ORDINANCE. NO. 1704
AN ORDINANCE RELATING TO THE LICENSING OF
ELECTRICAL PHONOGRAPHS, PINBALL GAMES OR
MACHINES., AND GAMES OR MACHINES OF SKILL
OR AMUSEMENT, AND AMENDING CHAPTER 5'.,20
OF THE PASCO MUNICIPAL CODE., ENTITLED
"JUKE BOXES, PINBALL GAMES AND OTHER .AMU`SE-
MENT DEVICES", BY.AMENDING SECTION NUMBERS

Section 1. Pasco Municipal- Code, Section 5.20.010 is hereby amended to read
as follows:
115.20.01.0 LICENSE REQUIRED. It is unlawful for any per"son, firm,
or corporation to own or have in his or its control or possession, or
to maintain, operate or permit to be operated, within the limits of the.
City, any electrical phonograph, pinball game, .ray gun, shuffle board,
pool table, foos ball., or any other game, machine,, table, device,,
game of skill or amusement device,, designed to be operated- or used
for ,playing music, or any type of';garne, either -upon payment of or inser-
tion of any coin , money or other- thing of value or representative thereof,,
and which is played or operated primarily for amusement and entertain-
ment, expressly excluding,, .however, any machine or device used ex-
clusively for the vending of` merchandise, without first securing and
paying the fee for a license. therefor as hereinafter provided. "Peep
Shows" or "Panorama type machines will be allowed only in establish-
ments licensed as "Arcades" under Section 5.64 of the Pasco Municipal.
Code."
S-ection 2. Pasco Municipal Code, Section 5.2 0.02 5 `is hereby amended to read
as 'follows
,.,,,2;0,4025 LICENSING GAMBLING GAMES . All gambling games, de. -
vices and activities are controlled under Srection 9..228 of; the Pasco
Municipal Code, and are expressly excluded from provisions of this
chap ter
Section 3. Pasco Municipal Code, Section 5.20.030 is hereby amended to read
as follows:
1!5..20.030 APPLICATION FOR LICENSE. The license shall be. obtained
from the City Clerk in accordance with the provisions of Section 5.20.010.. "
Section 4. Pasco Municipal Code, Section 5.20..080 is hereby_ .amended to read
as follows:
",5,.20.08'0 DISPLAY OF LICENSE - REPLACEMENT OF' LOST LICENSE -
DISPLAY OF DISTRIB,UT:OR`'S IDENTITY. License must, at all times,, be
plainly, displayed on premises. Said lic'ense will list the types of
electric. -phonographs`, mac'hines',,'`tables gam -es or'devices�licensed to
be on said premises and the number of each type. In the event of the
loss or destruction of a license,: a duplicate thereof. may be obtained
upon application therefor to the City Clerk and the payment of a fee in
the amount of One Dollar ($1.00) . All electrical phonographs, machines,
tables, games or devices owned by a distributorship, as defined in
Section 5.20•. 10.0 of this chapter, shall bear a sticker showing distribu-
tor's name and address.''

Section 5. Pasco Municipal Code, Section 5:2'0:100 is hereby amended to read
as follows:
"5.,20. 100 LICENSE FEES. The license fees to becharged hereunder
for electrical phonographs, machines , tables, games or devices as
specified under Section 5.20.010, shall be $500. per year, or any part
thereof, for each distributor who maintains, conducts, or operates one
or more such electrical phonograph, machine, table, game or device
to be known as a Distributor's License. For purpose of this chapter,
a Distributor is hereby defined as a ,person, firm or corporation who
furnishes any of the electrical phonographs, machines, tables, games
or devices licensed under this chalpter for use in any business establish-
ment other than owned' .or .operated by such person, firm or corpora,tion,.
In addition., the owner or operator of ahy business establishment having
any electrical phonograph,, machine, table, ,game ,or device, ,a's defined
in Section 5.20..010 on said, premises _must pay a fee of $50.00 per
machine each year, or fraction thereof.'''
Section 6. Pasco Municipal Code., Section 5.20. 110 is hereby amended to read
as follows-
" 5.20. 11.0 LICENSE PERIOD. The license period shall be for an an-
nual period, beginning January 1 s,t of any year and terminating Decem-
ber 31st of the same year.
Section 7. Pasco Municipal Code, Section 5.20. 130 is hereby amended to read
as follows:
"5.20.130 LICENSES NOT TRANSFERABLE:. Licenses shall not be
transferabl.bi�-'from one person to another and shall no't be transfer-
able from one type of electrical phonograph, .machine, table, game
or device to another."
Se -cation .8. Pasco .Municipal Code Section Numbers 5.20.02;0, 5.,20, 0:40, 5.20.:0'60,
5.2 0.070 5.2 0.09 0 and 5 .;2;0.1 &0 are hereby repealed.
Section 9 w This Ordinance shall be in full" force and effect'p.on its passage and
publication as required 'by law.
