AN ORDINANCE AMENDING SECTION NOS. 13.16.020, 13.16.120,
13.52.410-<6.04.285, CREATING A NEW SECTION 13.04.080 AND
REPEALING SECTION 6.04•.287.
THE CITY COUNCIL OF THE CITY,OF PASCO DO ORDAIN AS FOLLOWS:
Section 1. That Section 13.16.020 of the Pasco Municipal Code be changed
to read as follows:
"13.16.020. DEPOSITS. All users of water, sewer and/or
garbage shall be required to make a cash deposit to the
City Treasurer and such deposit shall remain on deposit
without interest. Any moneys due the City for water,
sewer and/or garbage services shall be deducted from this
deposit at termination of service to the user. However,
at the end of any two (2) consecutive years of service
during.which time the user account has not been delinquent,
the City shall refund said deposit held in behalf of the
user. Further, if the required deposit has previously been
refunded and the account subsequently becomes delinquent,
the user shall again be required to make the cash deposit."
The required cash deposit, except as otherwise provided
herein, shall be as follows:
Water, Sewer and Garbage
3/4" water service $25.00
1" water service 30.00.
1 1/2" water service 40.00
2" and up water service. 50.00
Sewer Only 10.00
Garbage Only - See Section 6.04.285
Section 2. That Section 13.16.120 of the Pasco Municipal Code be changed
to read as follows:
"13.16.120. UNAUTHORIZED TURN -ON. It is a breach of the
contract between the City and the property owner for any
property owner; occupant or any:unauthorized person to
consent to, or turn water on or off at the curb cock, or
in the meter box, or to -use -any water after water has been
shut off by authorized -Water Department personnel and be-
fore the water -is turned on by authorized Water Department
personnel. There i -s hereby created a presumption that the
head of the household or manager of a firm consents to all
breaches of above referenced contract by members of house-
holds or firm, thereby becoming responsible for violations
of this Section of the Code. Any violations of this Section
will result in a Civil action being brought against the head
of household/firm for damages not to exceed $300."
Section 3. That Section 13.52.410 of the Pasco Municipal Code be changed
to read as follows: -
"13.52.410. REPAIR & CLEANING OF PRIVATE DRAIN PIPE.. Whenever
any private. drain pipe connected with any public sewer or drain
becomes obstructed, broken or out of order, the Health officer
shall, if the owner, agent or occupant of such premises fails
to repair the same after five days's notice so to do, cause
such drain pipe to be removed, reconstructed, replaced, altered
or cleaned, as he may deem expedient, at the expense of the
owner, agent or occupant of such premises and the cost thereof
shall be.collected in the manner provided in Section 13.48.020
and 13.48.030."

Section 4. That Section 6.04.285 of the Pasco Municipa'1 Code be changed
to read as follows:
"6.04.285. SOLID WASTE DEPOSIT. The person responsible
for the payment of solid waste service charges as pro-
vided herein shall be required to make a deposit to the
City Treasurer and such deposit shall remain on deposit
without interest. Any moneys due the City for solid
waste services shall be deducted from the deposit at the
termination of service to the user. However, at the end
of two years of continuous service during which time the
solid waste user account has not been delinquent, the
City shalU refund said deposit held fn behalf of the user.
Further-, if the required deposit has previously been re-
funded and the account subsequently becomes delinquent,
the user.shall again place on deposit the required cash
deposit.
The required cash deposit shall be the greater of ten
dollars or twice the monthly charges for the type and
anticipated amount of service to be provided. However, in
the event the person responsible has made a water/sewer
deposit for the same premises, the deposit schedule as
shown in Section 13.16.02.0 shall apply."
Section 5. That Secti.on 6.04.287.is hereby repealed.
Section 6. There is hereby created a new Section in the Pasco Municipal
Code, to be known as,"13.04.080 all charges shall be the liability of property
owner" and shall read as follows:
"Section 13.04.080. All .charges shall be the liability
of property owner. c argeslor water, sewer an
garbage services to a property shall be the direct
responsibility of the property owner and all billings
and charges will be mailed to the meter address unless a
written request is received from the property owner to
mail such billings or charges to other than the meter
address. Each account shall -be in the name of the property
owner. Exception to this section will be allowed for long
term commercial leases (3 years -or longer) upon receipt of
a signed copy of said lease."
Section 7. This Ordinance shall be in full force and dffect upon its
passage and publication as required by law.
