ORDINANCE NO. 2003
AN ORDINANCE approving and confirming the
assessments and assessment roll of Local Improve-
ment District No. .84 created and established by
Ordinance No. 1694 for the purpose of improving
certain properties within the City by improving
the central business district of the City by
improving, constructing and installing illumination,
signalization and landscaping along Lewis Street
between 2nd Avenue and 7th Avenue and along 4th
Avenue between Columbia Street and Bonneville
Street, by acquiring, constructing and improving
three public parking Lots, a mini -park and a
pedestrian corridor within the improvement area,
and also the replacement of the overhead utility
wires and facilities with underground wires and
facilities from 2nd Avenue to 5th Avenue between
Clark Street and Lewis Street and from 2nd Avenue
to 4th Avenue between Lewis Street and Columbia
Street; and levying and assessing the amount
thereof against the several lots, tracts, parcels
of land and other property shown on the roll.
WHEREAS, the assessment roll levying the special assessments
against properties located in Local Improvement District No. 84 in
the City of Pasco, Washington (the "City"), created under Ordinance
No. 1.694 has been filed with the Director of Finance and ex -officio
City Clerk of the City as provided by law; `and
WHEREAS, notice of time and place of hearing thereof and
making objections and protests to such assessment roll was duly
published at and for the time and in the manner provided by law,
fixing the time and place of hearing thereon for the 20th day of
November, 1978, at the hour of 8:00 p.m. (PST), in the Council
Chambers of the City Hall, and further notice thereof was duly
mailed by the Director of Finance and ex -officio City Clerk to each
property owner shown on the assessment roll; and
WHEREAS, at the time and place fixed and designated in the
notice, the hearing was duly held and the City Council of the City
heard all persons who wished to be heard at such hearing and duly
considered all protests made in writing and overruled the same; NOW,
THEREFORE, .
THE CITY COUNCIL OF THE CITY OF PASCO, WASHINGTON, DO
ORDAIN, as follows:
Section 1. Any objections to the assessments or
assessment roll of Local Improvement District No. 84 be and the
same are hereby overruled and the assessments and assessment roll
of Local Improvement District No. 84 for the cost of improving
certain properties within the City by improving the central
business district of the City by improving, constructing and
installing illumination, signalization and landscaping along Lewis
Street between 2nd Avenue and 7th Avenue and along 4th Avenue
between Columbia Street and Bonneville Street, by acquiring,
constructing and improving three public parking lots, a mini -park
and a pedestrian corridor within the improvement area, and also
the replacement of the overhead utility wires and facilities with
underground wires and facilities from 2nd Avenue to 5th Avenue
between Clark Street and Lewis Street and from 2nd Avenue to 4th
Avenue between Lewis Street and Columbia Street, as provided by
ordinance No. 1694, be and the same is hereby approved and confirmed
in the total amount of $ 397,885.57
Section 2. Each of the lots, tracts, parcels of land
and other property shown upon the assessment roll of Local Improve-
ment District No. 84 is hereby -determined and declared to be
specially benefited by said improvement referred to hereinabove in
at least the amount charged against the same and the assessment
appearing against the same is in proportion to the several assess-
ments appearing upon such assessment roll; and that there is hereby
levied and assessed against each lot, tract, parcel of land and
other property appearing upon such assessment roll the amount
finally charged against the same thereon.
Section 3. The assessment roll as approved and confirmed
herein shall be filed with the Treasurer of the City for collection,
and the Treasurer of the City is hereby authorized and directed to
publish notice as required by law stating that the roll is in his
hands for collection and payment of any assessment thereon or any
portion of the assessment can be made at any time within thirty days
from the date of the first publication of such notice without
penalty, interest or cost, and that thereafter the sum remaining
unpaid may be paid in ten annual installments with interest thereon
hereby fixed at the rate of 7 1/2 % per annum. The first install-
ment of assessments on the assessment roll shall become due and
payable during the 30 -day period succeeding the date one year after
the date of first publication by the City Treasurer of notice that
the assessment roll is in his hands for collection and annually
thereafter each succeeding installment shall become due and payable
in like manner. If the whole or any portion of the assessments
remains unpaid after the 30 -day period, interest upon the whole
unpaid sum shall be charged at the rate of 71/2 % per annum, and

each year thereafter one of the installments, together with interest due
on the whole of the unpaid balance, shall be collected. Any installment
not paid prior to the expiration of the 30 -day period during which such
installment is due and payable shall thereupon become delinquent. All
delinquent installments shall be subject to a -charge for interest at
7 1/2% per annum and for an additional charge of 6% penalty levied upon
both the principal and interest due upon each installment or installments.
The collection of such delinquent installments will be enforced in the
manner provided by law.
PASSED by the City Council of the City of Pasco, Washington,
at a regular open public meeting thereof, this 20th day of November, 1978.
