CITY OF PASCO ORDINANCE NO. 1732 AN ORDINANCE AUTHORIZING THE ACQUISITION AND CON- DEyiNATION OF CERTAIN REAL PROPERTY NEEDED FOR THE NEW PASCO KENNEWICK INTER -CITY BRIDGE PROJECT WHEREAS, The Cities of Pasco and Kennewick have embarked on a project to construct a new inter -city bridge; and WHEREAS, the real property described below is necessary for the construction and improvement of the bridge and for access, egress and right-of-way; and, WHEREAS, the owner of a portion of property needed, described below, and other persons interested therein, have refused to accept offers for said property which are reasonable in the judgment of the officers and agents of the City, NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PASCO, WASHINGTON, DOES ORDAIN AS FOLLOWS: Section 1: That certain real property situate in the City of Pasco, Washington, County of Franklin, and more particularly described as: That part of Lot 8, Section 31, Township 9 North, Range 30 East, W.M., described as follows: Beginning at a point on the southerly line of Washing- ton Street, which point is 80.40 feet westerly from the northeast corner of fractional Block 34, Riverside Addition to.the City of Pasco, according to the recorded plat thereof as filed in the office of the Auditor for said county; thence westerly along said southerly line of Washington Street produced 69.60 feet; thence southerly parallel with and distant 150 feet westerly from the west line of south 10th Avenue, shown on the plat of Riverside Addition as Harrison Street, to the North line of the 400 foot charter right of way for the Northern Pacific Railway; thence southeasterly along said 400 foot charter right of way line and said line produced to its inter- section with the west line of South 10th Avenue pro- duced southerly; thence northerly along said west line of South 10th Avenue to its intersection with the east line of Lot 8; thence Northerly along said East line of Lot 8, 224 feet, more or less, to the point of beginning: EXCEPTING and reserving therefrom however, the rights of way 25 feet in width, being 12.50 feet on each side from the center lines of the two spur tracts now located on said premises. And except that portion of land 25 feet in width lying parallel to South 10th Avenue, heretofore deeded to State of Washington. Fractional Lots 1, 2 and 20, Block 34, Riverside Addition, according to�the plat thereof recorded in Volume "B" of Plats, Page 44, in Franklin County, Washington, except any portion thereof conveyed.to the State of Washington for highway purposes. Is necessary .for the construction of the inter -city bridge and the owners have refused to sell the property to the City of Pasco for a price believed to be reasonable by the officers and agents of said City, and it is necessary that the City institute legal proceedings to ascertain and determine the just compensation to be paid for the real property by way of condemnation. Section 2: That certain real property situate in the Citv of Pasco, Washington, County of Franklin and more particularly described as: All that portion of Lots 15, 16, 17 and the vacated alley adjoining thereto, in Block 25, Riverside Addition to Pasco, according to the plat thereof recorded in Volume B of Plats, Page 44, lying Easterly of a line parallel with and 40 feet Westerly measured radially from the centerline of the Pasco approach to the Pasco -Kennewick Intercity Bridge. The lands being described herein contain an area of 0.12 acres, more or less, the specific details of which are to be found within that certain map now of record and on file in the office of the Franklin County Auditor, and bearing date of approval, May 2.8, 1974, and the centerline of which is also shown of record in Book A of Highway Plats, Page 294, records of said County; Is necessary for the construction of the inter -city bridge and the owners have refused to sell the property to the City of Pasco for a price believed to be reasonable by the officers and agents of said City; and it is necessary that the City institute legal proceedings to ascertain and determine the just compensation to be paid for the real property by way of condemnation. Section 3: That the City Manager of the City of Pasco is hereby authorized and directed to file a petition for condemnation in the Superior Court of the State of Washington in and for Franklin County so that the City may acquire title to the same for such compensation as may be adjudged to be just, and upon determination of said compensation and the person entitled thereto, that the authorized officers and employees of the City of Pasco make such payment as required by decree of Court and acquire ownership of the said real property. Section 4: This ordinance shall be*in full force and effect after its approval, passage and publication as required by statute in the official newspaper of the City of Pasco.
