HomeMy WebLinkAbout1764 Ordinance• ORDINANCE N0, 1764 AN ORDINANCE ADOPTING RULES AND REGULATIONS GOVERNING THE USE OF CITY OWNED FACILITIES FOR RECREATION PURPOSES, MEETINGS, AND OTHER USES, AND SETTING FEES FOR THE SWIMMING POOLS, GOLF COURSE, RENTAL OF CITY COUNCIL CHAMBERS AND OTHER FACILITIES OWNED BY THE CITY, AND REPEALING RESOLUTION NOS. 7349 751, 7679 AND 890. WHEREAS, It is in the best interests of the City to provide for public use of City owned facilities, and WHEREAS, Rules and Regulations should be promulgated in order to provide that the facilities are maintained in the best possible condition, and WHEREAS, Certain fees should be established in order to provide the maximum use of the facilities, and a reasonable charge should be established for use of City facilities; NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PASCO DO RESOLVE AS FOLLOWS: Section 1. The following Documents attached hereto and by this reference incorporate herein are hereby adopted as the official Rules, Regulations and Fees governing use of City owned or operated facilities. A. Rules, Regulations and Fee Schedule for Use of City Owned Facilities (consisting of 5 pages and marked Exhibit A). B. Policy Statement - East Pasco Neighborhood Facility (consisting of 1 page and marked Exhibit B). C. Rental of City Council Chambers and Pasco Library (consisting of 2 pages and marked Exhibit C). D. Fees and Charges for Swimming Pools and Golf Course (consisting of 2 pages and marked Exhibit D). Section 2. Resolution Nos. 734, 751, 767, & 890 are hereby repealed. Section 3. This Ordinance shall be in full force and effect after its passage and publication as required by law. PASSED by the City Council and APPROVED as provided by law, this day of February 1976. Erickson, Director of Recreation & Parks Pursuant to the City Council Workshop meeting of 1/27/76, please find the attached proposed Ordinance for Rules and Regulations of City Owned Facilities. After discussion with the Council, the following changes have been made: 1. The actual Ordinance (cover page) has been reviewed by our City Attorney and heshas made necessary corrections. 2. At this point, no changes have been made on Exhibit A, Page 1, Item 3 pertaining to alcoholic beverages. Further investigation into this matter will be made by staff with a recommendation in the near future. 3. The hourly salary for supervision has been changed from the originally proposed $4 to $5, which reflects the necessary amount we have to pay for personnel benefits. Councilman Snider indicated an hourly salary should not be established akt afl,l�so that we would not have to change the Ordinance each time the supervisor's hourly salary changes. You will note on Exhibit A, Page 2, Item 11 states "at least $5..00 per hour, or the salary the supervisor of the event is currently being paid." This portion establishes that the minimum to be paid is $5 per hour, however, as the salary for supervision may increase year -after year, we would have the authority to charge more than the minimum of $5 per hour. Thus, we would not have to change the Ordinance each time the supervisor's hourly salary changes. 4. Exhibit A, Page 3, Item 16 - Fees & Charges: The charges now reflect the basic rental fee plus sales tax. 5. Exhibit A, Page 3, Item D shows the fee shall be per day to a maximum of one week for any event. ROE:cl enc. PASCO RECREATION & PARK DEPARTMENT RULES, REGULATIONS AND FEE SCHEDULE FOR THE USE OF CITY OWNED FACILITIES It is the policy of the City of Pasco to permit the use of City Facilities by community groups as much as possible within the regulations required for the protection of the interest and property of the City. The City Council hereby promulgates rules and regulations which shall govern the use of City owned facilities. No person, or group of persons, shall hold any meeting, or conduct group recreation activities in any facility except by permit and upon the terms and conditions hereinafter set forth, provided that such permit requirements shall not apply to scheduled City activities. Upon application, such permit will be issued unless (1) its issuance would obstruct and/or interfere substantially with City use and enjoyment by the Public, or (2) the date and time requested has previously been allocated by permit. 1. Applications must be completed by a qualified adult member of the organization requesting use. -y 2. All applications must be completed at least two (2) days in advance of the event. 3. No alcoholic beverages are allowed. 4. Cancellations must be made twenty-four (24) house in advance for applications where no charges are made. Cancellation must be made forty-eight (48) hours in advance for applications in which there is a charge. 5. Permittee shall restore facilities to the condition in which found; use of kitchen and utensils requires that dishes be washed, dried, and stored after use. If the facility is not left in said condition, the permittee will be charged the costs incurred by the City to restore the facility. Costs will apply to both labor and materials involved. 6. Equipment available for use shall be on inventory at the respective facilities. 7. A single application may be made for a series of stated meetings of like character. Exhibit A - Page 1 8.• Permittee shall hold the City free and clear of any and all claims for damages, and loss of property that may result from any act or omission on the part of the permittee or its agents while on City property. 9. If, in the opinion of the City, facilities are needed for a department program, applications may be revoked ten (10) days before the scheduled event. 10. Since the above policies have been established by the City Council, exception may only be made by special City Council action. Such applications must be made at least thirty (30) days in advance of the event. 11. At any time a recreational facility is used for any purpose except for a directly sponsored Pasco Recreation & Park Department activity, an employee of the Department, and/or City may be required to be present. An appro- priate fee for supervision of at least $5.00 per hour, or the salary the supervisor of the event is currently being paid maybe charged against the permittee for each hour the facility is open. 12. In the event a dance is the purpose for renting of a facility, a Police Matron and Police Officers may be required. These will be paid by the permittee. The cost of a business license, which is mandatory, will help defray part of this expense. The Chief of Police determines how many officers will be needed. 13. If, in the opinion of the Director of Recreation & Parks or his duly authorized representative, a supervisor is not needed, the charge for supervision may be waived. 14. If, in the event an organization, principles of an organization, or a group does not have the necessary monies for the use of any facility, the City Manager may give special approval for payment of fees within forty-eight (48) hours subsequent to the event. 15. The following classifications shall apply for the purpose of determining applicable fees and charges: CLASSIFICATION A: Public recreation activities that are co-sponsored by the Recreation & Park Department, such as flower shows, community celebrations, art exhibits, etc. There shall be no scheduled service charge, provided the event is free and open to the public. CLASSIFICATION B: Recreation activities and meetings that are organized, promoted, conducted, and sponsored by non-profit organizations, such as PTA, Community Clubs, Service Clubs, or Youth Service Agencies, such as Boy Scouts, Girl Scouts, Camp Fire Girls, CYO, YMCA, YWCA, etc., but do not include such groups as square dance clubs, choral groups, hobby clubs, grandmother's clubs, etc., which operate for the primary benefit of their own membership. B-1: If the event is free and open to the public, there shall be no rental fee charged. There may be a minimum of $5.00 per hour charged for a supervisor for each hour the facility is open. Exhibit A - Page 2. B-2: If an admission charge is to be made, donations received or articles or services sold, or club dues paid to meet actual expenses of the event, or if admission is limited to certain individuals such as members, invited guests, etc., there shall be a service charge in accordance with the rates listed herein. CLASSIFICATION'C: Any recreation, social or service activity conducted by any person or group of persons not included within Classification A or B hereinabove set forth. C-1: If the event is free and open to the public, there shall be no rental fee charged. There may be a minimum of $5.00 per hour charged for a supervisor for each hour the facility is open. C-2: If an admission charge is to be made, donations received or articles or service sold, or club dues paid to meet actual expenses of the event, or if admission is limited to certain individuals such as members, invited guests, etc., there shall be a service charge in accordance with the rates listed herein. CLASSIFICATION D: Any person or group of persons who desire to use outdoor park areas for financial gain, if -there is an admission charge, donations received, articles or services sold, there shall be a service charge in'accordance with the rates listed herein. This category would mainly apply to Arts & Crafts Fairs, park equipment displays, etc. 16. FEES AND CHARGE SCHEDULES: Community Center East Pasco Neighborhood Facility - Meeting Rooms Gymnasium Kurtzman Recreation Center Sylvester Park Building Outdoor Park Areas B-2 35 plus sales tax for each 24 hour period, plus a minimum of $5/hour for supervision. $10 plus sales tax for each 24 hour period plus a minimum of $5/hour.for supervision. $35 plus sales tax for each 24 hour period, plus a minimum of $5/hour for supervision. $10 plus sales tax for each 24 hour period, plus a minimum of $5/hour for supervision. $10 plus sal.es tax for each 24 hour period, plus a minimum of $5/hour for supervision. D The fee charged shall be $.05/sq. ft. per day. Maximum of one week for any event. Exhibit A - Page 3 C-2 60 plus sales tax for each 24 hour period, plus a minimum of $5/hour for supervision. $15 plus sales tax for each 24 hour period, plus a minimum of $5/hour for supervision. $60 plus sales tax for each 24 hour period, plus a minimum of $5/hour for supervision. $15 plus sales tax for each 24 hour period, plus a minimum of $5/hour for supervision. $15 plus sales,.tax for each 24 hour period, plus a minimum of $5/hour for supervision. In addition to the above charges, a $50 damage deposit may be charged prior to using the facility. Damage and/or extra cleaning charges will be subtracted from the damage deposit and returned to the organization, group or individual using the facility. If damage exceeds the $50 damage deposit, the organization, group or individual will be billed by the City for the additional costs of damage or cleaning. All fee's must be paid by cash', check or money order and made payable to the City of Pasco. Payment is due at least forty-eight (48) hours before the event. I. CLASSIFICATIONS: All applications for permit use must be categorized into one of the following: A, B-1, B-2, C-1, C-2, D, Special City Council Action II. SERIES OF DATES: Since Regulation No. 7 allows a single application for a series of stated meetings of like character, each specific date must be listed. Priority will be based on the following: 1. Classification 'A' has first priority, then Classification 'B', then Classification 'C' 2. Priority within each classification will be made on the basis of the type of activity and past record of usage. A. TYPE OF ACTIVITY: B. PAST RECORD OF USAGE: 1. Recreational 1. Care of facility 2. Social 2. Punctuality 3. Educational or Political '3. Payment of Fees 4. Other III. STORAGE: Due to limited storage space in City facilities, storage space is not available for groups, other than authorized Recreation & Park Department programs. IV. KITCHEN USE: Any organization using the kitchen facility must provide for its own towel and dishwashing detergent. It is also responsible for the clean-up of the kitchen (counter, floor, dishes and silverware washed, dried and put away, etc) . Exhibit A - Page 4 V. PAYMENT PROCEDURE: All groups must make payment directly to the Recreation & Park Department. Checks should be made out to the City of Pasco. Fees are due in the Recreation & Park Department Office, 1125 N. 4th or the East Pasco Neighborhood Facility Office, 205 S. Wehe at least forty-eight (48) hours in advance of the meeting date. VI. CANCELLATION: Applications with no service charge must cancel 24 hours in advance. Applications in which there is a service charge must be cancelled forty- eight (48) hours in advance of meeting date. Cancellations may be made by phoning the Recreation & Park Department Office. Exhibit A - Page 5 POLICY STATEMENT EAST PASCO NEIGHBORHOOD FACILITY It is the intention of the City of Pasco, the East Pasco Neighborhood Facility Board of Directors and staff to provide adequate social, educational and recreational programs to the residents of the community within the East Pasco Neighborhood Facility. 1. To comply with the Pasco Fire Department regulations and suggestions, there shall be no smoking allowed in the gymnasium, the kitchen, the raised platform, the restrooms in the gymnasium or the library. Smoking will be allowed in the conference room, the office areas and the front foyer to the gymnasium. 2. In order to comply with Fire Department regulations, the raised area in the south portion of the gymnasium shall be referred to as a "platform" and not a stage. It is understood that no storage will be allowed beneath the platform. It is also understood that bands, small dramatic and performing arts groups, speakers and events of this nature will be allowed to use the facility. However, performing arts groups with large backdrops, large stage sets and other activities that would cause a fire hazard will not be allowed. 3. Any individual, group or organization wishing to sponsor or conduct an activity within the building must first complete an application form with the Director or duly authorized representative. In most instances, all groups will be allowed use of the building. However, if an activity is questionable as to its nature, supervision, training of instructors or any other valid reason, the Director or duly authorized representative may deny use of the facility. 4. Any individual may be removed from the building for profanity, fighting, misuse of equipment, or any other type of flagrant behavior. Exhibit B - Page 1 RENTAL OF CITY COUNCIL CHAMBERS No person, or group of persons, shall hold any meeting, or conduct group activities in any facility described above except by permit and upon the terms and conditions hereinafter set forth, provided that such permit requirements shall not apply to scheduled activities. Upon application, such permit will be issued unless (1) its issuance would obstruct and interfere substantially with use and enjoyment by the public, or (2) the date and time requested has previously been allocated by permit, or (3) the use for which the permit is sought is of a private or commercial venture. 1.. Applications must be completed by a qualified adult member or advisor of the organization requesting use. 2. All applications must be completed at least four (4) days in advance of the event. 3. A single application may be made for a series of stated meetings of like character. 4. Permittee shall hold the City free and clear of any and all claims for damages, and loss of property that may result from any act or omission on the part of the permittee or its agents while on City property. 5. If, in the opinion of the City, facilities are needed for a department program, applications may be revoked ten (10) days before the scheduled event. 6. Governmental or Governmental sponsored activities are excluded from the fee charge. FEES For rent of the City Council Chambers, the rental shall be $10 for the first three (3) hours and $5 for each hour thereafter, or fraction thereof, up to the hour of 12 midnight, when the facility must be vacated. Exhibit C - Page 1 PASCO PUBLIC LIBRARY RENTAL POLICY The Edna Linbarger Auditorium with seating for 125 is open to any person or group of persons who wish to schedule the room for meetings or group activities. Reservation may be made through the desk clerk. Any non-profit group may use the facilities without charge. Any other group pays a nominal fee of $10 plus tax of 50� for a four hour period. If the kitchen is used for anything more than coffee, an additional charge of $5 plus 25� is charged. A deposit of $2.50 is required if a key is needed when the Library is closed. This deposit is refunded when the key is returned. Because it is a city -owned building, alcoholic beverages may not be used.
