ORDINANCE NO. 1937
AN ORDINANCE of the City of Pasco, Washington,
providing for improvement of existing parks and
park facilities by renovating the Memorial Park
Swimming Pool, acquiring and installing new
playground equipment, basketball courts, baseball
fields and tennis courts and making miscellaneous
park improvements, including landscaping; declaring
the estimated cost thereof as nearly as may be;
providing for the submission to the qualified
voters of the City at a special election to be
held therein on April 4, 1978, of a proposition
authorizing a levy to be made in 1978 for collec-
tion in 1979 of an additional tax upon all of the
taxable property within the City of $350,000.00,
the estimated dollar rate of tax levy to produce
such an amount being $1.75 per $1,000.00 of
assessed value (such assessed value representing
100% of true and fair value unless specifically
provided otherwise by law), such levy to be in
excess of the maximum tax levy specified by law
for cities without a vote of the qualified voters,
the proceeds of such levy to be used to provide
funds to pay the cost of such park improvements;
and declaring an emergency.
WHEREAS, the City is in urgent need of improving existing
parks and park facilities by renovating the Memorial Park Swimming
Pool, acquiring and installing new playground equipment, basketball
courts, baseball fields and tennis courts and making miscellaneous
park improvements, including landscaping; and the City does not have
available sufficient funds to meet the estimated cost of such
improvements; and
WHEREAS, under the provisions of RCW 84.52.052 a city may
levy taxes at a rate in excess of the rate specified in RCW
84.52.050 through 84.52.056 and RCW 84.52.043, or RCW 84.55.010
through 84.55.050, when authorized so to do by the electors of such
city in the manner set forth in Article VII, section 2(a) of the
Constitution of this state, as amended by Amendment 59 and as
thereafter amended, at a special election to beheld in the year
in which the levy is made; and

WHEREAS, under the provisions of RCW 84.52.052 a city may

in which the levy is made; and

WHEREAS, in order to provide the funds required to pay
the cost of such park improvements it is necessary that an addi-
tional tax levy of $350,000.00 be made; NOW, THEREFORE,
THE CITY COUNCIL OF THE CITY OF PASCO, WASHINGTON, DO
ORDAIN, as follows:
Section 1. It is hereby found and declared that an
emergency exists requiring the calling of a special election and
the Auditor of Franklin County, as ex -officio Supervisor of
Elections for said County, is hereby requested to find and declare
the existence of an emergency. The Franklin County Auditor is
further requested to call and conduct a special election in the
City of Pasco, Washington, (the "City") in the manner provided
by law, to be held therein on April 4, 1978, between the hours of
7:00 o'clock a.m. and 8:00 o'clock p.m. (PDST), for the purpose of
submitting to the qualified voters of the City, for their approval
or rejection, the question of whether or not a tax levy shall be
made in 1978 for collection in 1979 upon all taxable property of
the City of $350,000.00, the estimated dollar rate of levy required
to produce such amount being $1.75 per $1,000.00 of assessed value
(such assessed value representing 100% of true and fair value
unless specifically provided otherwise by law), in excess of the
maximum tax levy provided by law for cities without a vote of the
electors, the proceeds thereof to be used immediately through
incurring an indebtedness against the City by the issuance of
warrants against the Park Improvement Fund of the City to provide
funds necessary to pay the cost of improving existing parks and
park facilities by renovating the Memorial Park Swimming Pool,
acquiring and installing new playground equipment, basketball
courts, baseball fields and tennis courts and making miscellaneous
park improvements, including landscaping.

Section 2. The "ballot title" of the aforesaid proposi-
tion shall be as follows:
PROPOSITION
For the purpose of providing funds necessary
to pay the cost of improving existing parks and
park facilities by renovating the Memorial Park
Swimming Pool, acquiring and installing new
playground equipment, basketball courts, base-
ball fields and tennis courts and making
miscellaneous park improvements, including land-
scaping, shall an additional tax levy of
$350,000.00, requiring an estimated dollar rate
of $1.75 per $1,000.00 of assessed value in
excess of the maximum tax levy provided by law
for cities without a vote of the electors, be
made in 1978 for collection in 1979 upon all
the taxable property in the City, as provided
in Ordinance No. 1937 passed February 14,
1978?

Section 3. The Clerk of the City is directed (a) to
certify to the Auditor of Franklin County, ex -officio Supervisor
of Elections of said County, a copy of this ordinance at least
45 days prior to the date of such special election, and (b) to
perform such other duties as are necessary or required by law
to the end that the question of whether or not such excess tax
levy shall be made as herein provided for shall be submitted to
the voters of the City at the aforesaid election.
PASSED by the City Council of the City of Pasco, Washington,
at a regular open public meeting thereof, and APPROVED by the Mayor
this 14th day of February, 1978.
