AN ORDINANCE approving and confirming the assessments and assessment
roll of Local Improvement District #97 created and
established by Ordinance No. 1851, as amended by Ordinance
No. 1884, for the purpose of improving Fifth Avenue from
Court Street to SR -12, Sixth Avenue from Agate Street to
Pearl Street, Seventh Avenue from Court Street to Lincoln
Drive, Eighth Avenue from Jan Street to Lincoln Drive,
Ninth Avenue from Court Street to Lincoln Drive, Tenth
Avenue from Court Street to Riverview Drive, Eleventh
Avenue from Astor Way to Twelfth Avenue, Twelfth Avenue
from Astor Way to Lincoln Drive and from Court Street to
its northerly terminus approximately 600' north of Court,
Thirteenth Avenue from Court Street to Riverview Drive,
Fourteenth Avenue from Court Street to Lincoln Drive,
Lincoln Drive from SR -12 to Fourteenth Avenue, Jay
Street from Fifth Avenue to Seventh Avenue, Jan Street
from Fifth Avenue to Fourteenth Avenue, Riverview Drive
from Tenth Avenue to Thirteenth Avenue, Leola Street
from Seventh Avenue to Ninth Avenue, Pearl Street from
Fifth Avenue to Tenth Avenue, and from Thirteenth Avenue
to Fourteenth Avenue, Opal Street from Seventh Avenue
to Ninth Avenue, Astor Way.from Tenth Avenue to Thirteenth
Avenue, Agate Street from Fifth Avenue to Ninth Avenue,
Ruby Street from Seventh Avenue to Nineth Avenue, and from
Seventh Avenue to its easterly terminus approximately
385' east of Seventh Avenue within the City of Pasco,
Washington, to City standards by grading, constructing
and installing storm drains, curbs, gutters, necessary
sidewalks, base rock, leveling course, asphalt concrete
surfacing, and all incidental work; and levying and
assessing the amount thereof against the several lots,
tracts, parcels of land and other property shown on the
roll.
WHEREAS, the assessment roll levying the special assessments
against properties located in Local Improvement District #97 in the
City of Pasco; Washington, created under Ordinance No. 1851, as amended
by Ordinance No. 1884, has been filed with the Director of Finance and
Ex Officio City Clerk of the City of Pasco, as provided by law; and
WHEREAS, notice of time and place of hearing thereof and making
objections and protests to said assessment roll was duly published at
and for the time and in the manner provided by law, fixing the time
and place of hearing thereon for the 17th day of January, 1978, at
the hour of 8:00 p.m.(PST), in the Council Chambers of the City Hall
at Pasco, Washington, and further notice thereof was duly mailed by
the Director of Finance and Ex Officio City Clerk to each property
owner shown on the assessment roll; and

WHEREAS, at the time and place fixed and designated in the
notice, the hearing was duly held and the City Council of the City of
Pasco heard all persons who wished to be heard at such hearing and
duly considered all protests made in writing and overruled the same;
NOW, THEREFORE,
THE CITY COUNCIL OF THE CITY OF PASCO DO ORDAIN AS FOLLOWS:
Section 1. That any objections to said assessments or assessment
roll be and the same are herebv overruled and that the assessments and
assessment toll of Local.Improvement District No. 97 for the cost of
improving the City standards by grading, constructing and installing
storm drains, curbs, gutters, necessary sidewalks, base rock, leveling
course, asphalt concrete surfacing, and all incidental work, Fifth
Avenue from Court Street to SR -12, Sixth Avenue from. Agate Street to
Pearl Street, Seventh Avenue from Court Street to Lincoln Drive,
Eighth Avenue from Jan Street to Lincoln Drive, Ninth Avenue from
Court Street to Lincoln Drive, Tenth Avenue from Court Street to.
Riverview Drive, Eleventh Avenue from Astor Way to Twelfth Avenue,
Twelfth Avenue from Astor Way to Lincoln Drive and from Court Street
to its northerly terminus approximately 600' north of Court, Thirteenth
Avenue from Court Street to Riverview Drive, Fourteenth Avenue from
Court Street to Lincoln Drive, Lincoln Drive from SR -12 to Fourteenth
Avenue, Jay Street from Fifth Avenue to Seventh Avenue, Jan Street from
Fifth Avenue to Fourteenth Avenue, Riverview Drive from Tenth Avenue
to Thirteenth Avenue, Leola Street from Seventh to Ninth Avenue, Pearl
Street from Fifth Avenue to Tenth Avenue, and from Thirteenth Avenue
to Fourteenth Avenue, Opal Street from Seventh Avenue to Ninth Avenue,
Astor Way from Tenth Avenue to Thirteenth Avenue, Agate Street from
Fifth Avenue to Ninth Avenue, Ruby Street from Seventh Avenue to Ninth
Avenue and from Seventh Avenue to its easterly terminus approximately
385' east of Seventh within the City of Pasco, Washington, as provided
by Ordinance No. 1851, as amended by Ordinance No. 1884, be and the
same'is hereby approved and confirmed in the total amount of Seven
Hundred Thirty -One Thousand Four Hundred Thirty &50/100 Dollars.
Section 2. That each of the lots, tracts, parcels of land and
other property shown upon the assessment roll of Local Improvement
District #97 is hereby determined and declared to be specially benefited
by said improvement referred to hereinabove in at least the amount
charged against the same and the assessment appearing against the same
is in proportion to the several assessments appearing upon said
assessment roll; and that there is hereby levied and assessed against
each lot, tract, parcel of land and other property appearing upon said
assessment roll the amount finally charged against the same thereon.
Section 3. That the assessment roll as approved and confirmed
herein be and .the same shall be filed with the Treasurer of the City
of Pasco for collection and the City Treasurer of the City of Pasco is
hereby authorized and directed to publish notice as required by law
stating that the roll is in his hands for collection and payment of
any assessment thereon or any portion of the assessment can be made at
any time within thirty days from the date of the .first publication of
said notice without penalty, interest or cost, and that thereafter the
summary remaining unpaid may be paid in ten annual installments with`

interest thereon hereby fixed at the rate of '7 percent per annum.
The first installment of assessments on the assessment roll shall become
due and payable during the thirty day period succeeding the date one
year after the date of first publication by the City Treasurer of
notice that the assessment roll is in his hands for collection and
annually thereafter each succeeding installment shall become due and
payable in like manner. If the whole or any portion of the assessments
remains unpaid after the thirty day period, interest upon the whole
unpaid sum shall be charged at the rate of 7 percent per annum and
each year thereafter one of the installments, together with interest
due on the whole of the unpaid balance, shall be collected. Any
installment not'paid prior to the expiration of the thirty day period
during which such installment is due and payable shall thereupon become
delinquent. All delinquent installments shall be subject to a charge
for interest at 7 percent per annum and for an additional charge of
6 percent penalty levied upon both the principal and interest due upon
each installment or installments. The collection of such delinquent
installments will be enforced in the manner provided by law.
PASSED by the City Council of the City of Pasco at a special
open public meeting thereof this 17th day -of January, 1978.
