AN ORDINANCE OF THE CITY OF PASCO ADOPTING THE 1976
EDITION OF THE UNIFORM LLILDING CODE TOGETHER WITH
APPROPRIATE AM_`NDMENTS AND SUBSTITUTIONS THERETO;
ADOPTING REGULATIONS FON. BARRIER FREE FACILITIES;
ADOPTING UNIFORM BUILDIN'; CODE APPENDIX CHAPTER 32;
ADOPTING UNIFORM BUILDI;IG CODE APPENDIX CHAPTER 53;
AND REPEALING CHAPTER 16.04 OF THE PASCO MUNICIPAL
CODE.
BE IT ORDIANED BY THE CITY OF PASCO AS FOLLOWS:
Section 1. There is hereby added to the Pasco Municipal Code a new Chapter
16.04 entitled "Building Code", which chapter shall read as follows:
Chapter 16.04
Building Code
16.04.010 Adoption -of the Uniform Building Code. The Uniform Building Code,
with appendices, 1976 Edition prepared by the International Association of
Building Officials, and as herein amended or revised, is adopted by the City
of Pas:-o,and all buildings hereafter erected or constructed, enlarged, repaired,
removed, demolished, or converted shall be done in conformity with the pro-
visions of said.Uniform Building Code, except as expressly provided herein.
Three ;'3) copies of the Uniform Building Code, with appendices, 1976 Edition,
have theretofore been filed and are now on file in the office of the City
Clerk of the City of Pasco for use and examination by the public as required
by law mor to the adoption of this ordinance.
16.04.020 Substitution for UBC Sec—ion 204. Section 204 of the Uniform Buzldiny
Code shall be amended to read as follows:
Section 204. Board of Appeal:;. In order to determine and suitablity
of alternate materials and mathods of construction and to provide for
reasonable interpretation of Lhe provisions of this code, there shall
be and is hereby crated a Board of Appeals, to be known as the Mid-
.olumbia Building Appeals Commission, consisting of seven (7) members
who are qualified by experience and training to pass upon matters per-
caining to building construction. The Board of Appeals shall,be jointly
a_rpointed by the Mayors of Pasco, Kennewick and Richland and the Chairmen
of the Boards of County Commissioners of Benton and Franklin Counties.
The membership of the'Board shall consist of a representative of Franklin
County, a representative of Benton County, a civil engineer, an architect,
a general contractor, a speciality contractor and a fire specialist.
The term of membership on the Board shall be for a period of five (5)
years. The Building Officials of each appointing agency shall be ex -
officio members of the Board and shall serve as Secretary of the Board
on a rotating basis. The Board shall adopt reasonable rules and re-
gulations for conducting its investigations and shall tender all decisions
and findings in writing to all the Building Officials and Fire Chiefs
with a duplicate copy to the appellant and may recommend to the City
Councils and/or Boards of County Commissioners such new legislations as
is consistent therewith.
16.04.030 Amendment of UBC Section 303(b). Section 303(b) of the Uniform
Building Code shall be amended to read as follows:
(b) Plan -Checking Fees. Wht:n the valuation of the proposed construction
exceeds $1,000 and a plan is required to be submitted by Subsection (c) of
Section 301, a plan -checking fee shall be paid to the Building Official at the
time of submitting plans and spec.fications for checking: Said plan checking
fees for buildings of Groups R, Li•.,ision 3, and M occupancies shall be twenty
($20.00) .
Plan -checking fees for all other ;,uildings, shall be 65% of the building permit
fees as set forth in Table No. 3-11.

16.04.1:40 Amendment of UBC Table `d.. 3-A. Table No. 3-A of the Uniform

All final.plan-check and building permit fees shall be rounded off to the nearest
dollar.
16.04.050 Amendment of UBC Sectio;. 306(a). Section 306(a) of the 1976
Uniform Building Code shall be amended to read as follows:
(a) Use or Occupancy. No building or structure in Groups A to R-3, inclusive,
shall be used or occupied, and no substantial change in the existing occupancy
classification of a building or structure or portion thereof shall be made
until the Building Official has issued a Certificate of Occupancy -therefore
as provided herein.
16.04.060 Amendment of UBC Section 306(e). Section 306(e) of the 1976
Uniform Building Code shall be omitted and the following shall be substituted
in its place:
(e) Posting. The Certificate of Occupancy shall be posted in a conspicuous
place on the premises and shall not be removed except by the Building Official;
provided, that in the case of R-3 Occupancies, such certificate need not be
conspicuously posted but shall be available for inspection of the Building
Official upon request.
16.04.070 Addition of UBC Section 307. A new section, Section 307, is hereby
added to the 1976 Uniform Building Code and shall hereinafter be codified
as Section 16.04.070.of the Municipal Code as follows:
Section 307(a). Effective date urx)n which certificates of occupancy shall be
required for Group P.-3 Occupancies. All buildings or structures falling
within the R-3 classification as defined in Section 1401 of the 1976 Uniform
Building Code, for which building permits are issued after the effective date
of this ordinance, shall not be used or occupied until the Building Official has
issued a Certificate of Occupancy as provided in Section 306(a) of the 1976
Uniform Building Code as amended by PMC 16.04..050. All other Certificates
of Occupancy shall be required irrespective of when such building permits were
issued.

16.04.080 Eligibility for permanent city -provided utility services. The
utilities director is hereby direcued to deny any requests for utility services
including electrical service, solid waste removal and water and sewer service
on a permanent uses basis where t}.:.: applicant fails to demonstrate that the
dwell.ir:y in question has been issued a certificate of occupancy by -the building
official; provided, however, that provisional.utility services shall be avail-
able as are necessary for the pro7.er construction of the dwelling prior to the
issuance of the occupancy permit, in circumstances where the dwelling is un-
occupied. In the event that provisional service is provided and it becomes
apparent that the dwelling is being occupied, the utilities -director is hereby
authorized to discontinue such service.
16.04.090 Addition of UBC Section 308. Section 308 is hereby added to the
Uniform Building Code and shall hereinafter be codified as Section 16.04.090
of the Pasco Municipal Code as. follows:
Section 308 Obligation of the Parties: In the event of a violation of Section
16.04.050 and 16.04.070 above provided, it shall be presumed as a matter of
law that the person or persons who obtained the building permit or permits
for the ccn struction of the dwelling in question caused or allowed the occu-
pancy of the dwelling in violation of the above stated provisions.
Further, it shall be a violation of this code for any person or persons to
cause or allow the occupancy of a dwelling within catagories R-3 by any third
person or persons; where no certificate of occupancy has first been issued.
16.04.100 Amendment of UBC Section 503(d).4. Section 503(d)4 of the 1976
Uniform Building Code shall be amended to read as follows:
Section 503(d)4. One-hour occupancy separation between a Group R, Division
3, and 14 Occupancy. In the one-hour occupancy separation between a Group R,
Division 3, and M Occupancy, the separation may be limited to the installation
of materials approved for one-hour fire -resistive construction on the garage
side and a self-closing, tight -fitting solid wood door 1-3/8 inches in thick-
ness will be permitted in lieu of a one-hour fire assembly. Fare dampers
shall not be required in ducts pi=rcing this separation for ducts constructed
of not lEss than. No. 26 gauge galvanized steel. All other penatrations on
the garage side of this wall, such as, but not limited to plumbing and elec-
trical, shall be of metalic materials or one-hour approved materials.
16.04.110 Amendment of UBC Sectirn 1304. Section 1304 of the 1976 Uniform
Building Code shall be amended to read as follows:
Section 1304. Stairs, exits, and smokeproof enclosures. Stairs, exits, and
smokeproof enclosures shall be as specified in Chapter 33.
All stairs and exits in Group R, Division 1 Occupancies shall open directly
upon a street or alley.or upon a yard or court not less than 4 feet in width
directly connected to a street or alley by means of a passageway not less in
width than the stairway opening into such passageway and not less than 7 feet
in height.
Buildings more than one story in height shall have no transoms or ventilating
openings from guest rooms to public corridors.
Door openings from guest rooms to public corridors shall be protected as
specified in Section 3304.
Every sleeping room below the fourth story shall have at least one operable
window or exterior door approved for emergency egress or rescue. The units
shall be operable from the inside to provide a full clear opening without the
use of separate tools.

All egress or rescue windows from sleeping rooms shall have a minimum net
clear opening or 5.7 square feet. The minimum net clear opening height
dimension shall be 24 inches and the minimum net clear opening width dimen-
sion shall be 20 inches with the bottom of the opening no more than 44 inches
above the floor.
16.04.120 Amendment of UBC Section 1.404. Section 14.04 of the 1976 Uniform
Building Code shall be amended to read as follows:
Section 1404 Stairs, exits, and smokeproof enclosures in Group R, Division
3 Occupancies. Stairs, exits, and smokeproof enclosures shall be specified
in Chapter 33.
All stairs and exits in Group R, iivision 3 Occupancies shall open directly
upon a street or alley or upon a yard court not less than 4 feet in width
directly connected to a street or alley by means of a passageway not less in
width than the stairway opening into such passageway and not less than 7 feet
in height.

specified in Section 3304.

16.04.130 Amendment of UBC Section 1807(x). Section 1807(a) of the 1976
Uniform Building Code shall be amended to read as follows:
Section 1807(a). Scope. These requirements apply to buildings housing
Group B, Division 2 Occupancies used primarily as offices and to Group R,
Division 1 Occupancies.
Such buildings having floors used for human occupancy located more than 36
feet above the lowest level of Fire Department vehicle access shall conform
to the requirements of this Section in addition to other applicable require-
ments of this Code.
16.04.140 Amendment of UBC Section 1807(b). Section 1807(b) of the 1976
Uniform Building Code shall be amended to read as follows:
Section 1807(b). Compartmentation. Compartmentation shall be provided in
every building to provide areas of refuge for the building occupants. This
may be provided by either of the following:
1. Horizontal exits dividing a story into two or more areas of approximately
the same size not exceeding 10,000 square.feet; or
2. Subdividing the building into three-story compartments by interrupting
the stairshaft with smoke barriers every third floor or through the use
of smoke proof enclosures for all stairways or any other method which
will protect against the movement of smoke from one compartment to
another.

Openings in exterior walis, locat:d vertically above one another, shall be
protected by approved flame barr.2e2s extending 30 inches beyond the exterior
wall in the plan- of the floor or 1.y vertical panels not less than 3 feet in
height.
Horizontal exit walls used for compartmenting a building shall not have
openings therein which would permit transfer of smoke from compartment to the
other except for required exits. For sprinkler alternate see Section 1807(m).
16.04.150 Amendment of UBC Section 1907. Section 1907 of the 1976 Uniform
Building Code shall be amended to read as follows:
Section 1907. Special Provisions for Group B, Division 2 Office Buildings and
Group R, Division 1 Occupancies. Type 11-F.R. buildings shall comply with
the special provisions on high rise buildings in Section 1807.
EXCEPTION: The reduction provisions for roofs in Section 1807(m)2(i) are not
permitted.
16.04.160 Amendment of UBC Section 2305(d) Section 2305(d) of the 1976
Uniform Building Code shall be amended to read as follows:
Section 2305(d) Snow Loads. Snow loads full or unbalanced shall be considered
in place of loads set forth in Table No. 23-C, where such loading will result
in larger members or connections.
Potential accumulation of snow at valleys, parapets, roof structures, and
offsets in roofs of uneven configuration shall be considered. Snow loads
shall be 25 pounds per square foot.
16.04.170 Amendment of UBC Sectio,; 2311(a). Section 2311(a) of the 1976
Uniform Building Code shall be amended to read as follows:
Section 2311(a). Wind Design. General. Buildings or structures shall be
designed to withstand the minimum horizontal and uplift pressures set fortis
in Column 25 of Table No. 23-F and this Section allowing for wind from any
direction. The wind pressures set forth in Table No. 23-F are minimum values
and shall be adjusted by the Building Officials for areas subjected to higher
wind pressures. When the form factor, as determined by wind tunnel tests or
other recognized methods, indicates vertical or horizontal loads or lesser
or greater severity than those produced by the loads herein specified, the
structure may be designed accordingly.
16.04.180 Amendment of UBC Section 2517(c)2. Section 2517(c) of the 1976
Uniform Building Code shall be amended to read as follows:
Section 2517(c)2. Underfloor clearance. Wood joists or the bottom of wood
floors closer than 18 inches, or wood girders closer than 12 inches to the
ground underfloor areas and their supports, shall be of treated wood or all
heartwood of approved naturally durable species as listed in Section 2517(c)3.
Accessible underfloor areas shall be provided with an exterior 24 -inch by 24
inch access crawl hole. The well for the access hole must have a minimum
horizontal distance of 24 inches or if there is mechanical equipment under
the house, the opening must be capable of removing the largest piece of
equipment.
16.04.190 Amendment of UBC Section 2517(c)6. Section 2517(c)6 of the 1976
Uniform Building Code shall be amended to read as follows:

Section 2517(c)6. Founeation ver.r:ilation. Underfloor areas shall be
ventilated by an approved mechanical means or by openings in exterior
:�:ounda.l:%on walls.. Such openings _ill have a net area of notless than
one (1) square foot for each 25 li.r:aar feet of exterior wall. Openings
shall be located as close to corners as practicable and shall provide
cross ventilation on at least two approximately opposite sides. They shall
be covered with corrosion resistant wire mesh not less than 1/4 inch nor more
than 1/2 inch in any dimension.
16.04.200 Amendment of UBC Section 2518(9,)4. Section 2518(g)4 of the 1976
Uniform Building Code shall be amended to.read as follows:
Section 2518(g)4. Framing details. Studs shall be placed with their wide
dimension perpendicular to the walls. Not less than three studs shall be
installed at each corner of an exterior wall.
Bearing and exterior wall studs shall be capped with double top plates installed
to provide overlapping at corners and at intersections with other partitions.
End joints in double top plates shall be offset at least 48 inches.
Interior nonbearing partitions sha11 be capped with double top plates installed
to provide overlapping at corners and intersection with other partitions and
walls.
Studs shall be full bearing on a plate or sill not less than 2 inches in
thickness having a width not less than that of the wall studs.
16.04.210 Amendment of UBC Sectio: 2907(a). Section 2907(a) of the 1976
Uniform Building Code shall be amended to read as follows:
Section 2907(a). Footings. General. Footings and foundations unless
otherwise specifically provided, shall be constructed of masonry or concrete
and in all cases extend below the frost line which shall be determined to be
no less than 24 inches. Footings shall be constructed of solid masonary or
concrete, foundations supporting wood shall extend at least 6'inches above
adjacent finish grade. Footings shall have a minimum depth below finish
grade as indicated in Table 29-A unless another depth is recommended by a
foundation investigation.
Any hollow core masonry unit foundation that exceeds 24 inches vertical
height shall have all cores filled to a minimum of 6 inches above finish grade
with mortar or other materials acceptable to the administrative authority.
16.04.220 Amendment to UBC Section 3203(d)SB of the 1976 Uniform Building
Code shall be amended to read as follows:
Section 3203(d)5B. Metal shingles. The roof valley flashing shall be
provided of not less than No. 28 galvanized gauge corrosion -resistant metal
applied over an underlayment of not less than Type 15 felt. The metal shall
extend at least 8 inches from the center line each way. Sections of flashing
shall have an end lap of not less than 4 inches.
16.04.230 Amendment of UBC Section 3203(d)5C. Section 3203(d)5C of the
1976 Uniform Building Code shall be amended to read as follows:
Section 3203(d)5C. Asbestos cement shingles, slate shingles and clay and
cement tile. The roof valley flashing shall be provided of not less than No.
28 galvanized sheet gauge corrosion -resistant metal applied over an underlayment
of not less than Type 15 felt. The metal shall extend at least 11 inches from
the center line each way. Sections of flashing shall have an end lap of not less
than 4 inches.

6.04. 240 Amendment of UBC Section 3205(a). Section 3205(a.) of the 1976
Uniform Building Code shall be amended to read as follows:
Section 3205(a). Attics: Access, ilraft Stops and Ventilation. An attic
access opeing shall be provided in the ceiling of the top floor of buildings
with combustible ceiling or roof construction. The opening shall be located
in a corridor, hallway or garage of an R-3 occupancy and in.the corridor or
hallway of any other occupancy.
16.04.245 Addition to UBC Sectiot: _ 1-303(k). Section 3303(k) -;hall be added
to the Uniform ':filding Code to road as follows:
Section 3303(k). Door Construction. All exterior doors installed for use
to habitable portions of dwelling u -nits, if of wood construction, shall be
of solid core design.
16.04.257 Section 4902 Amended - .)esign Loads. Section 4902 of Chapter 49
of the Appendix of the Un -'form Building Code shall be amended to read as follows:
Design Loads. Patio covers shall be designed -and -constructed to sustain, within
the stress limits of this Code, all dead loads plus a minimum vertical live
load of 20 pounds per square foot. Such covers shall be designed to resist the
minimum horizontal wind loads set forth in this Code, except that where less
thal 12 feet high the horizontal wind load shall be as indicated in Table No.
49-A. In addition, they shall be designed to support a minimum wind uplift equa.
to the horizontal wind load acting vertical upward normal to the roof surface
except that for structures not more than 10 feet above grade the uplift may be
three-fourths (3/4) of the horizontal wind load. When enclosed with: insect
screening or plastic, wind loads shall be applied to the structure assuming it
is fully enclosed.
16.04.260 Adoption of Regulations :or Barrier Free Facilities. Pursuant to
the provisions of RCW 35.21.180 and in -conformance therewith, the Regulations
for Barrier Free Facilities, dated October 1, 1976, as promulgated by the
Washington State Building Code Advisory Council, are adopted by reference.
Three copies of. the Regulations for Barrier Free Facilities have been filed
for use and examination by the public in the office of the Pasco City Clerk.
16.04.27_0 Adoption of UBC Appendix Chapter 32 as contained in 1977 Supplement
to the Uniform Building Code. Pursuant to the provisions of RCW 35.21.180,
and in conformance therewith, the Uniform Building Code Appendix Chapter 32
as contained in the 1977 Supplement to the Uniform Building Code, is adopted
by reference. Three copies of the Uniform Building Code Appendix Chapter
32 as contained in the 1977 Suppl::nent to the Uniform Building Code have
been filed for use and examination by public in the office'of the Pasco City
Clerk.
16 04 280 Adoption of UBC Appendix Chapter 53, as contained in the 1977
Supplement to the Uniform Building Code. Pursuant to the provisions of
RCW 35.21.180 and in conformance therewith, the Uniform Building Code Appendix
Chapter 53 as contained in the 1977 Supplement to the Uniform Building Code
together with appropriate amendments and substitutions thereto, is adopted
by reference, three copies of the Uniform Building Code Appendix Chapter 53
as contained in the 1977 Supplement to the Uniform Building Code have been
filed for use and examination by the public in the office of the Pasco City
Cl erk .
16.04.290 Amendment of UBC Section 5303(c). Section 5303(c) of the 1977
Supplement to the Uniform Building Code shall be amended to.read as follows:
Section 5303(c). Residential Bui._dings not more than three stories in
height. The following provisions shall apply to all buildings and structures,
or portions thereof, not more than three stories in height and housing group
R occupancies.
1. Walls. The gross area of exterior walls above grade, including foundation
walls, shall have a combined thermal resistance (R) value of R-11. All
windows shall be insulated glass or storm windows.

16.04.300 Amendment of UBC Section 5303(c)2. Section 5303(c)2 of the 1977
Supple,.:ent to the Uniform Buildin_r Code shall be amended to read as follows:
Section; 5303(c),. Roofj,2eiling. 1':ny building that is heated or mechanically
cooled shall have a combined thermal resistance (R) value for roof/ceilings not
less than R-19.
16.04.310 Violations - Penalties. It shall be unlawful for any person, firm,
or corporation to violate any of the provisions of this chapter. Every person
convicted of a violation of any provision of this chapter shall be guilty
of a misdemeanor and shall be punished by a fine of not more than $500 or by
imprisonment for not more than 90 mays, or by both such fines and imprisonment.
Each firm or corporation convicted of a violation of any provision of this
Chapter shall be punished by a fine or not more than $500.
For any violation of a continuing nature, each day's violation shall be con-
sidered a separate offense and shall subject the offender to the above penalties
for each offense.
16.04.320 Savings Clause. Nothing contained in any provision of this code shall
apply to an offense charged at an, time before the day when this code shall
become effective. Any such offense shall be punished according to the pro-
visions of the ordinance or other laws existing when such offense was charged
in the same manner as if this code had not be enacted.
16.04.330 Severability. The invalidity of any article, section, subsection,
provision, clause, or portion thereof, or the.invalidity of the application
thereof to any person or circumstance, shall not affect the validity of the
remainder of this chapter or the validity of its application to other persons
or circumstances.
Section 22. Ordinance No. 1643 and Chapter 16.04 of the Pasco Municipal Code
is hereby repealed.
Section. 3. Effective Date. This ordinance shall be in full force and effect
after its passage and publication as required by law.
