ORDINANCE NO. 1887
AN ORDINANCE VACATING THE PORTION OF THE NORTH -SOUTH ALLEY
BETWEEN LOTS 8.AND 9 WITHIN BLOCK 5 OF HELM'S SECOND ADDITION
TO THE CITY OF PASCO.
WHEREAS all steps and proceedings required by law and by
resolution of the Council of the City of Pasco to vacate the portions
of the alley hereinafter named have been duly taken and performed;
NOW, THEREFORE,
THE CITY COUNCIL OF THE CITY OF PASCO DO ORDAIN AS FOLLOWS:
Section 1. That the following described property:
North -south alley, Block 5, between Lots 8 and 9 of
Helm's Second Addition, situate in the City of Pasco,
Franklin County, Washington;
be and the same is hereby vacated and the land so vacated
be and is hereby surrendered and attached to the lots bordering
thereon, respectively, as a part thereof, and all right or
title of said City of Pasco and the public in and to the
portions of the said alley so vacated shall and does hereby
vest in the owners of said property abutting thereon, all
in the manner provided by law; provided, however, that all
utility easements that the City of Pasco may have in the above
described property shall be retained by the City of Pasco in
perpetuity for the purpose of constructing, reconstructing,
repairing and maintaining the utility lines under, along and
across the entire portion of the alley right-of-way herein
vacated, together with the right and privilege to enter upon
each and every part of the property herein reserved at any
time with all necessary men, materials, appliances and
equipment for the purpose of constructing, inspecting,
operating, repairing and maintaining said utility lines.
Section 2. That this Ordinance shall become effective upon
its passage and publication as required by law.
