AN ORDINANCE RELATING TO FIRE PREVENTION AND AMENDING
TITLE 18 OF THE PASCO MUNICIPAL CODE BY REPEALING AN
REENACTING CHAPTER 18.04 THEREOF
THE CITY COUNCIL OF THE CITY OF PASCO DO ORDAIN AS FOLLOWS:
Section 1. That Title 18 of the Pasco Municipal Code be
and the same is hereby amended by repealing Chapter 1.8.04 thereof in
its entirety and reenacting the same to read as follows:
18.04.010 Adoption: There is hereby adopted by the City
Council of the City of Pasco for the purpose of prescribing
regulations governing conditions hazardous to life and property
from fire or explosion that certain Code known as the Uniform
Fire Code, recommended by the Western Fire Chief's Association
and the International Conference of Building Officials, being
particularly the 1976 Edition thereof and the whole thereof, save
and except for portions as are hereinafter deleted, modified or
amended of which Code not less than three copies have been and
now are filed in the Office of the City Clerk of the City of Pasco,
and the same are hereby adopted and incorporated as fully as if
set out in length herein; and from the date on which this Ordinance
shall take effect the provisions thereof shall be controlling
within the corporate limits of the City of Pasco.
18.04.020 Definitions:
a) Wherever the term "Chief of the Bureau of Fire
Prevention" is used in the Uniform Fire Code, it shall mean the
Fire Chief or his designee charged with the duties of administering
and enforcing this Ordinance.
b) Wherever the term "Corporation Counsel" is used in the
Uniform Fire Code, it shall mean the City Attorney.
c) Wherever the term "Fire Zone" is used in this Ordinance
or in the Uniform Fire Code, it shall mean Fire Zone No. 1, Fire
Zone 2 and Fire Zone 3.
d) Wherever the term "Municipality" is used in the Uniform
Fire Code, it shall mean the City of Pasco.
e) Wherever the term "Nationally recognized good practice"
is used in the Uniform Fire Code, it shall mean those practices
prescribed in the standards and publications listed in Appendix D
of the Uniform Fire Code.
18.04.030 Substitution for Section 1.126 of the Uniform
Fire Code: Section 1.216 of the Uniform Fire Code.shall be
omitted, and the following shall be substituted in its place:
Whenever this Code is inapplicable for any reason to
any situation involving the protection of persons and
property from the hazards of fire and explosion, the
materials, methods of construction, installations,
practices, or operations necessary to provide such
protections shall, to a reasonable degree, be in
accordance with nationally recognized and accepted
standards, principles and tests and generally recognized
and well established methods of fire prevention and
control, as set forth in the following publications by
recognized national authorities and technical or
scientific organizations, which are adopted by reference
as part of this Code as though set forth herein in full.

18.04.040 Establishment of Limits of Districts in Which
Storage of Explosives and Blasting Agents is to be Prohibited: The
limits referred to in Section 11.106b of the Uniform Fire Code in
which storage of explosives and blasting agents are prohibited is
hereby established to be Fire Zone No. 1, Fire Zone No. 2 and Fire
Zone No. 3.
18.04:050 Substitution for Section 12.103 of the Uniform
Fire Code: Section 12.103 of -.the Uniform Fire Code shall be omitted
and the following shall be substituted in its place:
The permittee shall file with the Fire Chief, a public
liability and property damage insurance policy providing
coverage with limits not less than $150,000 to the
applicant for liability for the payment of damages which
may be caused either to a person or, to property by reason
of the permitted display, and arising from any acts, or
failure to act, of the permittee, his agents, employees
or subcontractors, unless he is excused from filing such
policy by reason of any of the provisions of the Laws of
the State of Washington.
18.04.060 Substitution for Section 12.106 of the Uniform
Fire Code: Section 12.106 of the Uniform Fire Code shall be omitted
and the following shall be substituted in its place:
Any member of the Pasco Police or Fire Departments is
hereby authorized and empowered to seize, take, remove or
cause to be removed at the expense of the owner, any and
all stocks of fireworks offered or exposed for sale, stored,
or transported, or held in violation of this article.
18.04.070 Substitution for Section 13.301 of the Uniform
Fire Code: Section 13.301 of the Uniform Fire Code shall be omitted
and the following shall be substituted in its place:

(a) The Chief shall designate the type and number of
fire appliances to be installed and maintained in and upon
all buildings and premises in the jurisdiction other than
private dwellings. This shall be done according to the
relative severity of probable fire, including the rapidity
with which it may spread. Such appliances shall be of a
type suitable for the probable class of fire associated
with such building or premises and shall have approval of
the Chief.
(b) In occupancies of an especially hazardous nature,
or where special hazards exist.in addition to the normal
hazard of the occupancy, or where access for fire apparatus
is unduly difficult, additional safeguards may be required
consisting of additional fire appliance units, more than
one type of appliance, or special systems suitable for the
protection of the hazard involved. Such devices or
appliances may consist of automatic fire alarm systems,
automatic sprinkler or water spray systems, standpipe and
hose, fixed or portable fire extinguishers, suitable
asbestos blankets, breathing apparatus, manual or automatic
covers, or carbon dioxide, foam or other special fire
extinguishing systems. Where such systems are installed,
they shall be in accordance with the applicable standards
of the National Fire Protection Association.
(c) An approved water supply capable of supplying required
fire flow for fire protection shall be provided to all
premises upon which buildings or portions of buildings are
hereafter constructed. When any portion of the building
protected is in excess of 150 feet from a water supply on
a public street, there shall be provided, when required by
the Chief, on-site fire hydrants and mains capable of
supplying the required fire flow.
Water supply may consist of reservoirs, pressure tanks,
elevator tanks, water mains, or other fixed system capable
of supplying their required fire flow. In setting the
requirements for fire flow, the Chief may be guided by the
standard published by the Insurance Services Office, "Guide
for Determination of Required Fire Flow".
The location, number, and type of fire hydrants connected
to a water supply capable of delivering the required fire
flow shall be provided on the public street or on the site
of the premises to be protected as required and approved by
the Chief. All hydrants shall be accessible to the Fire
Department apparatus by roadways meeting the requirements
of Section 13.208.

(d) When fire protection facilities are to be installed
by the developer, such facilities including all surface
access roads shall be installed and made serviceable prior
to and during the time of constructions. When alternate
methods of protection, as approved by the Chief, are
provided, the above may be modified or waived.
(e) All fire alarm systems, fire hydrant systems, fire -
extinguishing systems (including automatic sprinklers).,
wet and dry standpipes, basement inlet pipes, and other
fire protection systems and pertinents thereto shall meet
the approval of the Fire Department as to installation
and location and shall be subject to such periodic tests
as required by the Chief. Plans and specifications shall
be submitted to the Fire Department for review and approval
prior to construction.
(f) Fire hydrants connected to an approved water supply
system capable of delivering the required fire flow shall
be provided on the public street or on the site of the
premises to be protected as required by the Chief, prior
to any combustible flaming.
18.04.080 Substitution for Section 15.109 of the Uniform
Fire Code: Section 15.109 of the Uniform Fire Code shall be omitted
and the following shall be substituted in its place:
(a) Flammable liquids shall not be dispensed by gravity
from tanks, drums, barrels or similar containers. An
exception may be granted where the nature of the liquid to
be dispensed makes such a restriction impractical. Approved
pumps taking suction from the top of the container shall be
used. Flammable or combustible liquids shall not be
dispensed by a device that operates through pressure within
a storage tank or container, unless the tank or container
has been approved as a pressure vessel for the use to which
it is subjected. In no case shall air or oxygen pressure
be used for this purpose.
(b) Flammable liquids shall not be dispensed into the
fuel tank of a motor vehicle directly from any aboveground
tank. This subsection shall not prohibit the use of
approved portable or temporary fueling or dispensing units
operating under the provisions of a special permit issued
by the Chief.
(c) Not withstanding any other provision of the Uniform
Fire Code, flammable liquids used as motor fuels may not be
stored and dispensed from fixed equipment into the fuel,
tanks of motor vehicles in any use District classified as
Residential by the Pasco Comprehensive Zoning Ordinance,
being R-1 Low Density, R-1 Suburban, R-2, R-3 and R-4 use
Districts.

18.04.090 Establishment of Limits of Districts in which
Storage of Flammable Liquids in Outside Above Ground Tanks is to
be Prohibited:
(a) The limits referred to in 15.201(a) of the Uniform
Fire Code in which storage of flammable liquids in outside
above ground tanks is prohibited, is hereby established as
Fire Zone No. 1.
(b) The limits referred to in Section 15.601 of the
Uniform Fire Code in which new bulk plants for flammable
or combustible liquids are prohibited, are hereby
established as Fire Zone No. 1 and Fire Zone No. 2.
18.04.100 Substitution for Section 15.709 of the Uniform
Fire Code: Section 15.709 of the Uniform Fire Code shall be omitted
and the following shall be substituted in its place:
(a) There shall be no smoking or open flames in the areas
used for fueling, servicing internal combustion engines,
receiving or dispensing of flammable or combustible liquids.
A conspicuous sign prohibiting smoking shall be posted
within sight of each customer being served. Letters on such
signs shall be not less than 4 inches high. The motors of
all vehicles being fueled shall be shut off during the
fueling operation.
(b) Extinguishers of a minimum classification of 20-B,
C shall be provided and so located that no pump, dispenser,
or fill -pipe opening shall be a greater distance than 75
feet from such extinguisher.
18.04.110 Establishement of Limits in which Bulk Storaqe of
Liquified Petroleum Gauges are to be Restricted: The limits
referred to in Section 20.105(a) of the Uniform Fire Code in which
bulk storage of liquified.petroleum gas is restricted, are hereby
established as Fire Zone No. 1 and Fire Zone No. 2.
18.04.120 Substitution for Section 27.101 of the Uniform
Fire Code: Section 27.101 of the Uniform Fire Code shall be omitted
and the.following shall be substituted in its place:
BONFIRES AND OUTDOOR RUBBISH FIRES.
(a) Permit Required. No person shall kindle or maintain
any bonfire or rubbish fire or warming fire or authorize
any such fire to be kindled or maintained without a permit.
During the construction or demolition of buildings or
structures, no waste materials or rubbish shall be disposed
of by burning on the premises or in the immediate vicinity
without having obtained a permit. A permit shall be required
for each construction site. Burning permits shall be issued
between the hours of 8:00 a.m., and 5:00 p.m., Monday
through Friday except on holidays. Burning permits
will be issued upon approval of an on -sight inspection
of the burning site by a Fire Department representative.
All permits will be in writing and will be valid for a
period of one year from the date of issue, at which time
they may be renewed. The Pasco Fire Department may utilize
controlled burning for the purpose of training firefighters
without a permit. Burning permits will be free of charge.
(b) Location Restricted. No person shall kindle or
maintain any bonfire or rubbish fire or warming fire or
authorize such fire to be kindled or maintained on any
private land unless (1) the location is not less than 25
feet from any ordinary combustible.material and adequate
provision is made to prevent fire from spreading to within
25 feet of any structure, or (2) the fire is contained
in any approved waste burner located safely not less than
15 feet from any structure. Bonfires, rubbish fires, and
warming fires shall be located not less than 25 feet from
power poles and not under overhead transmission lines, or
(3) the burning site is located in Fire Zone #2 or #3.
(c) Attendance of Open Fires. Bonfires and rubbish
fires shall be constantly attended by a competent person
until such fire is extinguished. This person shall have a
garden hose connected to the water supply, or other fire
extinguishing equipment readily available for use. Warming
fires shall be under the constant observation of a competent
person, and shall be extinguished one hour prior to the
evacuation of a construction site.
(d) Chief May Prohibit. No person shall kindle or
maintain any bonfire or rubbish fire or warming fire or
authorize such fire to be kindled or maintained even if
a permit has been issued, when any of the following
conditions are in force: (1) If the wind velocity is above
10 miles per hour, or (2) if a temperature inversion is
present or air circulation is insufficient to disperse
smoke, gases, and fumes, to the extent necessary to protect
the public health. It shall be the responsibility of the
permittee to check the local conditions prior to burning
by calling the phone number listed on the permit.
(e) All controlled burning shall comply with the
regulations of the Benton -Franklin Walla Walla Counties
Air Pollution Control Authority.
18. 04.130 Substitution for 'Suction 27.104 of ,they -Umi:form
Fire Code: Section 27.104 of the Uniform Fire Code shall be
omitted and the following shall be substituted in its place:

No person shall deposit hot ashes or
cinders or smoldering coals or greasy or oily substances
liable to spontaneous ignition, into any combustible
receptacle, or place the same within 25 feet of any
combustible materials, except in metal or other non-
combustible covered receptacles. Such receptacles shall
be placed outside of buildings and kept at least two feet
away from any combustible wall or exterior window opening.
18.04.140 Substitution for Section 27.106 of the Uniform
Fire Code. Section 27.106 of the Uniform Fire Code shall be
omitted and the following shall be substituted in its place:
(a) Any residential incinerator used in connection
with a residential dwelling shall be located not less
than 15 feet from any building or structure or other
combustible material. Any residential incinerator used
in connection with any occupancy other than single family
dwelling shall be located not less than 15 feet from any
building or property line; provided, further that the stack
of any such incinerator shall be constructed in accordance
with the Mechanical Code, and shall terminate not less than
5 feet from combustible roof, overhang, or eave construction.
(b) This restriction shall not apply to barbecue pits
and outdoor fireplaces built in accordance with the Building
Code. -
18.04.150 Substitution for Section 27.107 of the Uniform
Fire Code. Section 27.107 of the Uniform Fire Code shall be
omitted and the following shall be substituted in its place:
Any incinerator installed in a trailer
camp, mobile home park, or permanent camping park, shall
be of a type approved by the Benton -Franklin Walla Walla
Counties Air Pollution Control Authority. Such incinerator
shall be located no less than 15 feet from any building,
structure, or other combustible material."'
18..-04.160 Su5stitut'i'ori 'for Section 27.109 of the Uniform
Fire'Code. Section 27.109 of the Uniform Fire Code shall be
omitted and the following shall be substituted in its place:
A minimum clearance of 15 feet shall
be maintained between any incinerator and all rubbish,
dry grass, weeds, vegetation, and any other combustible
material.
18.04.170 Substitution for Section 27.112 of the Uniform
Fire Code. Section 27.112 of the Uniform Fire Code shall be
omitted and the following shall be substituted in its place:
No waste matter shall be disposed of
by burning except as follows:
(a) All burning shall take place between 6:00 a.m.,
and 6:00 p.m.
(b) Burning confined to incinerators.
EXCEPTIONS: All burning shall be done in an approved
incinerator, except that outdoor burning of approved
combustible waste matter may be done in the open if:
1. A permit to engage in such burning is obtained.
2. Such burning is done at a distance of more than
25 feet from any building, structure or other combustible
material.
3. A garden hose and water supply or other fire
extinguishing equipment is on hand and a competent person
is in constant attendance until all fire has been
extinguished. Applicants for such permit must be in legal
control of the lot or parcel of land on which the burning
is to be done.
4. None of the following materials shall be burned:
lawn grass clippings, leaves, garbage, dead animals,
asphalt, paper, petroleum products, paints, rubber products,
plastics, any substances which normally emits dense smoke
or obnoxious oders.
5. All controlled burning fires--. shall be of a
size not larger than 2 .feet in height; and shall burn only
approved materials.
6. Burning at construction sites shall comply with
all burning rules and regulations.__
18.04.180 Substitution for Section 27.201 of the Uniform
Fire Code. Section 27.201 of the Uniform Fire Code shall be omitted
and the following shall be substituted in its place:
(a) Accumulations of wastepaper, hay, grass, straw, weeds,
litter or combustible or flammable waste, waste petroleum
products, or rubbish of any kind shall not be permitted to
remain upon any roof or in any court, yard, vacant lot or
open space. All weeds, grass, vines or other growth, when
same endangers property, or is liable to be fired, shall
be cut down and removed by the owner or occupant of the
property.
(b) All combustible rubbish, oily rags or waste material
when kept within a building, or adjacent to a building,
shall be securely stored in metal or metal -lined receptacles
equipped with tight -fitting covers or in rooms or vaults
constructed of non-combustible materials.
(c) In the event any conditions herein prohibited are
found to exist, the Fire Chief may give notice to the
property owner upon which the condition is found to correct
the same within a reasonable period of time, and if not
corrected, the Fire Chief may cause the same to be corrected
and the cost thereof shall be and hereby is declared a lien
against the property.
18.04.190 Substitution for Section 27.203 of the Uniform
Fire Code. Section 27.203 of the Uniform Fire Code shall be
omitted and the following shall.be substituted in its place:
(a) Permit Required. No person shall store in excess
of 2500 cubic feet gross volume of combustible empty
packing cases, boxes, barrels or similar containers, or
rubber or cork, or other similarly combustible materials
without a permit.
(b) Storage Requirements. Storage in buildings shall
be orderly, shall be more than 2 feet from the ceiling, and
shall be so located as not to endanger exit from the
building. Refer to Article 35 for High Piled Stock.
Storage in the open shall not exceed 20 feet of height,
shall be so located as not to constitute a hazard to
adjacent buildings or property, and shall be compact and
orderly. Such storage is prohibited within 3 feet of any
property line and shall not exceed 6 feet in height when
within 10 feet of such property line, except.where no hazard
or menace of fire to adjoining property is created thereby.
(c) Hazardous Storage. Where the storage or accumulation
of combustible waste matter used in stores, apartment
buildings, factories and other similar places is a hazard
or menace of fire, said storage of such materials shall be
removed at least every second day.
(d) Regulation of Storage in Unfinished Spaces. It
shall be unlawful to place, store, or keep, or permit to
be placed, stored, or kept, in any unfinished attic or
other place directly under a roof or any unfinished basement
or unfinished area under a building except a residence,
any furniture, baggage, or other combustible or flammable
material. The term "unfinished" as used in this section
shall apply to any space or area directly under a roof of
any building or under the lowest story of any building,
which if used for storage of combustible material, would
be required by the Building Code to have all walls lathed
and plastered or otherwise completed as required for any
intermediate area or space within the building.
18.04.200 Substitution for Section 1.214 of the Uniform
Fire Code. Section 1.214 of the Uniform Fire Code shall be
omitted and the following shall be substituted in its place:
Alternate Materials & Methods
(a) Upon application in writing by the owner or lessee,
or his duly authorized representative the Chief and/or
City Manager may consider and allow alternate materials'or
methods, where there are practical difficulties in the way
of carrying out the strict letter of the Code provided
that the spirit of the Code shall be complied with, public
safety secured and substantial justice done. The particulars
of the variances shall be entered upon the records of the
department and a signed copy shall be furnished the applicant
and the City Manager.
(b) The Chief, on notice to the Building Department,
may approve any alternate material or method, provided he
finds that the proposed design, use or operation
satisfactorily complies with the intent of this Code and
that the material, method of work performed or operation
is for the purpose intended, at least the equivalent of
that prescribed in this Code in quality, strength,
effectiveness, fire resistance, durability and safety;
provided, however, that any approval under the authority
herein contained shall be subject to the approval of the
Building Official whenever the alternate material or method
involves matters regulated by the Building Code.
(c) The Chief may require tests as proof of compliance
with the intent of this Code, such tests to be made by an
approved agency at the expense of the person requesting
approval of the alternate material or method of construction.
(d) If technical expertise is unavailable within the
department because of new technology, process, products,
facilities, materials and uses attending the design,
operation, or use of a building or premises subject to the
inspection of the department, the Chief may require the owner
or the person in possession or control of the building or
premises to provide, without charge to the department, a
technical opinion and report. The opinion and report shall
be prepared by a qualified engineer, specialist, laboratory
or firesafety specialty organization acceptable to the Chief
and the owner and shall analyze the firesafety properties
of the design, operation or use of the building or premises
and the facilities and appurtenances situated thereon, and
prescribe the necessary recommended changes.
(e) The Building Inspector, Fire Chief and the Officer
designated by the Fire Chief as the Chief Enforcing Officer
of this Code, shall act as a committee to determine and
specify after having given affected persons an opportunity
to be heard, any new materials, processes, or occupancies,
in addition to those now enumerated in this Code, which

shall require permits, during the 90 -days next following
such determination. The Chief of the Bureau of Fire
Prevention shall post a list of such new materials, processes,
and occupancies in a conspicuous place in his office and
shall distribute copies thereof to interested persons. The
Committee shall promptly make recommendations to the City
Council for changes in or additions to this Ordinance
relating to such new uses, processes or occupancies.
18.04.210 Substitution for Section 1.215 of the Uniform
Fire Code. Section 1.215 of the Uniform Fire Code shall be omitted
and the following shall be substituted in its place:
Whenever the Chief of the Fire Department shall disapprove
an application or refuse to grant a permit applied for, or
when it is claimed that the provisions of this Code do not
apply or that the true intent and meaning of the Code have
been disconstrued or wrongly interpreted, the applicant may
appeal from the decision of the Chief of the Fire Department
to the Board of Appeals, as established under the Building
Code of the City of Pasco.
18.04.220 Violations - Penalties. Any person, firm, or
corporation violating any of the provisions of this Code shall be
deemed guilty of a misdemeanor, and each such person shall be
deemed guilty of a separate offense for each and every day or portion
thereof during which any violation of any of the provisions of this
Code is committed, continued, or permitted, and upon conviction of
any such violation such person shall be punishable by a fine of not
more than $500 or by imprisonment for not more than six months or by
both such fine and imprisonment.
18.04.230 Severability:The invalidity of any article,
section, sub -section, provision, clause, or portion thereof, or
the invalidity of the application thereof to any person or
circumstances shall not affect the validity of the remainder of this
Ordinance or the validity of its application to other persons or
circumstances.
Section 2. This Ordinance shall be in full force and effect
after its passage and publication as required by law.

18.04.120 Substitution for Section 27.101 of the Uniform
Fire Code. Section 27.101 of the Uniform Fire Code shall be
omitted and the following shall be substituted in its place:
Outdoor Burning Restricted
(a) Except as hereinafter provided, it shall be unlawful
for any person to cause or allow any outdoor fire within
the City of Pasco.
(b) Definition of outdoor fire: "Outdoor fire" means
the combustion of material in the open.
(c) The following outdoor fires are exempt from (a) of
this section:
1. Fires from torches, incense burners, insect pots,
flares, smokeless gas burners, and barbecue appliances.
2. Fires for instruction in methods of fighting fire,
testing fire resistance of materials, or testing fire
protection equipment provided prior written approval
has been issued by the Benton -Franklin -Walla Walla Air
Pollution Control Authority.
(d) It shall be prima facie evidence that the person who
owns or controls property on which an outdoor fire occurs
has caused or allowed said outdoor fire.
18.04.130 Substitution for Section 27.104 of the Uniform
Fire Code. Section 27.104 of the Uniform Fire Code shall be omitted
and the following shall be substituted in its place:
No person shall deposit hot ashes or cinders or smoldering
coals or greasy or oily substances liable to spontaneous
ignition, into any combustible receptacle, or place the
same within 25 feet of any combustible materials, except
in metal or other non-combustible covered receptacles.
Such receptacles shall be placed outside of buildings and
kept at least two feet away from any combustible wall or
exterior window opening.
18.04.140 Substitution for Section 27.106 of the Uniform
Fire Code. Section 27.106 of the Uniform Fire Code shall be omitted
and the following shall be substituted in its place:
(a) Any residential incinerator used in connection with
a residential dwelling shall be located not less than 15
feet from any building or structure or other combustible
material. Any residential incinerator used in connection
with any occupancy other than single family dwelling shall
be located not less than 15 feet from any building or
property line; provided, further that the stack of any such
incinerator shall be constructed in accordance with the
Mechanical Code, and shall terminate not less than 5
feet from combustible roof, overhang, or eave construction.
(b) This restriction shall not apply to barbecue pits
and outdoor fireplaces built in accordance with the
Building Code.
18.04.150 Substitution for Section 27.107 of the Uniform
Fire Code. Section 27.107 of the Uniform Fire Code shall be
omitted and the following shall be substituted in its place:
Any incinerator installed in a trailer camp, mobile home
park, or permanent camping park, shall be of a type
ap,proved by the Benton -Franklin -Walla [galla Counties Air
Pollution Control Authority. Such incinerator shall be
located no less than 15 feet from any building, structure,
or other combustible material.
18.04.160 Substitution for Section 27.109 of the Uniform
Fire Code. Section 27.109 of the Uniform Fire Code shall be
omitted and the following shall be substituted in its place:
A minimum clearance of 15 feet shall be maintained between
any incinerator and all rubbish, dry grass, weeds,
vegetation; and any other combustible material.
18.04.170 Substitution for Section 27.112 of the Uniform
Fire Code. Section 27.112 of the Uniform Fire Code shall be
omitted and the following shall be substituted in its place:
No waste matter shall be disposed of by burning except
as follows:
(a) All burning shall be done in an incinerator
approved by the Fire Chief, and
(b) Such burning shall take place between 6:00 a.m.,
and 6:00 p.m.

18.04.120 Substitution for Section 27.101 of the Uniform
Fire Code. Section 27.101 of the Uniform Fire Code shall be
omitted and the following shall be substituted in its place:
'BONFIRES AND OUTDOOR RUBBISH FIRES.
(a) Permit Required. No person shall kindle or maintain
any bonfire or rubbish fire or warming fire or authorize
any such fire to be kindled or maintained without a permit.
During the construction or demolition of buildings or
structures, no waste materials or rubbish shall be disposed
of by burning on the premises or in the immediate vicinity
without having obtained a permit. A permit shall be
required for each construction site. Burning permits
shall be issued between the hours of 6:00 a.m., and 6:00
p.m., daily. Burning permits will be issued upon approval
of an on -sight inspection of the burning site by a Fire
Department representative. All permits will be in writing
and will be valid for the date of issue. The Pasco Fire
Department may utilize controlled burning for the purpose of
training firefighters without a permit. A .fee of $1.00
shall be charged for each permit issued.
(b) Location Restricted. No person shall kindle or
maintain any bonfire or rubbish fire or warming fire or
authorize such fire to be kindled or maintain on any private
land unless (1) the location is not less than 25 feet from
any ordinary combustible material and adequate provision
is made to prevent fire from spreading to within 25 feet of
any structure, or (2) the fire is contained in any approved
waste burner located safely not less than 15 feet from any
structure. Bonfires, rubbish fires, and warming fires
shall be located not less than 25 feet from power poles
and not under overhead transmission lines, or (3) the
burning site is located in Fire Zone #2 or #3.
(c) Attendance of Open Fires. Bonfires and rubbish
fires shall be constantly attended by a competent person
until such fire is extinguished. This person shall have a
garden hose connected to the water supply, or other fire
extinguishing equipment readily available for use. warming
fires shall be under the constant observation of a competent
person, and shall be extinguished one hour prior to the
evacuation of a construction site.
(d) Chief may Prohibit. No person shall kindle or
maintain any bonfire or rubbish fire or warming fire or
authorize such fire to be kindled or maintained even if a
permit has been issued, when any of the following conditions
are in force: (1) If the wind velocity is above 10 miles
per hour, or (2) if a temperature inversion is present or
air circulation is insufficient to disperse smoke, gases,
and fumes, to the extent necessary to protect the public
health.
(e) All controlled burning shall comply with the
regulations of the Benton -Franklin Walla Walla Counties
Air Pollution Control Authority.

(b) Burning confined to incinerators.
Exceptions: All burning shall be done in an approved
incinerator, except that outdoor burning of approved
combustible waste matter may be done in the open if:
1. A permit to engage in such burning is obtained.
2. Such burning is done at a distance of more than
25 feet from any building, structure or other combustible
material.
3. A garden hose and water supply or other fire
extinguishing equipment is on hand and a competent person
is in constant attendance until all fire has been
extinguished. Applicants for such permit must be in
legal control of the lot or parcel of land on which the
burning is to be done.
4. None of the following materials shall be burned:
lawn grass clippings, leaves, garbage, dead animals,
asphalt, paper, petroleum products, paints, rubber products,
plastics, any substances which normally emits dense smoke
or obnoxious oders.
5. All controlled burning fires shall be of a size not
larger than 2 feet in height; and shall burn only approved
materials.
6. Burning at construction sites shall comply with all
burning rules and regulations.
