collection for a four (4) cubic yard container. d -3- (6) Ten & 25/100 ($10.25) Dollars per collection for a six (6) cubic yard container. (7) Twelve & 65/100 ($12.65) Dollars per collection for an eight (8) cubic yard container. C. ROLL -OFF CONTAINER RATES: For collection of solid waste contained in a roll -off container, the charge shall be One & 10/100 ($1.10) Dollars per cubic yard, plus reasonable disposal -site fees. For roll -off containers exceeding two (2) cubic yards in capacity, there shall be a minimum of two (2) collections per month or in the alternative, a rate of Two & 20/100 ($2.20) Dollars per cubic yard charge. D. MISCELLANEOUS RATES: Miscellaneous rates for service not included in the base rates of paragraphs A, B, and C above shall be: (1) Eighteen and 75/100 ($18.75) Dollars per hour for a truck and one (1) man crew for each special collection. (2) Twenty -Five and 00/100 ($25.00) Dollars per hour for a truck and two (2) man crew for each special collection. (3) Two & 50/100 ($2.50) Dollars per compacted cubic yard, plus disposal fees. (4) Five & 00/100 ($5.00) Dollars per compacted cubic yard if compactor belongs to Contractor, plus disposal fees. (5) For roll -off containers for special cleanups, Ten and 00/100 ($10.00) Dollars per day over two (2) days, Five & 00/100 ($5.00) Dollars delivery charge, One and 10/100 ($1.10) Dollars per cubic yard, plus disposal site fees. (6) Four and 50/100 ($4.50) Dollars per trip for a return trip when customer failed to place cans at collection point for regular collection. (7) 25/100 ($.25) Dollar per can for collection of solid waste over twenty-five (25) feet, but less than fifty (50) feet from the collection point; 35/100 ($.35) Dollar per can for collection of solid waste over fifty (50) feet, but less than seventy-five (75) feet from the collection point; and 50/100 ($.50) Dollar per can for collection of solid waste over seventy-five (75) feet from the collection point. (8) For special pickups on the regular collection route after notification by the customer to the Contractor, a fee of no more than Four and 00/100 ($4.00) Dollars for each item collected shall be charged; for special pickups not on a regular collection route a return trip fee of Four and 50/100 ($4.50) Dollars may be charged in addition hereto. -4- (9) On all services other than those outlined in paragraph lA (Can Rates) above, a billing charge of 25/100 ($.25) Dollars may be added to each bill. E. MINIMUM CHARGES: In the event the Contractor determines that certain minimum container service levels are required, the minimum level shall be two (2) pickups per week for one (1), one and one-half (1 and 1/2), and two (2) cubic yard containers and Thirty -Six & 00/100 ($36.00) Dollars minimum charge for a three (3) cubic yard container. F. SERVICE TO CITY: The Contractor shall make collection at all City Parks, Fire Stations, the City Hall, the Library, Municipal Garage, water shops and other city -owned or leased public buildings at least once each week and it shall be reimbursed for such service at the standard rates hereinabove set forth. Section 2. That Section 6.04.310 of the Pasco Municipal Code (Ordinance No. 1881, Section 6) be and the same is hereby amended to read as follows: P.M.C. 6.04.310 BILLING PROCEDURE. A. The charges for solid waste collection and disposal shall be compulsory and universal and shall be billed by either the finance department or the city's contractor. Such charges may be included with the billing for water and sewer utility service if the city does the billing. The charges shall be paid to the city or its contractor depending upon who does the billing by the person responsible for the water and sewer utility billings. In the event the solid waste disposal customer does not receive city water or. sewer service, the owner of the property to be served is responsible for the charges. Charges shall be paid not later than the date payment is due after billing and after services received, and, if not so paid, the charges shall be deemed delinquent. B. In the event of delinquence, charges for solid waste collection and disposal shall become a lien against the property. If an account is delinquent for a month or more, the customer may be charged after written notice thereof interest at the rate of twelve percent (120) per year from the date of delinquency or fifty cents ($.50), whichever is greater. The customer is also responsible for any costs of collection, including attorney's fees. Billings for commercial accounts shall be mailed to the tenant in possession unless special.instructions to the contrary are received from the owner. Billings for a residence or a multi -family residence may be charged to the tenant in possession of the premises provided prior written authorization has been given by'the property owner and any required deposit has been made. The person receiving the billing is also responsible for the charges. -5- C. If the city's contractor does the billing, he shall apply in writing for the right to refuse collection at the delinquent account's location until the delinquency is paid. The application shall contain a verified statement of the name and location of the delinquent account, the amount of delinquency, and the procedure utilized to attempt collection of the delinquency. The city,.after reviewing the merits of the application and making a determination that the contractor has made a good -faith effort to collect and that the account remains a month or more delinquent, shall grant to the contractor in writing the right to refuse to collect solid waste until the delinquence is paid. The contractor may also collect any amounts owed in the manner provided by law, including the enforcement of a lien on the property of the account. D. Failure to pay charges for solid waste disposal services shall constitute a violation of this chapter and shall be punishable as such. Section 3. This ordinance shall be in full force and effect on January 1, 1979. of PASSED by the City Council of the City of Pasco this December , 197 8 .
