HomeMy WebLinkAbout1747 Ordinance� � s ORDINANCE NO. 1747 AN ORDINANCE AMENDING SECTION 3 OF ORDINANCE 1596 (AND PASCO MUNICIPAL CODE CHAPTER 9.62.010) BEING AN ORDINANCE RELATING TO PUBLIC SAFETY AND MORALS; DECLARING ABANDONED VEHICLES AND ABANDONED VEHICLE HULKS TO CONSTITUTE PUBLIC NUISANCES AND PROVIDING FOR THE ABATEMENT THEREOF; DECLARING THE ABANDON- MENT OF A VEHICLE OR VEHICLE HULK, OR THE KEEPING OF AN ABANDONED VEHICLE OR VEHICLE HULK ON PRIVATE PROPERTY UNDER CERTAIN CIRCUMSTANCES, TO CONSTITUTE A MISDEMEANOR AND PROVIDING A PENALTY FOR VIOLATIONS; SPECIFIYING CIRCUMSTANCES UNDER WHICH VEHICLES AND VEHICLE HULKS ARE AUTHORIZED TO BE IMPOUNDED; PRO- VIDING FOR THE DISPOSITION OF IMPOUNDED VEHICLES AND VEHICLE HULKS, AND DECLARING AN EMERGENCY. THE CITY COUNCIL OF THE CITY OF PASCO DO ORDAIN AS FOLLOWS: Section 1. Section 3 of Ordinance No. 1596, and Pasco Municipal Code Chapter 9.62.010, are hereby amended to read as follows: Section 3. "Abandoned Vehicle on Public Property", except as otherwise provided in this section, means any vehicle which remains in substantially the same location for a period of five continuous days or longer on any street, alley or other public way in the City and after a period of ten days or longer from the date the written notice is mailed by the Pasco Police Department, by certified mail with a return receipt requested, to the last known registered or legal owner of any such vehicle. Section 2. This Ordinance shall be in full force and effect after its passage and publication as required by law. PASSED and APPROVED this 2 day of December, , 1975. Attest: Leo E. Tebaldi, Chief of Polic SUBJECT: Abandoned Vehicle Ordinance, Amendment Attached is my recommendation for amending the abandoned vehicle ordinance. I have also attached the section of the Municipal Code showing the deletions and changes. As you can see the only change I have recommended is in the time limit on vehicles abandoned on streets and/or public property. I have not recommended any change in the ordinance as it relates to vehicles on private property as we are bound by state law on that. I believe this minor change in the ordinance will give us the necessary means -to speed up the removal process. AMT:er ABANDONED.VEHICLES AND VEHICLE HULKS 9.62.220 Abandoned on private property -- Exemptions. 9.62.230 Removal of vehicle by property owner. 9.62.240 Penalty for violation. 9.62.010 DEFINITIONS (a) "Abandoned vehicle on private property" means any vehicle which remains for a period of twenty- four hours or longer on private property, in the city, owned or occupied by a person other than the vehicle owner or occupant of the private property.
