AN ORDINANCE AMENDING SECTION 11 OF ORDI-
NANCE NO. 1537, PASCO MUNICIPAL CODE CHAP-
TER 6.04 AND ADDING TWO NEW SECTIONS TO
SAID ORDINANCE TO BE SECTIONS 17 AND 18,
PASCO MUNICIPAL CODE 6.04. , 6.04 ,
AND BEING AN ORDINANCE RELATING TO HEALTH
AND SANITATION; PROVIDING FOR AND REGULAT-
ING THE COLLECTION, TRANSPORTATION AND DIS-
POSAL OF SOLID WASTE IN THE CITY OF PASCO;
PROVIDING FOR RATES AND CHARGES THEREFOR;
CREATING A "SOLID WASTE FUND"; PROVIDING FOR
PENALTIES FOR THE VIOLATION THEREOF AND RE-
PEALING ORDINANCES IN CONFLICT HEREWITH .
THE CITY COUNCIL OF THE CITY OF PASCO DO ORDAIN AS FOLLOWS:
Section I, Section 11 of Ordinance No. 1537 and Pasco Municipal Code Section
6.04 .310 are hereby amended to read as follows:
"Section 11 . Billing Procedure. The charges for solid waste collec-
tion and disposal as included herein shall be compulsory and universal
and shall be billed by the Finance Department. Such charges shall be
included with the billing for water and sewer utility service. The charges
shall be paid to the City by the person responsible for the said utility
billings and shall be paid not later than 30 days after the billing is mailed
and, if not so paid, the charges shall be deemed delinquent. In the event
of delinquency, ;charges for solid waste collection and disposal shall be-
come a lien against the property prior to all other liens and encumbrances
filed subsequent to such notice except liens for general taxes and local im-
provement assessments. Interest shall accrue upon delinquent accounts
at 8% per year from date of delinquency until paid; and in the event of
foreclosure said lienable charge shall include all costs and fees of fore-
closing said lien. Billings for commercial accounts shall be mailed to the
tenant in possession unless special instructions to the contrary are re-
ceived from the owner. Billing for a residence or a multi -family residence
shall be charged to the tenant in possession of the premise providing
prior written authorization has been given by the property owner and any
required deposit has been made. "
Section 2, Ordinance No. 1537 is hereby amended by adding a new Section to be
Section 17, Pasco Municipal Code Section 6.04. to read as follows:
"Section 17. Solid Waste Deposit Fund. There is hereby created
a 'Solid Waste Deposit Fund' in which all solid waste deposit
moneys received by the City shall be deposited and held for the
express benefit of the depositor."
Section 3. Ordinance No. 1537 is hereby amended by adding a new Section to be
Section 18, Pasco Municipal Code Section 6.04, to read as follows:
"Section 18. Solid Waste Deposit. The person responsible for
the payment of solid waste service charges as provided herein shall
be required to make a deposit to the City Treasurer and such deposit

Section 2, Ordinance No. 1537 is hereby amended by adding a new Section to be

Section 3. Ordinance No. 1537 is hereby amended by adding a new Section to be

shall remain on deposit without interest. Any moneys due the City
for solid waste services shall be deducted from the deposit at the
termination of service to the user. However, at the end of two years
of continuous service during which time the solid waste user account
has not been delinquent the City shall refund said deposit held in be-
half of the user. Further, if the required deposit has previously been
refunded and the account subsequently becomes delinquent the user
shall again place on deposit the required cash deposit.
The required cash deposit shall be $10.00, but not less than twice
the monthly charge for the type and anticipated amount of service to
be provided. However, in the event the person responsible has also
made a water deposit for the same premise the amount of deposit herein
shall be $5.00, but not less than the monthly charge for the type and
anticipated amount of service to be provided."
Section 3. Effective Date. This ordinance shall be in full force and effect after
its passage and publication as required by law.
