ORDINANCE NO.
AN ORDINANCE PROVIDING FOR THE PROTECTION
OF THE PUBLIC HEALTH, WELFARE AND SAFETY BY
PRESCRIBING MINIMUM STANDARDS FOR THE DE-
SIGN, CONSTRUCTION OR INSTALLATION, REPAIR,
OR ALTERATIONS OF SWIMMING POOLS, PUBLIC
OR PRIVATE, AND EQUIPMENT RELATED THERETO;
REQUIRING A PERMIT AND INSPECTION THEREFORE;
PROVIDING FOR THE ADMINISTRATION AND ENFORCE-
MENT OF THE STANDARDS SET FORTH HEREIN; PRO-
VIDING FOR THE QUALIFICATION AND REGISTRATION
OF PERSONS ENGAGED IN THE BUSINESS OF SWIM-
MING POOL INSTALLATION OR ALTERATIONS OR
EQUIPMENT RELATED THERETO; AND PRESCRIBING
FOR PENALTIES FOR VIOLATIONS THEREOF; AND
REPEALING ORDINANCE NO. 1371 AND PASCO
MUNICIPAL CODE TITLE 20, AND ALL OTHER ORDIN-
ANCES OR PARTS OF ORDINANCES IN CONFLICT
HEREWITH.
THE CITY COUNCIL OF THE CITY OF PASCO DO ORDAIN AS FOLLOWS:
Section 1. The Uniform Swimming Pool Code, 1973 Edition, prepared by the Inter-
national Association of Plumbing and Mechanical Officials and as hereafter amended
or revised, is hereby adopted by the City of Pasco as its official Swimming Pool
Code.
Section 2. Three copies of the Uniform Swimming Pool Code, 1973 Edition, have
been filed for use and examination of 'the public in the office of the City Clerk prior
to the adoption of this ordinance.
Section 3. The Uniform Swimming Pool Code, 1973 Edition, is hereby amended by
adding a new section to read as follows:
"FENCES - All swimming pools shall be enclosed by a non -climbable
fence or other s'truc'ture, such fence to be not less than five (5) feet in
height and provided with a self-closing gate or gates equipped with a
latch or locking device operable only from the pool side of -the fence,
or by a locking device operable by a key only on the outside of the fence.
Said fence or structure shall be not closer than three (3) feet from the
water's edge on all sides of the pool."
Section 4. The Uniform Swimming Pool Code, 1973 Edition, is hereby amended by ad-
ding a new Section to read as follows:
"ZONING REGULATIONS -
(a) Any swimming pool located in any zone shall maintain the same front
and side yard setbacks as required by the Zoning Ordinance for the main
building.

(b) Public and semi-public pools may be approved in a Residential Zone
only after obtaining a special permit from the Board of Adjustment."
Section 5. Ordinance No. 1371 and Pasco Municipal Code Title 20 as it now appears
are hereby repealed, as well as all other ordinances or parts of ordinances in conflict
herewith.
Section 6. This ordinance shall be in full force and effect after its passage and
publication as required by law.
