AN ORDINANCE' approving `and c'onfirming', the
assessments and assessment roll of Local Improve-
ment District No. '86, which has been created and

Avenue and -:Arthur Avenue from Columbia Street to
Court, S't'reet within the .'City of- Pasco,- Washington',`
to arterial standard's by grading., constructing and
installing,,,storm drains-,, qurbs,.,gu.tter,s., street
lighting, n.ecesls'ary sidewalks, base rock, leveling--
course,. asphalt concrete surfacing, and all
incdental'`-work, : as provided by. Ordinance. No..
1705:, and, levying 'and assessing the amount thereof,
against .the several 'lots, tracts, parcels of land
and other prope'rty,.'•shown on :the roll.
.WHEREAS, the assessment, 611 levying the special assessments
against properties located in Local Improvement Distr:ict,No.,86 in the
City.o'f Pasco, Washington, created under Ordinance;No. 1705, ..has been
filed with •the_Dir'ector' of Finance` and ex -officio City Clerk of the
City of Pasco, .'as provided' :by`'law; ' and
WHEREAS,:, notic.e of the time and place. of hearing thereof
and of. making• objectibns,' and protests.:to .said roll was duly published
at arid for the time and in the manner provided -by law, fixing the time
and place of hearing thereon`fgr. the 1.7th day of February, 19'76, at
the hour of 8:00.0'clockp.;m: (PST), in the. Council•Chambers of the
City Hall, at Pasco,- Washington,: and further -notice 'thereof was duly
mailed by the Director of Finance and 'ex -officio City Clerk.'to each
property-,- owner • shown on 'the. roll.; and
WHEREAS, at the time. and place fixed `and designated in the
notice, the -hearing ;was duly held and the rgity Council heard all
persons who wished to be'heard at'such hearing and duly considered
al'l protests made in.�wr ting and•,ove.rruie•d'the"same.; NOW, -THEREFORE,
" THE CITY'COUNCIL OF':THE-CITY OF PASCO, WASHINGTON, DO.
ORDAIN,. as follows:
Section' 1:• The 'assessments and assessment roll of Local
Improvement District No.. 8.6, which•has'been;,created and established
for the purpose of improving Fifth Avenue from
Columbia Street to Court Street within the City of Pasco, Washington,
to arterial standards by grading, constructing and installing storm
drains, curbs, gutters, street lighting, necessary sidewalks, base
rock, leveling course, asphalt concrete surfacing, and all incidental
work, as provided by Ordinance No. 1705, as the same now stand,
be and the same are hereby in all things and respects approved and
confirmed in the total amount of $ 98,985.98
Section 2. Each of the lots, tracts, parcels of land and
other property shown upon the roll is hereby determined and declared
to be specially benefited by said improvement in at least the amount
charged against the same and the assessment appearing against the
same is in proportion to the several assessments appearing upon said
. roll. There is hereby levied and assessed against each lot, tract,
parcel of land and other property appearing upon said roll the amount
finally charged against the same thereon.
Section 3. The assessment roll as approved and confirmed
shall be filed with the Treasurer of the City of Pasco for collection,
and the City Treasurer is hereby authorized and directed to publish
notice as required by law stating that the roll is in her hands
for collection and payment of any assessment thereon or any portion
of the assessment can be made at any time within thirty days from
the date of the first publication of said notice without penalty,
interest or cost, and that thereafter the sum remaining unpaid may
be paid in ten equal annual installments with interest thereon
hereby fixed at the rate of 8 % per annum. The first installment
of assessments on the assessment roll shall become due and payable
during the thirty -day period succeeding the date one year after the
date of first publication by the City Treasurer of notice that the
assessment roll is in her hands for collection and annually thereafter
each succeeding installment shall become due and payable in like
manner. If the whole or any portion of the assessments remains unpaid
after the thirty -day period, interest upon the whole unpaid sum shall

be charged at the rate of 8 % per annum and each year thereafter
one of the installments, together with interest due on the whole
of the unpaid balance, shall be collected. Any installment not paid
prior to the expiration of the thirty -day period during which such
installment is due and payable shall thereupon become delinquent.
All delinquent installments shall be subject to a charge for interest
at 8 % per annum and for an additional charge of 6% penalty
levied upon both principal and interest due upon such installment or
installments. The collection of such delinquent installments will
be enforced in the manner provided by law.
PASSED by the City Council of the City of Pasco, Washington,
at a regular open public meeting thereof, and APPROVED by the Mayor
of the City this 17th day of February, 1976.
