AN ORDINANCE RELATING TO SOLID WASTE DISPOSAL AND
AMENDING CHAPTER 6.04 OF THE PASCO MUNICIPAL CODE
BY AMENDING SECTIONS 6.04.030, 6.04.070, 6.04.100,
6.04.240, 6.04.300, and 6.04.310 THEREOF.
THE CITY COUNCIL OF THE CITY OF PASCO DO ORDAIN AS FOLLOWS:
Section 1. That Section 6.04.030 of the Pasco Municipal Code
be and the same is hereby amended to read as follows:
6.04.030 SUPERVISION BY CITY. The city manager is
empowered and authorized to appoint a suitable and
qualified person(s), subject to budget provisions, to
supervise the collection, transportation and disposal
of solid waste and garbage, for the supervision of the
sanitary land fill operation, the arbitration to disputes
between the contractor and the customer arising from
missed pickups, size and/or condition of container,
frequency of pickups and other complaints, and for the
enforcement of the provisions of this chapter. The
person appointed as herein provided shall have the
authority and power to issue complaint citations for
violations of the provisions of this chapter. All
disputes with respect to the handling of complaints
submitted to the person appointed herein not resolved
by that person shall be submitted to the city manager
for final resolution.
The Benton -Franklin health district may order the
removal of any solid waste or rubbish at any time and
from any locality where it is determined by said
authorities that such removal is necessary for the
protection and preservation of public health, sanitation
and cleanliness. In all cases, the Benton -Franklin
health district shall notify the contractor that such
removal is necessary. The contractor shall remove such
solid waste and rubbish as ordered by the district;
further, the contractor shall charge the city and the
city in turn shall charge the occupant or the person
who allows the deposit of solid waste or rubbish to
accumulate a sum equal to three times the amount usually
charged for such special service. If the premises is
unoccupied, as an alternate, the city will then charge
the owner of said premises a sum equal to three times
the amount usually charged for such special service.
Section 2. That Section 6.04.070 of the Pasco Municipal
Code be and the same is hereby amended to read as follows:
6.04.070 COLLECTION CONTRACTS - SOLID WASTE. In the
event it is advisable for the city to arrange for the
collection of solid waste from within the city by other
than its own forces, it may, in accordance with the law,
contract with another person to perform such service.
Section 3. That Section 6.04.100 of the Pasco Municipal Code
be and the same is hereby amended to read as follows:
6.04.100 CAN, CONTAINER -.SPECIFICATIONS. Solid waste
cans and containers shall be strong, water right, water
impermeable, not easily corrodable, rodentroof and
insectproof. Cans shall not be less than fifteen nor
more than thirty-two gallons capacity. Cans shall have
two handles at the sides thereof or other suitable handle.
The city or solid waste collector, if any, with the
approval of the Benton -Franklin health district may make
special arrangements with the owners or operators of
public food establishments and commercial establishments
to permit the use of containers of greater capacity than
thirty-two gallons which may be of nonstandard construction.
All cans and containers shall meet all State Department of
Ecology requirements and plastic bags may be substituted
therefor providing they meet said requirements. Containers
of a volume of one cubic yard or greater shall be placed
and maintained on a hard, level surface at a grade equal
to that of a street adjacent to the establishment maintaining
the container.
Section 4. That Section 6.04.240 of the Pasco Municipal Code
be and the same is hereby amended to read as follows:
6.04.240 SPECIAL COLLECTION AND TRANSPORTATION. The city
may designate two special cleanup weeks, one of which shall
be in the spring of the year and the other of which shall
be in the fall of the year, during which time the city and
the solid waste collector, if any, may collect solid waste
other than garbage and swill at no additional cost:to
residences or establishments.
Section 5. That Section 6.04.300 of the Pasco -Municipal Code
be and the same is hereby amended to read as follows:
6.04.300 SCHEDULE OF SERVICE CHARGES. (a) Occupied
Residence.' The person responsible for water service to
each residence or separate unit therefor shall be charged
two dollars and seventy-five cents per month for each
occupied residence or unit thereof for the weekly removal
of up to two cans per week of solid waste from each residence
or unit therefor. In addition, a special rate of one dollar
and seventy cents per month for the weekly removal of one
can per week from each residence or unit therefor is
established. To qualify for this special rate, the person

responsible must be at least sixty years of age. In addition,
he must be on or qualify for public assistance under the law
of the state of Washington and certify on an appropriate form
at the City Hall that one can per week is at least or more
than adequate to meet his normal needs. In the event such
person signs for this special service and requirements for
compulsory and/or universal solid waste collection are
subsequently eliminated, his application for such special
service shall be voided. If the city's solid waste contractor
is responsible for billing, the city shall notify the
contractor of those persons qualifying for the special rate
herein provided.
(b) Occupied Multi -Family Residence. The person responsible
for water service to each unit or units of a multi -family
residence shall be charged two dollars and fifty-five cents
per month per unit for the weekly removal of up to two cans
per week of solid waste from each residence unit of the premises.
As an alternate, the person responsible for water service may
contract for centralized container service at the rate specified
herein. As a further alternate, the person responsible for
water service may contract for a special rate based on fewer
than two cans per week, but not less than one can per week,
from each residence unit of`the premises. Such a special rate
shall be mutually agreeable to the person responsible, the
contractor and the city. The additive for billing costs shall
not be over two dollars per month per account.
(c) Commercial Establishment. The minimum monthly
charge shall be three dollars and seventy cents per month for
the weekly removal of up to two cans per week of solid waste
.from the premises. As an alternate, container service may
be contracted for at the rate specified herein. As a further
alternate, commercial accounts may be covered by a special
rate. Such special rates shall be mutually agreeable to the
person responsible, the contractor and the city. The additive
for billing shall not be over two dollars per month per account.
(d) Public Food Establishment. The charge for a public
food establishment shall be fourteen dollars and twenty-five
cents per month per can for daily service as described herein.
The minimum monthly charge shall be fourteen dollars and
seventy-five cents. As an alternate, the person responsible
for water service to the public food establishment may contract
for container service at the rate specified herein.
(e) Extra Can or Bag Charges. There shall, be a charge
of fi'f'ty cents per can or bag, per week for the removal of
each can or bag in excess of thelevel- of service opted .for by the.
customer.,
Section 6. That Section 6.04.310 of the Pasco Municipal Code
be and the same is hereby amended to read as follows:

6.04.310 BILLING PROCEDURE. The charges for solid waste
collection and disposal as included herein shall be
compulsory and universal and shall be billed by either
the finance department or the city's contractor. Such
charges may be included with the billing for water and
sewer utility service. The charges shall be paid to the
city or its contractor by the person responsible for the
water and sewer utility billings and shall be paid not later
than thirty days after the billing is mailed and, if not
so paid, the charges shall be deemed delinquent.
If the city does the billing, in the event of
delinquency, charges for solid waste collection and disposal
shall become a lien against the property prior to all other
liens and encumbrances filed subseauent to such notice
except liens for general taxes and local improvement
assessments. Interests shall accrue upon de_linauent accounts
at eight percent per year from the date of delinquency
until paid; and in the event of foreclosure said lienable
charge shall include all costs and fees of foreclosing
said lien. Billings for commercial accounts shall be mailed
to the tenant in possession unless special instructions to
the contrary are received from the owner. Billing for a
residence or a multi -family residence shall be charged to
the tenant in possession of the premises providing prior
written authorization has been given by the property owner
and any required deposit has been made.
If the citv's contractor does the billing for solid
waste disposal, in the event of delinquency of four.(:4)
months charges for solid waste collection and disposal,
the city's contractor shall have the right to apply in
writing for the right to refuse collection at the delinquent
person's residence or establishment until the delinquency
is paid. The application shall contain a verified statement
of the name and location of the delinquent account, the
amount of delinquency and the procedures utilized to attempt
collection of the delinquency. The City, after reviewing
the merits of the application and making a determination
that the 'contractor has made a good faith effort to collect,
A that the account remains

shall grant to the contractor in writing the right to refuse
to collect solid waste from the delinquent customer until
the delinquency is paid.
Failure to pay charges for solid waste disposal serivices
shall constitute a violation of this chapter and shall
be punishable as herein provided.
Section 7. That this Ordinance shall become effective upon its
passage and publication as required by law.
