AN ORDINANCE OF THE CITY OF PASCO WASHINGTON ADOPTING
FOR SAID CITY THE CLASSIFICATION OF NON -CHARTER CODE
CITY WITHOUT REOEGANIZATION TO BE GOVERNED BY THE
PROVISIONS OF CHAPTERS 35A.13 and 35.02 OF THE REVISED
CODE OF WASHINGTON UNDER THE COUNCIL-MANAGER PLAN OF
GOVERNMENT
WHEREAS, the City Council of the City of Pasco, by Resolution
No. 1047, passed August 3, 1976, declared its intention by Resolution
to adopt for the City of Pasco the classification of Non -Charter
Code City, retaining the council-manager plan of government under
which the City is presently operating, pursuant to Chapter 35A.02
of the Revised Code of Washington; and
WHEREAS, said Resolution No. 1047 was duly published in the
time and manner provided by law and more than 90 days have expired
from, but excluding, the first day of publication of said Resolution
No. 1047, and no referendum petition having been filed as prescribed
by Section 35A.29.170 of the Revised Code of Washington; and
WHEREAS, the City Council now desires to effectuate the intent
expressed in said Resolution No. 1047 by enacting an ordinance
adopting for said city the classification of Non -Charter Code City
in the manner provided hereinafter, now, therefore,
THE CITY COUNCIL OF THE CITY OF PASCO, WASHINGTON, DOES ORDAIN
AS FOLLOWS:
Section 1: There is hereby adopted for the City of Pasco,
Washington, the classification of Non -Charter Code City, retaining
the council-manager plan of government under which the City of Pasco
is presently operating, as provided in Chapter 35A.12 of the Revised
Code of Washington, endowed with all of the applicable rights,
powers, privileges, duties and obligations of a Non -Charter Code
City as the same now exists, or may be provided hereafter, including
any and all supplements, amendments, or other modifications to said
Title hereafter at any time inacted.
Section 2: The City'Clerk is hereby authorized and directed
to forward to the Secretary of State.a certified copy of this
Ordinance for filing pursuant -to Section 35A.02.040 as -amended,
of the Revised Code of Washington, on the effective date of this
Ordinance and upon which filing the City of Pasco shall thereafter
be classified as a Non -Charter Code Code as herein provided.
Section 3: Existing City Laws and Regulations. All ordinances,
resolutions, orders and elected and appointed positionsadopted
under the Third Class City Classification, where not in conflict
with state law shall continue .in .force until.repealed or 'amended
by the City Council under the newly adopted Optional Municipal
Code Classification of Non -Charter Code City .under the council—
manager plan of government.
Section 4: This Ordinance:shall be 'in full force and effect
,five days after its passage 'and-publication..as required by law.
PASSED BY THE CITH COUNCIL AND APPROVED this 16 day of
November, .1976.

Dear Mr. Whiting:
On November 17, 1976, our Deputy City Clerk, Mrs. Evelyn Wells, sent a
letter to the Secretary of State Office indicating that the
Pasco City Council had passed Ordinance No. 1823 adopting for the City
the classification of a non -charter code city. Unfortunately, the
above ordinance contained a typographical error citing Chapter 35 A.12
of RC14 rather than properly citing Chapter 35 A.13. Accordingly,
Ordinance No. 1832 was passed on December 4, 1976 correcting this error.
A copy of it was likewise sent to the Secretary of State's office.
I am writing to determine whether or not your office does furnish each
city which has elected to become a non -charter code city, with some
certification indicating that it is in fact a code city and has
complied to all applicable statuatory requirements. Inasmuch as we
have not received any formal notification from your office, we are not
quite certain what final steps are to be taken before the designation
becomes official. This is of some consequence to us since the City will
be utilizing a number of additional powers such as serving warrants
outside the City once we are certain that the new designation is official.
We would therefore appreciate some indication from your office that the
City is now an official non -charter code city.

MEMORANDUM
TO: All Department Heads February 23, 1977

SUBJECT: NON -CHARTER CODE CITY.
Attached is a copy of a letter from Donald F. Whiting, Supervisor of Elections
in the Secretary -of State's Office, indicating that we became a Code City as
of January 10, 1977. I know there have been some questions raised as to
whether or not we were in fact a Code City, but this letter settles the matter,
so that we can now take advantage of whatever additional authority is provided
in the statutes rela ting to Non -Charter Code Cities.

This letter is written to notify your office that the
certified copy of the City of Pasco Ordinance No. 1823
adopting the classification of a noncharter code city,
but retaining the council-manager form of government,
and Ordinance No. 1832 amending section 1 of Ordinance
No. 1823 to correct a typographical error, have been
officially filed with the office of the Secretary of
State (Elections Division) as of January 10, 1977.
